Urban and rural planning as mentioned in these Regulations includes urban system planning, urban planning, town planning, township planning and village planning. Urban system planning is divided into provincial urban system planning and regional urban system planning. Urban planning and town planning are divided into overall planning and detailed planning. Detailed planning is divided into control detailed planning and construction detailed planning.
The planning area as mentioned in these Regulations refers to the built-up areas of cities, towns and villages, and the areas where planning control must be implemented due to the needs of urban and rural construction and development. Towns, townships and villages within the urban planning area, and villages within the town and township planning area shall not be designated separately. Article 3 Cities, towns and townships shall formulate city plans, town plans and township plans.
The people's governments at or above the county level shall determine the areas where village planning should be formulated. Encourage other villages to make village plans according to development needs. Article 4 The formulation and implementation of urban and rural planning shall conform to the requirements of scientific development, follow the principles of overall planning of urban and rural areas, adjusting measures to local conditions, rational layout, land conservation, intensive development, planning before construction, pay attention to the combination of recent construction and long-term development, promote the conservation and comprehensive utilization of resources and energy, protect natural resources and historical and cultural heritage, highlight regional characteristics and traditional features, and improve the living environment. Article 5 The compilation of overall urban planning, town planning, township planning and village planning shall be based on the national economic and social development planning and be linked with the overall land use planning. Article 6 People's governments at all levels shall include the funds for the preparation and management of urban and rural planning into the fiscal budget at the corresponding level. The people's governments at or above the county level shall give financial support to the preparation of town planning, township planning and village planning.
The financial department of the people's government at or above the county level shall, according to the needs of urban and rural planning and management, arrange urban and rural planning and management funds in the annual budget. Article 7 Urban system planning, urban planning, town planning, township planning and village planning approved according to law are the basis for urban and rural construction and planning management, and may not be amended without legal procedures.
Construction activities in the planning area shall conform to the urban and rural planning approved according to law. Article 8 People's governments at all levels shall strengthen the management of urban and rural planning, encourage the adoption of advanced science and technology, enhance the scientificity of urban and rural planning, and improve the efficiency of implementation, supervision and management of urban and rural planning.
Units and individuals that have made remarkable achievements in urban and rural planning shall be commended and rewarded by the people's governments at or above the county level and their relevant departments. Article 9 The Urban and Rural Planning Committee of the people's government at or above the county level is the deliberative body of the urban and rural planning decision-making of the people's government at the corresponding level, and is responsible for examining the draft urban and rural planning that needs the approval of the people's government at the corresponding level and other draft urban and rural planning that needs to be examined, and putting forward examination opinions to the people's government at the corresponding level.
The Urban and Rural Planning Committee is composed of the people's government at the corresponding level and its relevant administrative departments, experts and public representatives, and its members are appointed by the people's government at the corresponding level. The urban and rural planning committee shall, according to the responsibilities determined by the people's government at the corresponding level, establish and improve the operating procedures and voting methods. Article 10 The competent department of urban and rural planning of the people's governments at or above the county level shall be responsible for the management of urban and rural planning within their respective administrative areas. Among them, the urban and rural planning work in the urban planning area of a city with districts is managed by the competent department of urban and rural planning of the municipal people's government with districts. The agency of the competent department of urban and rural planning of the municipal people's government with districts shall undertake the relevant urban and rural planning management work in accordance with the prescribed responsibilities.
The people's governments of towns and townships other than the towns where the county people's government is located shall bear the responsibilities of urban and rural planning and management according to law, and determine the relevant institutions or personnel to be responsible for the specific work.
Other relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in urban and rural planning and management. Chapter II Formulation of Urban and Rural Planning Article 11 The formulation of urban and rural planning shall abide by laws, regulations and relevant national and provincial standards and technical specifications.
The competent department of urban and rural planning of the provincial people's government may, according to the relevant national standards and technical specifications, formulate the standards and technical specifications for the preparation of urban and rural planning in this province, standardize and guide the preparation of urban and rural planning in this province.
The competent department of urban and rural planning of the people's governments of cities and counties shall guide the people's governments of towns and townships to organize the preparation of town planning, township planning and village planning. Twelfth provincial urban system planning by the provincial people's government organization, submitted to the State Council for approval.
Regional urban system planning is organized by the competent department of urban and rural planning of the people's government at the next higher level, and submitted to the people's government at the same level for approval by the organization department. Thirteenth overall urban planning by the city people's government organization, submitted to the provincial people's government for approval. The overall planning of Hefei City and the State Council City was approved by the provincial people's government and submitted to the State Council for approval.
The overall planning of the town where the county people's government is located shall be organized by the county people's government, submitted to the municipal people's government with districts for examination and approval, and submitted to the competent department of urban and rural planning of the provincial people's government for the record. The overall planning, township planning and village planning of other towns shall be organized by the people's governments of towns and townships, submitted to the people's governments at the county level for examination and approval, and reported to the competent department of urban and rural planning of the municipal people's government with districts for the record. Among them, the overall town planning, township planning and village planning within the urban planning area of a city with districts shall be reported to the municipal people's government with districts for examination and approval.
City town system planning and county town system planning are respectively incorporated into the overall urban planning and the overall planning of the town where the county people's government is located, and jointly compiled and approved.
The planning period of urban master plan and town master plan is generally twenty years. The overall urban planning should also make predictive arrangements for the future development of the city according to the needs of urban development.
