Where an employer collects property from a laborer by way of guarantee or other names, the labor administrative department shall order it to be returned to the laborer within a time limit, and impose a fine of not less than 2,000 yuan per person, and if it causes damage to the laborer, it shall be liable for compensation.

If some companies use hidden means to collect mortgage payment in disguise, such as requiring workers to provide a certain amount of guarantee or deducting the corresponding proportion from their wages as collateral every month, this move should also be legally recognized as the risk of collecting mortgage payment, which is against the law and infringes on the legitimate rights and interests of workers.

If the employed personnel are unwilling to pay, they may report to the local labor inspection brigade or apply to the labor arbitration commission for arbitration.
