Article 22 of the Regulations on the Prevention and Handling of Medical Disputes
Once a medical dispute occurs, both doctors and patients can solve it through the following ways:
(1) Both parties negotiate voluntarily;
(2) apply for people's mediation;
(3) Applying for administrative mediation;
(four) to bring a lawsuit to the people's court;
(five) other ways as prescribed by laws and regulations.
Article 43
In the event of a medical dispute, if the parties fail to negotiate or mediate, they may bring a lawsuit to the people's court according to law. The parties may also bring a lawsuit directly to the people's court.
