Regulations of Gansu Province on the Management of Rural Drinking Water Supply
Chapter I General Provisions Article 1 In order to strengthen the management of drinking water supply in rural areas, ensure the safety of drinking water in rural areas, and safeguard the legitimate rights and interests of both water supply and water users, these Regulations are formulated in accordance with the provisions of the Water Law of People's Republic of China (PRC) and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the planning, construction and operation, water source protection, water quality monitoring, water supply and other related activities of rural drinking water projects within the administrative area of this province. Article 3 The rural drinking water projects mentioned in these Regulations refer to all kinds of centralized water supply projects and decentralized water supply projects built to solve the drinking water problem of rural residents. Centralized water supply projects include water source projects, water intake facilities, water plants, water distribution networks, information monitoring systems, household facilities and related ancillary facilities; Decentralized water supply project includes facilities such as water cellar and small electric well. Article 4 The people's governments at or above the county level shall incorporate the rural drinking water supply into the national economic and social development plan of their respective administrative areas, increase capital investment in the construction and management of rural drinking water supply projects, and ensure the safety of rural drinking water supply.

Encourage units and individuals to invest and donate money to build and operate rural drinking water supply projects.

Encourage qualified areas to extend the urban public water supply pipe network to solve rural drinking water and realize the integration of urban and rural water supply. Fifth water administrative departments of the people's governments at or above the county level shall be responsible for the supervision and management of rural drinking water supply within their respective administrative areas.

The departments of development and reform, finance, health and family planning, environmental protection, land and resources, housing and urban and rural construction of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in the supply of drinking water in rural areas. Article 6 The people's government at the county level is the main body responsible for rural drinking water safety.

The water administrative department of the people's government at the county level is responsible for the planning, construction and management of centralized drinking water supply projects in rural areas.

The township (town) people's government shall coordinate the construction, operation, management and protection of rural centralized drinking water supply projects. Chapter II Planning and Construction Article 7 The planning of rural drinking water projects shall be formulated by the water administrative department of the people's government at or above the county level in conjunction with the departments of development and reform, health and family planning, housing and urban and rural construction, and environmental protection. , reported to the people's government at the same level for approval before implementation.

Rural drinking water project planning should coordinate urban and rural economic and social development, giving priority to the development of urban-rural integration and large-scale centralized water supply projects. Eighth rural drinking water supply water resources allocation should give priority to the use of surface water, rational exploitation of groundwater. Ninth people's governments at or above the county level shall give priority to the protection of rural drinking water centralized water supply project construction land. Tenth rural drinking water supply project site selection and construction, strict implementation of national and provincial technical standards and norms; The materials and facilities used in the project shall meet the relevant quality standards and the hygienic evaluation requirements of wading products.

Units engaged in the design, construction and supervision of centralized drinking water supply projects in rural areas shall have corresponding qualifications. Eleventh new construction, renovation and expansion of centralized drinking water supply projects in rural areas shall conform to the rural drinking water supply development plan, and shall be examined by the water administrative department of the people's government at or above the county level, and shall go through the relevant formalities in accordance with the relevant provisions before construction. Twelfth rural centralized drinking water supply projects across administrative regions and railways, highways, electricity, communications and other facilities, as well as forests and grasslands, the relevant regions and departments should give support.

If new construction, reconstruction and expansion of railways, highways, electric power and communication facilities cause damage to rural drinking water sources or water supply facilities, remedial measures shall be taken to compensate. Thirteenth rural centralized drinking water supply project tap water into households, organized by the construction unit or water supply unit, can also be built by villagers' committees or users in accordance with the provisions of the standard, the construction costs borne by users. Fourteenth rural centralized drinking water supply project is completed, it shall be accepted in accordance with the relevant provisions; Only after the acceptance is qualified can it be put into use. Chapter III Water Sources and Water Quality Article 15 People's governments at the county level shall designate water source protection areas for rural drinking water projects within their administrative areas, take protective measures and set up geographical indications and warning signs. Article 16 The competent department of environmental protection of the people's government at the county level shall undertake the protection of rural drinking water sources and the prevention and control of pollution, and the water administrative department of the people's government at the county level shall cooperate with the related work of water source protection. Seventeenth health and family planning administrative departments of the people's governments at or above the county level shall regularly supervise and inspect the health of rural drinking water within their respective administrative areas to ensure the safety of rural drinking water. Eighteenth rural drinking water supply quality should meet the national sanitary standards for drinking water. Rural drinking water supply quality monitoring institutions should strengthen daily supervision, and regularly carry out water quality testing on raw water, factory water and terminal water of rural drinking water supply projects within the county. The cost of water quality testing shall be borne by the finance at the corresponding level. Chapter IV Management and Operation Article 19 After the completion of the centralized drinking water supply project in rural areas, the ownership shall be determined in accordance with the following provisions:

(a) government investment in construction, owned by the state;

(two) the funds and government subsidies raised by rural collective economic organizations shall be owned by rural collective economic organizations;

(three) units or individuals to invest, government subsidies, owned by investors;

(four) the investment of the government, rural collective economic organizations, units or individuals shall be determined in accordance with the contract;

(five) government subsidies, water users to raise funds to raise labor construction funds, used by an administrative village or villagers' group, owned by the collective.
