Article 1 In order to strengthen the supervision and management of the quality of jewelry products, maintain the order of jewelry trading, protect the legitimate rights and interests of operators and consumers, and promote the healthy development of the jewelry industry in our city, these Measures are formulated in accordance with the provisions of the Product Quality Law of People's Republic of China (PRC) and other relevant laws and regulations. Second industrial and commercial enterprises and individual industrial and commercial households (hereinafter referred to as operators) engaged in jewelry processing and sales activities within the administrative area of our city must abide by these measures. Article 3 Jewelry as mentioned in these Measures refers to natural gemstones, optimized gemstones, synthetic gemstones, artificial gem, chopped stones, all kinds of gemstones with special optical effects (such as starlight and cat's eye), cultured pearls and other processed products, semi-finished products inlaid with jewels and other products. Article 4 Kunming Municipal Bureau of Technical Supervision shall supervise and inspect the quality of jewelry processed and sold in the whole city. According to the needs of the market, a unified municipal jewelry quality supervision station and a fair appraisal point should be set up reasonably; Organize and coordinate the training, assessment and accreditation of inspection and appraisal personnel.

County technical supervision and management departments shall accept mediation and arbitration of jewelry quality disputes according to law. Article 5 Kunming Jewelry Quality Supervision and Inspection Station is a statutory jewelry quality inspection institution, which is responsible for supervising and inspecting the quality of jewelry processed and sold within its jurisdiction and conducting regular or irregular supervision and spot checks on the jewelry market; Accept the entrustment inspection and arbitration inspection of jewelry quality.

Samples for sampling inspection shall not be destroyed or returned after inspection. The units and individuals under investigation shall actively cooperate and shall not refuse to check. The normal expenses required for sampling inspection shall be paid by the inspected. Unreasonable refusal to conduct random inspection shall be punished as unqualified products. Article 6 A jewelry quality inspection institution without the authorization of the technical supervision department shall not engage in statutory inspection, and the inspection report issued by it shall have no legal effect. Article 7 A business operator must meet the following basic requirements when processing and selling jewelry:

(1) Mark the correct name and recognized alias of the product according to the terminology specified in the Appraisal Standard for Jewelry and Jade (hereinafter referred to as the Appraisal Standard) issued by the Ministry of Geology and Mineral Resources of People's Republic of China (PRC) and China.

(two) in accordance with the provisions of the "identification standard", indicate the product attributes and other quality signs.

(3) indicate the origin, factory name and sales price of the product.

(four) with the corresponding quality inspection methods and quality inspection and acceptance system, and gradually establish a quality assurance system. Product quality assurance card; Jewelry with a value of more than 10000 yuan shall be accompanied by an appraisal certificate issued by a statutory inspection agency.

(5) Jewelry whose sales price is within 1000 yuan to 10000 yuan shall be accompanied by a product quality assurance card; Jewelry with a value of more than 10000 yuan shall be accompanied by an appraisal certificate issued by a statutory inspection agency. Article 8 A business operator shall not process and sell jewelry with inferior quality, and pass the fake off as the real one. The following imitations are prohibited:

(1) Low-grade gemstones are used as middle-grade and high-grade gemstones;

(2) Dyed gemstones are used as natural colored gems;

(3) The coated gemstone is used as a natural gemstone without explanation;

(four) the use of synthetic gems as natural gems without explanation;

(5) using artificial gem as a natural gem without explanation;

(6) Destructive gemstones are used as natural gemstones;

(seven) the use of a divided gem as a single gem without explanation;

(8) Other gems that are not allowed or specified in the Convention are used as natural gems after improving their quality characteristics. Article 9 Operators are encouraged to adopt advanced science and technology and implement scientific quality management methods to improve the quality of jewelry. Units and individuals with advanced product quality management, operators with stable product quality improvement and excellent service, and technical supervision departments that have made remarkable achievements shall be informed of praise and reward. Article 10. Consumers have the right to inquire about the quality of jewelry purchased from the business operators and complain to the technical supervision departments and relevant departments. Technical supervision departments and relevant departments shall be responsible for handling. Eleventh in violation of the provisions of article seventh, the technical supervision department shall order it to make corrections within a time limit; Refuses to correct, can be ordered to stop selling, and impose a fine of 20-05% of the illegal income. Twelfth in violation of the provisions of article eighth, the technical supervision department may order it to stop selling, confiscate the illegal income, and impose a fine of less than one time the illegal income; If the circumstances are serious, the business license shall be revoked by the industrial and commercial department; If the case constitutes a crime, it shall be submitted to the judicial department for criminal responsibility. Thirteenth forged inspection data, inspection conclusions and identification certificates, the technical supervision department shall order it to make corrections, and impose a fine of three times the normal inspection fee, until the business license is revoked by the industrial and commercial department; If the case constitutes a crime, it shall be submitted to the judicial department for criminal responsibility. Fourteenth supervision and inspection personnel and management personnel of technical supervision departments who abuse their powers, engage in malpractices for personal gain, accept bribes or forge inspection conclusions shall be given administrative sanctions. If the circumstances are serious, criminal responsibility shall be investigated according to law. Fifteenth these Measures shall be implemented and interpreted by Kunming Municipal Bureau of Technical Supervision, and specific implementation rules shall be formulated according to the Measures. Article 16 These Measures shall come into force as of the date of promulgation.
