Article 1 In order to promote the technical progress of the construction industry, strengthen the management of building energy conservation, improve the quality of construction projects and improve the urban environment, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) Municipality on the Promotion of Cleaner Production, the Regulations on the Quality Management of Construction Projects, the Regulations on Civil Building Energy Conservation and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 The term "ready-mixed concrete" as mentioned in these Measures refers to the concrete mixture which is mixed by cement, aggregate, water, admixture and mineral admixture in a certain proportion in a centralized mixing station (factory) and then transported by truck to the place of use for sale within the specified time. Article 3 These Measures shall apply to the production, transportation, use, supervision and management of ready-mixed concrete within the administrative area of this Municipality. Article 4 The municipal construction administrative department is responsible for the supervision and management of the production and use of ready-mixed concrete in this Municipality, and directly responsible for the supervision and management of the production and use of ready-mixed concrete in Wuhua District, Panlong District, Guandu District, Xishan District and Chenggong New District, Kunming National High-tech Industrial Development Zone, Kunming Dianchi National Tourism Resort and Kunming National Economic and Technological Development Zone (hereinafter referred to as the three development (holiday) zones); And provide business guidance to other counties (cities) and districts.

Other county (city) district construction administrative departments shall be responsible for the supervision and management of ready-mixed concrete within their respective administrative areas.

Environmental protection, urban management comprehensive administrative law enforcement, traffic management of public security organs, safety production supervision and other relevant departments shall, according to their respective functions and duties, do a good job in the management of ready-mixed concrete. Article 5 Construction and relevant administrative departments shall encourage ready-mixed concrete production enterprises to adopt advanced production equipment and technology, develop in a high-quality and large-scale way, promote comprehensive utilization of resources, save energy, and widely use industrial solid waste and energy-saving building materials in the production process.

Ready-mixed concrete production enterprises that have made outstanding contributions in technological progress, energy conservation, utilization of industrial solid waste and energy-saving building materials shall be commended by the construction administrative department and given special financial support. Article 6 Within the administrative area of this Municipality, ready-mixed concrete shall be used in construction projects with a one-time pouring volume of more than 6 cubic meters, and on-site self-mixing is prohibited:

(1) Construction projects in the main urban planning area (including three development (holiday) areas), Chenggong New District planning area, Anning City planning area, Dongchuan District, Shilin County built-up area and Shilin Scenic Area since 1 March, 2065438;

(two) since July 20 10 and 1 year, the construction projects in the county planning area of each county (city) district. Article 7 In the construction project that should use ready-mixed concrete in accordance with Article 6 of these Measures, in any of the following circumstances, the concrete can be mixed on the construction site by itself, and the construction administrative department shall record it before construction:

(a) due to road traffic reasons, the special vehicle for transporting ready-mixed concrete cannot reach the construction site;

(two) due to the special needs of construction projects, ready mixed concrete production enterprises can not produce;

(three) other mixing is really necessary in the construction site.

If concrete is mixed on the construction site by itself, effective measures such as safety protection, dust prevention, sound insulation and waste water discharge shall be taken in accordance with national standards and relevant provisions of environmental protection. Article 8 Ready-mixed concrete shall be used in construction projects conforming to the provisions of Article 6 of these Measures, and the construction unit shall incorporate the requirements for using ready-mixed concrete into the construction bidding documents and construction contracts.

The construction unit shall make a commitment to the construction administrative department to use ready-mixed concrete. Article 9 Ready-mixed concrete production enterprises shall obtain qualification certificates issued by construction administrative departments in accordance with regulations, and organize the production and sales of ready-mixed concrete within the scope of qualification.

Ready-mixed concrete production enterprises that have not obtained qualification certificates shall not produce and sell ready-mixed concrete. Article 10 When a ready-mixed concrete production enterprise establishes a mixing station (factory), it shall comply with the national, provincial and municipal regulations on resource conservation, clean production and safe and civilized production, so that the site of the mixing station (factory) is fully hardened and the greening reaches the standard, and it is equipped with corresponding facilities such as sewage treatment, dust removal, noise reduction and sand-gravel separation, and shall be reported to the municipal construction administrative department for the record. Eleventh ready mixed concrete production enterprises shall abide by the following provisions in the production process:

(a) strictly implement the relevant national and provincial standards, norms and procedures, establish and improve the quality and safety assurance system and operation mechanism;

(two) the use of qualified building materials, in accordance with the requirements of the relevant technical standards for sampling, storage, inspection and acceptance of raw materials into the factory, and the inspection and acceptance of information on file for future reference;

(three) it is forbidden to use excavated sand and gravel materials in key areas such as Dianchi Lake Basin;

(4) Other provisions of laws, regulations, rules and relevant technical standards. Twelfth in the process of using ready-mixed concrete shall comply with the following provisions:

(a) the construction unit or the construction unit purchases ready-mixed concrete from a production enterprise with corresponding qualifications;

(two) the construction unit shall make the roads on the construction site smooth and provide necessary conditions for the transportation and use of ready-mixed concrete;

(three) the supervision unit in accordance with the relevant provisions of the state, province and city and the contract, the construction unit in the construction of ready-mixed concrete supervision.

(4) Under the supervision of the supervision unit, the construction unit shall, jointly with the ready-mixed concrete production enterprises, conduct joint acceptance of the concrete entering the site in accordance with relevant national and provincial standards, norms, procedures and contract stipulations, and keep the acceptance data on file for future reference. Ready-mixed concrete without acceptance or unqualified acceptance shall not be used;

(five) the construction unit shall, under the supervision of the supervision unit, carry out the construction in accordance with the requirements of the national and provincial standards, norms and regulations on ready-mixed concrete to ensure the quality of concrete construction;

(six) other provisions of laws, regulations, rules and relevant technical standards.
