Counties (cities) can refer to the provisions of this Ordinance.
Fireworks parties and other large-scale fireworks display activities that should be held with the permission of the public security organs according to law are not restricted by Articles 7 and 8 of these Regulations. Article 3 The management of setting off fireworks and firecrackers shall adhere to the principles of combining prohibition with restriction, safety and environmental protection. Article 4 These Regulations shall be organized and implemented by the Municipal People's Government.
The public security organs are responsible for the safety management of fireworks and firecrackers, and investigate and deal with illegal fireworks and firecrackers. Other relevant departments shall, in accordance with their respective responsibilities, do a good job in the supervision and management of fireworks and firecrackers.
Township (town) people's governments and sub-district offices shall do a good job in the management of fireworks and firecrackers within their respective administrative areas.
City residents' committees, villagers' committees and property service enterprises shall assist in the management of fireworks and firecrackers. Article 5 State organs, social organizations, enterprises and institutions, schools and other organizations shall carry out publicity and education activities on the lawful, civilized and safe discharge of fireworks and firecrackers.
Radio and television, newspapers, Internet and other information dissemination media should do a good job in the publicity and education of fireworks safety management. Article 6 Fireworks and firecrackers are prohibited in the following areas and places:
(a) the scope of protection of cultural relics protection units (points) and historical buildings;
(2) Transportation hubs such as stations and airports and railway line safety protection zones;
(3) Units that produce, manage, store and transport inflammable and explosive articles;
(4) Safety protection zones for power transmission and transformation facilities;
(5) Medical institutions, kindergartens, schools and places for the aged;
(six) shopping malls, markets, cinemas, squares and other crowded places;
(7) Parking lots, urban bridges and underground spaces;
(eight) key fire prevention areas such as mountains and grasslands;
(nine) other areas and places as prescribed by laws and regulations. Seventh in the city center, except for the areas and places where fireworks and firecrackers are prohibited as stipulated in Article 6, other areas are restricted discharge areas.
In the restricted discharge area, fireworks and firecrackers can be set off in the following time periods, and fireworks and firecrackers may not be set off in other time periods:
(1) From 8: 00 on New Year's Eve to 0: 30 on the first day of the first month;
(2) From 8: 00 to 23: 00 on the first day of the first month to the sixth day of the first month;
(3) From 8: 00 to 23: 00 on the fifteenth day of the first month. Eighth in the restricted discharge area, it is allowed to discharge C and D personal fireworks products that meet the safety and quality requirements of fireworks and firecrackers. Article 9 Urban residents' committees, villagers' committees and realty service enterprises may, in accordance with the provisions of these Regulations, agree on the areas and places where fireworks and firecrackers are prohibited within their respective administrative areas through civilized conventions, or the types of fireworks and firecrackers that need to be prohibited in the category of Class C and Class D individual discharge. Tenth above six winds, moderate pollution, severe pollution weather and its early warning period, it is forbidden to set off fireworks. Eleventh fireworks, shall have the following acts:
(a) throwing at people, vehicles, buildings (structures) and crowded places;
(2) Pointing to inflammable and explosive articles;
(3) Discharging or throwing in the corridors, corridors, roofs, balconies and windowsills of buildings;
(4) obstructing the safe passage of pedestrians and vehicles or affecting traffic order;
(5) Setting off fireworks and firecrackers in other ways that endanger public safety and personal and property safety. Twelfth minors under the age of fourteen should be accompanied by adults and stay away from the CMC. Thirteenth any unit or individual found in violation of the provisions of this Ordinance fireworks, have the right to dissuade or report to the public security organs.
Hotels, guesthouses, wedding companies and other units should discourage the discharge of fireworks and firecrackers in violation of the provisions of these regulations when undertaking banquets and ceremonies; Those who refuse to listen to dissuasion shall report to the public security organ. Fourteenth one of the following acts, the public security organ shall order it to stop setting off fireworks and firecrackers, and impose a fine of more than one hundred yuan to five hundred yuan on individuals and a fine of more than five thousand yuan to ten thousand yuan on units; If it constitutes a violation of public security administration, it shall be punished by the public security organ according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
(a) in violation of the provisions of the second paragraph of Article 6 and Article 7 of these regulations, setting off fireworks and firecrackers in areas, places and time periods where fireworks and firecrackers are prohibited;
(two) in violation of the provisions of article eighth of this Ordinance, the discharge of fireworks and firecrackers that do not meet the requirements of this Ordinance;
(three) in violation of the provisions of article eleventh of these regulations, fireworks and firecrackers are set off in a way that endangers public safety and personal and property safety. Fifteenth other acts in violation of the provisions of this Ordinance, laws and regulations have legal liability provisions, from its provisions. Article 16 State organs and their staff who abuse their powers, neglect their duties or engage in malpractices for selfish ends in the safety management of fireworks and firecrackers shall be given administrative sanctions by their units or competent authorities according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
