In order to effectively protect the personal and property safety of the public and citizens, effectively prevent and control the air and noise pollution caused by the discharge of fireworks and firecrackers, and ensure that the general public and tourists spend a safe, civilized and tidy Spring Festival, according to the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations on the Safety Management of Fireworks and Firecrackers, Several Provisions on the Management of Fireworks and Firecrackers in Haikou City and the requirements for the construction of the National Ecological Civilization Experimental Zone, During the Spring Festival and Lantern Festival in 2023 (0: 00 on June 6, 2023+10: 00 on October 265438 to 24: 00 on February 5), the municipal government decided to carry out the control of fireworks and firecrackers in some areas. The relevant matters are hereby notified as follows:
1. Fireworks and firecrackers are prohibited in the following areas of this city.
(a) ring highway, provincial road 2 12 north and Haikou east-west administrative boundaries (including Guilin Yang Economic Development Zone and Haikou Jiangdong New District; All the streets in the city; Xixiu Town, Changliu Town, Haixiu Town and Chengxi Town; Yunlong town, north of 2 12 provincial highway).
(2) The whole town administrative regions of six towns including Shishan Town, Yongxing Town, Longqiao Town, Lingshan Town, sanjiang town Town and Yanfeng Town.
(3) Mission Hills Tourist Resort in Haikou.

Article 1 In order to strengthen the management of fireworks and firecrackers, protect and improve the ecological environment, and ensure public safety and citizens' personal and property safety, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations of the State Council on the Safety Management of Fireworks and Firecrackers and other relevant laws and regulations, and combined with the actual situation of this Municipality.
Article 2 These Provisions shall apply to the production, operation, transportation and discharge of fireworks and firecrackers within the administrative area of this Municipality.
Article 3 The municipal and district people's governments shall strengthen their leadership over the management of fireworks and firecrackers, establish a coordination mechanism for the management of fireworks and firecrackers, and make overall plans to solve major problems in the management of fireworks and firecrackers.
The administrative department in charge of emergency management is responsible for the supervision and management of the safety production of fireworks and firecrackers; The public security department is responsible for the safety management of fireworks and firecrackers; The competent administrative department of ecological environment is responsible for the unified supervision and management of prevention and control in fireworks pollution.
Market supervision and management, comprehensive administrative law enforcement and other departments shall, in accordance with their respective responsibilities, do a good job in the management of fireworks and firecrackers.
Fourth Town People's government, street offices should be fireworks management into social governance, strengthen organization, coordination, guidance and supervision.
Neighborhood (village) committees and property service enterprises shall cooperate with the management of fireworks and firecrackers.
Article 5 The municipal, district people's governments and their relevant departments, the town people's governments and sub-district offices shall organize publicity and education on the management of fireworks and firecrackers, advocate a green and civilized lifestyle, and encourage the operation and use of safe and environmentally friendly substitutes such as electronic firecrackers and fireworks containers.
Neighborhood (village) committees and property service enterprises should strengthen publicity and education for residents, villagers and owners, and guide them to change their customs.
Radio, television, newspapers, internet and other media and telecom operators should do a good job in the management of fireworks and firecrackers and public welfare publicity to change customs.
Schools and guardians of minors shall publicize and educate minors on the management of fireworks and firecrackers.
Article 6 Fireworks and firecrackers are prohibited in the following areas of this Municipality:
(a) expressway, provincial road 2 12 north and Haikou city, east and west administrative boundaries near the area;
(two) other areas designated by the Municipal People's government and announced to the public.
The area where fireworks and firecrackers are prohibited shall be reasonable according to law and gradually extended to the administrative area of this Municipality.
The Municipal People's Government may, according to the early warning of heavy pollution weather, take emergency measures to completely ban the discharge of fireworks and firecrackers within the administrative area of this Municipality.
Article 7 Fireworks and firecrackers are prohibited in the following places outside the areas specified in Article 6 of these Provisions:
(a) the location of state organs, archives, libraries, museums, cultural centers, gymnasiums and cultural relics protection units;
(2) Kindergartens, schools and scientific research institutions;
(3) Medical institutions and pension institutions;
(four) commercial squares, bazaars, cultural and entertainment places;
(5) Transportation hubs such as stations, docks and airports and railway line safety protection zones;
(6) Within the safety protection zone of power transmission and transformation facilities;
(seven) gas stations, liquefied petroleum gas stations and other inflammable and explosive goods production and storage units;
(eight) key fire prevention areas such as mountainous areas and scenic spots;
(nine) the provisions of laws and regulations and other places designated and announced by the Municipal People's government.
The property owner or manager of the place specified in the preceding paragraph shall clearly define the prohibited discharge scope of the place according to law and do a good job in management, and set up warning signs at the entrance or exit or in a prominent position.
Article 8 In areas other than the areas and places where fireworks and firecrackers are prohibited as stipulated in Articles 6 and 7 of these Provisions, fireworks and firecrackers are prohibited at other times except on New Year's Eve, the first day of the first month of the first month and from 6: 00 to 22: 00 every day.
The Municipal People's Government may, in accordance with the provisions of laws and regulations, adjust the time for prohibiting the discharge of fireworks and firecrackers as stipulated in the preceding paragraph according to the actual situation, and announce it to the public.
Ninth it is forbidden to set off fireworks and firecrackers in the following ways:
(1) Throwing at pedestrians, vehicles, inflammable and explosive articles, buildings and crowded places;
(two) in the balcony, window sill, indoor, corridor, roof discharge or throwing;
(three) other ways to endanger public security and personal and property safety.
Minors who set off fireworks and firecrackers shall be accompanied by their entrusted guardians or other persons with full capacity for civil conduct.
Tenth in major public celebrations and other festivals, it is necessary to hold a fireworks party or other large-scale fireworks display activities, the organizer shall apply to the public security department, and after approval, set off fireworks at the designated time and place.
Article 11 Whoever engages in fireworks and firecrackers in this Municipality shall apply to the emergency management administrative department for a business license for fireworks and firecrackers according to law, and shall operate in strict accordance with the determined business premises, types of fireworks and firecrackers and limited storage, and shall not buy or sell fireworks and firecrackers illegally produced and operated.
If the administrative department in charge of emergency management changes or withdraws the legally effective business license for fireworks and firecrackers, causing property losses to citizens, legal persons or other organizations, it shall make compensation according to law.
Twelfth fireworks shall not be sold in the areas and places where fireworks and firecrackers are prohibited as stipulated in Articles 6 and 7 of these Provisions.
The establishment of fireworks business premises in this Municipality shall be decided by the Municipal People's Government and its relevant departments according to the actual situation.
Thirteenth by road transport of fireworks, shall obtain the permission of the public security department according to law.
The transportation of fireworks and firecrackers by rail, waterway and air shall be carried out in accordance with the relevant laws, regulations and rules on the safety management of railway, waterway and air transportation.
Fourteenth it is forbidden to carry fireworks and firecrackers on public transport.
It is forbidden to mail fireworks and firecrackers, and it is forbidden to carry fireworks and firecrackers in checked luggage, parcels and mails.
Article 15 Any unit or individual has the right to dissuade acts in violation of these Provisions, and can directly complain and report to the public security and other relevant departments through the 12345 public service hotline. The relevant departments shall handle it in a timely manner, keep the information of the complainant or informant confidential, and may give appropriate rewards as appropriate.
Article 16 Whoever, in violation of the provisions of Articles 6 to 9 of these Provisions, sets off fireworks and firecrackers in an area, place and time where fireworks and firecrackers are prohibited, or sets off fireworks and firecrackers in a way that endangers public safety and personal and property safety, shall be ordered by the public security department to stop the discharge, and shall be imposed a fine of more than 100 yuan and less than 500 yuan; Those who violate the administration of public security shall be punished according to law.
Seventeenth in violation of the provisions of article tenth, without permission to hold a fireworks party or other large-scale fireworks display activities, the public security department shall order it to stop the discharge, and impose a fine of not less than ten thousand yuan but not more than fifty thousand yuan on the organizer.
Article 18 Whoever, in violation of the provisions of Article 11 of these Provisions, continues to operate fireworks and firecrackers without permission, beyond the scope of permission and at the expiration of the license period, shall be ordered by the administrative department in charge of emergency management to stop illegal business activities, and shall be fined more than 20,000 yuan/kloc-0.00 million yuan, and the illegally operated articles and illegal income shall be confiscated; If it constitutes a violation of public security administration, it shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Operators engaged in the retail of fireworks and firecrackers illegally produce and operate fireworks and firecrackers, and the emergency management administrative department shall order them to stop the illegal behavior, impose a fine of 1000 yuan to 5,000 yuan, and confiscate the illegally operated items and illegal income; If the circumstances are serious, the business license of fireworks and firecrackers shall be revoked.
Article 19 Whoever, in violation of the provisions of the first paragraph of Article 13 of these Provisions, transports fireworks and firecrackers by road without permission shall be ordered by the public security department to stop illegal transportation activities, and shall be fined between RMB/kloc-0 and RMB 50,000, and the illegally transported articles and illegal income shall be confiscated; If it constitutes a violation of public security administration, it shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 20 Whoever, in violation of the provisions of Article 14 of these Provisions, takes fireworks and firecrackers by public transport, or sends fireworks and firecrackers by mail, or carries fireworks and firecrackers in checked luggage, parcels and mails shall be confiscated by the public security department and may be fined more than 200 yuan 1000 yuan.
Twenty-first acts in violation of these provisions, these provisions have not set penalties, but other laws and regulations have set penalties, in accordance with the provisions of relevant laws and regulations.
In violation of the provisions of this act, according to the provisions of the State Council, the relatively centralized power of administrative punishment has been determined by the comprehensive administrative law enforcement departments, from its provisions.
Twenty-second national staff responsible for fireworks management dereliction of duty, abuse of power, corruption, shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Twenty-third the specific application of these Provisions shall be interpreted by the Municipal People's government.
Article 24 These Provisions shall come into force on June 2020 1 65438+1October1day.
