Regulations of Dongguan Municipality on the Administration of Outdoor Advertising Facilities and Signboards
Chapter I General Provisions Article 1 In order to standardize the management of outdoor advertising facilities and signboards and create a clean, beautiful and safe city appearance environment, these Regulations are formulated in accordance with the Advertising Law of People's Republic of China (PRC), the Regulations on the Administration of City Appearance and Environmental Sanitation, the Regulations on Highway Safety Protection and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the installation of outdoor advertising facilities and signboards and their supervision and management activities within the administrative area of this Municipality. Article 3 The term "installation of outdoor advertising facilities" as mentioned in these Regulations refers to the act of using the following carriers to set up exhibition boards, electronic display devices, light boxes, neon lights, luminous fonts, advertising columns, physical modeling, lighting patterns or other forms of advertising facilities in outdoor space:

(a) buildings (structures) and fences (fences) on the construction site;

(two) roads, squares, bridges, tunnels, platforms, docks and other outdoor venues;

(three) bus shelters, newsstands, telephone poles, poles and other outdoor public facilities;

(4) Cloth, balloons and inflatable devices;

(five) the appearance of buses, ships, urban rail transit and other means of transportation;

(6) Other carriers.

Signboard setting as mentioned in these Regulations refers to the behavior of individual industrial and commercial households, legal persons and unincorporated organizations to set up signs, light boxes, neon lights and text symbols indicating the unit name, font size, signboards or the name of buildings (structures) in their business premises, offices or buildings with legal ownership. Article 4 The comprehensive law enforcement department of urban management is the administrative department in charge of outdoor advertising facilities and signboards, and is responsible for the supervision and management of outdoor advertising facilities and signboards in accordance with the provisions of these Regulations.

The municipal transportation department is responsible for the supervision and management of the ground advertising sign facilities at the outer edge of the ditches on both sides of the highway within the range of 50 meters of national highway, 30 meters of provincial highway, 20 meters of county road and 0/0 meter of township road.

City natural resources, housing and urban construction, market supervision, emergency management, public security, meteorology, rail transit and other departments should do a good job in the management of outdoor advertising facilities and signs in accordance with their respective responsibilities.

Town People's Government (street offices) shall do a good job in the preparation of outdoor advertising planning within its jurisdiction, and exercise the power of administrative punishment and related administrative inspection and administrative compulsory measures as stipulated in this Ordinance in accordance with the list of matters for adjustment of functions and powers formulated by the provincial people's government and the Municipal People's government.

The Town People's Government (street offices) shall strengthen the capacity building of law enforcement and impose administrative penalties in accordance with legal procedures. The Municipal People's Government and its departments shall strengthen organization and coordination, business guidance and law enforcement supervision, establish and improve the coordination mechanism of administrative punishment, and improve the evaluation system. Article 5 The installation of outdoor advertising facilities and signboards shall be safe, beautiful, reasonable in layout, energy-saving and environmentally friendly, conform to the requirements of outdoor advertising planning, urban appearance standards and technical specifications for the installation of outdoor advertising facilities and signboards, adapt to the functions of urban regional planning, and coordinate with the surrounding environment. Article 6 Advertising industry associations shall strengthen industry self-discipline, standardize industry management, and create a market environment of fair competition and honest operation. Chapter II Technical Specifications for Planning and Setting Article 7 Outdoor advertising planning includes outdoor advertising special planning and outdoor advertising setting planning. The special planning of outdoor advertising should define the spatial layout of classified control of urban outdoor advertising facilities, and should be divided into restricted areas, strictly controlled areas and prohibited areas. Outdoor advertising planning shall specify the location, quantity, location, form and other specific requirements of outdoor advertising facilities.

Outdoor advertising special planning by the city management comprehensive law enforcement departments in conjunction with the municipal transportation, natural resources and other relevant departments. Starting from the outer edge of ditches on both sides of the highway, the location planning of ground advertising sign facilities within the range of 50 meters of national highway, 30 meters of provincial highway, 20 meters of county road and township road 10 meter shall be compiled by the municipal transportation department as an integral part of the special planning of outdoor advertising. Outdoor advertising special planning by the municipal urban management comprehensive law enforcement departments reported to the Municipal People's government for approval and promulgation and implementation.

Outdoor advertising planning by the town people's government (street offices) according to the special planning of outdoor advertising, solicit the opinions of the comprehensive law enforcement department of urban management, by the town people's government (street offices) reported to the municipal transportation department announced the implementation. Outdoor advertising planning should use public resources to plan a certain proportion of public service advertising facilities, but not in the name of public service advertising design, production or disguised release of commercial advertising.

Temporary outdoor advertising facilities are not included in outdoor advertising planning. Eighth in any of the following circumstances, outdoor advertising facilities shall not be set up:

(a) in the state organs, schools, hospitals, cultural relics protection units, scenic spots, construction control zones, geological disaster risk zones;

(two) using or blocking signs, traffic lights, traffic signs, traffic safety facilities and traffic technology monitoring equipment;

(three) the use of street trees, or occupy motor vehicles and sidewalks;

(four) the use of overpasses, elevated bridges, dangerous buildings or buildings that may endanger safety;

(five) the use of the construction site enclosure (block) to set up commercial advertisements, except for the display of the name, font size, logo and engineering information of the owner and the construction unit;

(six) using the facade of buildings along the street to hang curtains;

(seven) in the building roof (roof) new outdoor advertising facilities;

(eight) in the highway construction control area, the new ground advertising signs;

(nine) affect the use of municipal public facilities, traffic safety facilities, traffic signs, fire safety facilities, barrier-free facilities, or hinder the passage, escape, fire fighting and rescue of fire engines;

(ten) hinder the production or people's life, damage the city appearance or architectural image;

(eleven) other circumstances in violation of laws and regulations and the provisions of this Municipality's outdoor advertising planning.
