Legal basis: Notice of the Ministry of Civil Affairs on the Identification and Treatment of Veterans Returning to Home with Illness; Civil affairs departments (bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government, civil affairs bureaus under separate state planning, and civil affairs bureaus of Xinjiang Production and Construction Corps:
After the related treatment of veterans returning home with illness has been improved, the number of veterans who require this treatment has gradually increased. In order to do a good job in the identification of veterans who return home sick, the relevant issues are hereby notified as follows after soliciting the opinions of the relevant military departments:
1. Article 51 of the Regulations on Pensions and Preferential Treatment for Military Personnel (hereinafter referred to as the Regulations) stipulates: "Veterans who return home sick refer to those who have fallen ill during their service and have not yet reached the conditions for disability assessment, and have been discharged by a military hospital." According to the provisions of Article 22 of the Regulations, disability assessment due to illness is limited to conscripts and junior non-commissioned officers who are sick during their active service. Therefore, it should be limited to demobilized conscripts and junior non-commissioned officers who are sick during their active service. The disease here refers to a chronic disease that can directly cause the residual feelings listed in the Military Disability Grade Standard.
Second, conscripts and junior noncommissioned officers suffering from chronic diseases who have difficulties in living after returning to their hometowns may apply to the civil affairs department of the people's government at the county level to enjoy the treatment of returning veterans who are sick, and submit or have the following materials:
(1) I apply;
(2) household registration book;
(3) veteran certificate;
(four) the military hospital certificate, especially one of the following:
1. The registration form of veterans with chronic diseases recorded in veterans' files or the certificate issued by the military system hospital that they suffered from chronic diseases during their service (to be confirmed by the hospital or the health department at a higher level);
2 recently copied from the military system hospital and stamped with the seal of the medical record management department.
(5) A copy of recent chronic diseases (especially those recorded in the original military hospital certificate) stamped by the hospital medical record management department, relevant physical examination reports, diagnosis conclusions, etc.
Three, the civil affairs department of the people's government at the county level to review the above materials, that meet the conditions, arrange the applicant in accordance with the provisions of the civil affairs department of the provincial people's government or to the designated hospital to check the chronic disease certificate issued by the military hospital. For those who have not recovered from chronic diseases in the army, fill out the Examination and Approval Form for Veterans Returning to their Homes in Sickness (the form style shall be formulated by the civil affairs department of the provincial people's government), which shall be examined and approved by the civil affairs department of the people's government at or above the county level. The specific examination and approval authority shall be stipulated by the civil affairs department of the provincial people's government.
Four, the examination and approval authorities that meet the conditions, in the "sick veterans back home approval form" signed opinions, approved to enjoy the treatment of sick veterans back home, from the date of approval next month by the civil affairs department of the local people's government at the county level to issue regular grants, and enjoy other related benefits. If it is examined and approved by the civil affairs department of the people's government at the county or prefecture level, the examination and approval authority shall submit the relevant materials to the civil affairs department of the provincial people's government for the record. The civil affairs department of the people's government at a higher level shall review the submitted materials and correct those that do not meet the conditions.
Five, the sick veterans have been cured or the living conditions have changed, and they no longer meet the conditions for enjoying the treatment, and the relevant treatment of sick veterans who have returned to China will be suspended.
Civil affairs departments in the process of handling, should be written notice sick veterans to the designated hospital for physical examination or submit relevant materials within a time limit to verify the above situation. And informed that "if the medical examination or related materials are not submitted as required within the time limit, the relevant treatment will be cancelled."
Six, sick or "Regulations" provisions of article forty-eighth of the death, from next month to stop the relevant treatment.
Seven, the civil affairs department of the provincial people's government can formulate specific implementation rules according to the local actual situation.
Eight, this notice shall be implemented as of the date of issuance. Former demobilized conscripts and junior noncommissioned officers shall also be handled in accordance with the spirit of this notice.
