China's Land Management Law stipulates: Article 62 Rural villagers can only own one homestead, and the area of the homestead shall not exceed the standards set by provinces, autonomous regions and municipalities directly under the Central Government.

According to Article 34 of the Measures for the Implementation of the Land Management Law of the People's Republic of China in Gansu Province, the villagers' application for the construction of residential land shall be announced to the villagers after being discussed and approved by the villagers' representative meeting, and submitted to the county (city, district) people's government for approval, and the approval letter for construction land shall be issued.

Rural villagers residential land according to the following standards:

(1) agricultural area: if the per capita arable land in this village is less than 667 square meters (1 mu), the homestead of each household shall not exceed 200 square meters, and if it exceeds 667 square meters (1 mu) but is less than 65438 square meters (2 mu), it shall not exceed 267 square meters,1..
