Chapter 2 Examination and Registration
Article 8
The state implements a physician qualification examination system. The physician qualification examination is divided into the practicing physician qualification examination and the practicing assistant physician qualification examination.
The measures for the unified examination of physician qualifications shall be formulated by the health administration department of the State Council. The physician qualification examination shall be organized and implemented by the health administrative departments of the people's governments at or above the provincial level.
Article 9
Those who meet one of the following conditions may take the medical practitioner qualification examination:
(1) Have a bachelor’s degree or above in the medical major of a college, Under the guidance of a practicing physician, the probation period has expired for one year in a medical, preventive, or health care institution;
(2) After obtaining the practicing certificate of a practicing assistant physician, and having a medical degree from a college, , have worked in a health care institution for two years or more; have a medical degree from a secondary vocational school and have worked in a medical, prevention, or health care institution for five or more years.
Article 10
Those who have a medical degree from a college or a medical degree from a secondary vocational school shall be on probation for one year in a medical, preventive or health care institution under the guidance of a practicing physician. Article 11
Those who have studied traditional medicine from a teacher for three years or who have developed expertise through many years of practicing medical skills shall be designated as traditional medicine by the health administrative department of the people's government at or above the county level. Those who pass the examination and are recommended by professional organizations or medical, prevention, and health care institutions may take the examination for the qualification of a practicing physician or the qualification of a practicing assistant physician. The content and methods of the examination shall be formulated separately by the health administrative department of the State Council.
Article 12
Those who pass the physician qualification examination shall obtain the qualification of a practicing physician or the qualification of a practicing assistant physician.
Article 13
The state implements a physician practice registration system.
Those who have obtained medical qualifications may apply for registration with the health administrative department of the people's government at or above the county level where they are located.
Except for the circumstances stipulated in Article 15 of this Law, the health administrative department that accepts the application shall approve the registration within thirty days from the date of receipt of the application and issue a certificate uniformly printed by the health administrative department of the State Council. Article 14
After registration, physicians may practice in medical, preventive, and health care institutions in accordance with the registered practice location, practice category, and scope of practice, and engage in corresponding medical, Prevention and health care business.
Anyone who has not registered as a physician and obtained a practicing certificate is not allowed to engage in medical practice activities.
Article 15
Registration will not be granted if one of the following circumstances occurs:
(1) Those who do not have full capacity for civil conduct;
(2) Due to criminal punishment, it has been less than two years from the date of completion of the punishment to the date of application for registration;
(3) Subject to the administrative penalty of revoking the physician's practicing certificate, self-imposed punishment The period from the date of decision to the date of application for registration is less than two years;
(4) There are other circumstances that make it inappropriate to engage in medical treatment, prevention, and health care business as stipulated by the health administrative department of the State Council.
If the health administrative department that accepts the application refuses to register if the application does not meet the conditions, it shall notify the applicant in writing within 30 days from the date of receipt of the application and explain the reasons. If the applicant has objections, he may apply for reconsideration or file a lawsuit with the People's Court within fifteen days from the date of receipt of the notice.
Article 16
If a physician encounters any of the following circumstances after registration, the medical, prevention, or health care institution where he or she works shall report to the health administrative department that approved the registration within thirty days. The health administrative department shall cancel the registration and withdraw the physician's practicing certificate:
(1) Death or declared missing; (2) Subject to criminal punishment;
(3) Subject to the administrative penalty of revoking the physician’s practicing certificate;
(4) The suspension of practice activities has expired in accordance with the provisions of Article 31 of this Law, and the re-assessment still fails;
< p> (5) The physician's practice has been suspended for two years;(6) There are other circumstances that make it inappropriate to engage in medical treatment, prevention, and health care business as stipulated by the health administration department of the State Council.
If the party whose registration has been deregistered has objections, he or she may apply for reconsideration or file a lawsuit with the People's Court within fifteen days from the date of receipt of the deregistration notice.
Article 17
If a physician changes his or her practice location, practice category, scope of practice or other registration matters, he or she shall go to the health administration department that approved the registration in accordance with the provisions of Article 13 of this Law. Go through the registration change procedures.
Article 18
If a physician has suspended his practice for more than two years and the circumstances specified in Article 15 of this Law disappear, his application for resumption of practice shall be submitted to Article 31 of this Law. The institution stipulated in Article 13 has passed the assessment and shall be re-registered in accordance with the provisions of Article 13 of this Law.
Article 19
Practicing physicians who apply for individual practice must be registered and practice in medical, preventive, and health care institutions for five years, and go through the approval procedures in accordance with relevant national regulations. ; No medical practice is allowed without approval.
The health administrative departments of the local people's governments at or above the county level shall, in accordance with the provisions of the health administrative department of the State Council, regularly supervise and inspect physicians who practice medicine individually. If any circumstances specified in Article 16 of this Law are found, they shall Cancel registration in a timely manner and withdraw the physician's practicing certificate.
Article 20
The health administrative department of the local people's government at or above the county level shall announce the list of persons approved for registration and deregistration, and the list shall be compiled by the health administrative department of the provincial people's government , reported to the health administrative department of the State Council for filing.
