Legal analysis: the law stipulates that the bride price does not have to be returned. In most cases, it doesn't need to return. In three cases, the bride price must be returned. According to the judicial interpretation, according to China's current national conditions, if the bride price is paid according to the custom, there are three situations in which the bride price can be requested to be returned: First, if the two parties have not gone through the marriage registration formalities, but have not lived together, it is the payment before marriage that makes the life of the payer difficult. The latter two items should be based on the premise of divorce. The Law on Divided Return of Bridal Gifts stipulates that bride price payment is based on local customs and habits, which is different from unconditional gift, and its essence is conditional gift. Paying the bride price and collecting the bride price are based on the premise of concluding a marriage relationship. The judicial interpretation of the Supreme Court also clearly stipulates the return of bride price.
Legal Basis: Interpretation of the Supreme People's Court on Several Issues Concerning the Application of the Marriage Law of the People's Republic of China (II) Article 10 If a party requests to return the bride price paid according to custom, the people's court shall support it if it is found that it belongs to the following circumstances:
(1) Both parties have not gone through the marriage registration formalities;
(2) Both parties have gone through the marriage registration formalities, but they have not lived together;
(3) premarital payment, causing difficulties to the payer.
The application of items (2) and (3) of the preceding paragraph is conditional on the divorce of both parties.
