Chapter I General Provisions
Article 1 In order to protect the interests of consumers, standardize business practices, promote the development of e-commerce in the jewelry and jade jewelry industry in the direction of health, safety, standardization, orderly, efficient management and honesty, create a good environment for fair competition, and establish a standardized and efficient online sales market system, this Convention is formulated in accordance with relevant national laws and regulations and combined with the actual situation of the industry.
Article 2 Jewelry (diamond) e-commerce mentioned in this Convention refers to the act (activity) of engaging in online marketing and service of jewelry (diamond) products in People's Republic of China (PRC) by using technical service facilities such as mobile communication and Internet (including wireless network).
Article 3 The self-discipline of jewelry (diamond) e-commerce industry shall be based on the basic principles of law-abiding, fairness and honesty.
Article 4 This Convention is an industry self-discipline convention. All members of China Jewelry and Jade Jewelry Industry Association will automatically join this Convention. It is suggested that e-commerce practitioners in the whole industry (including overseas enterprises or organizations) voluntarily join this Convention.
Article 5 China Jewelry Industry Association is the executive body of this Convention and is responsible for organizing the implementation of this Convention.
Chapter II Self-discipline Clause
Article 6 Encourage and support fair, just, legal and orderly e-commerce of jewelry (diamonds), and oppose unfair means of industry competition.
Article 7 To safeguard the legitimate rights and interests of consumers, and shall not infringe upon the legitimate rights and interests of consumers in any way or means.
Eighth jewelry (diamond) e-commerce practitioners should consciously abide by the relevant laws, regulations and policies on the development and management of the jewelry industry, and actively promote the construction of e-commerce integrity and professional ethics. Consciously fulfill the obligation of self-discipline in jewelry industry;
2. It is forbidden for jewelry (diamond) e-commerce operators to publish the following information on the Internet or other media: (1) false advertisements of goods and services or misleading consumption statements; (2) Information on the supply and demand of products or services whose production and sale are explicitly prohibited by relevant state departments; (three) using another person's trademark, unauthorized use of another person's enterprise name or trade name, forgery or fraudulent use of certification marks, brand-name marks and other quality marks;
1. Enterprises engaged in online transactions must provide and publish real enterprise information, and shall not fabricate or fabricate enterprise name, business address and contact information, or exaggerate registered capital, business scope, business scale and business ability, or fabricate or fabricate various evaluation grades or cooperate with well-known enterprises or institutions;
3. In the process of e-commerce marketing of jewelry (diamonds), we should earnestly fulfill our commitments to consumers; After the marketing behavior is realized or completed, consumers should take the initiative to inform the transaction information and after-sales service content, and take the initiative to accept consultation, verification and complaints;
4. Consciously regulate the pricing behavior of jewelry (diamonds) e-commerce goods, prohibit price fraud, and do not engage in malicious competition by pricing below cost, predatory pricing, unfair joint pricing, price fraud and other pricing methods;
5. The information or service released by jewelry (diamond) e-commerce shall specify the name, material, evaluation factors, grade, price and other information of the goods in detail, and the certificate used must be the product inspection certificate issued by the metrological certification and authorized authentication institutions of the national product quality supervision and inspection institutions;
6. It is forbidden to refuse to issue invoices for consumers on the grounds of discounts, discounts, group purchases and other promotional methods;
7. Members' accounts and passwords shall be strictly managed, and members' information and privacy shall not be provided to third parties;
8. E-commerce operators should respect the personality and legitimate rights and interests of competitors, and prohibit acts of deliberately slandering and belittling the reputation of competitors' enterprises and products, and prohibit acts of stealing trademarks, patents and pictures, styles or styles, product series names, personalized descriptions and other violations of intellectual property rights of others;
9. E-commerce operators should strive to improve the professional quality and ethics of employees and maintain the normal flow order of technical and management talents in the industry. When hiring personnel from other units in the industry to serve this unit, they shall not infringe upon the intellectual property rights of the original unit and shall not disclose their business secrets.
Chapter III Implementation of the Convention
Article 9 China Jewelry and Jade Jewelry Industry Association shall organize the implementation of the self-discipline convention for jewelry (diamond) e-commerce industry, and supervise and inspect the compliance of enterprises and institutions in the industry with this convention.
Article 10 The contracting unit shall indicate in a prominent position on the homepage of its website that "this website is supervised by China Jewelry Industry Association". Among them, jewelry (diamond) e-commerce operators who are engaged in B2B, B2C and F2C jewelry e-commerce and are members of China Jewelry Industry Association should also indicate that this website provides official invoices for the goods sold.
Article 11 China Jewelry and Jade Jewelry Industry Association accepts complaints from industries and consumers about violations of the Convention, and sets up special complaint telephone numbers and online complaints. The complaint telephone number is 0 10-58276084. Website: www.chinajeweler.com.
Article 12 Any institution or individual may report the violation of the self-discipline convention to the convention supervision and implementation agency, and the convention implementation agency has the right to conduct investigation and mediation, safeguard industry unity and safeguard the overall interests of the industry. Convention supervision and implementation agencies can also take the initiative to supervise and inspect the implementation of convention members.
Thirteenth in violation of the self-discipline convention on e-commerce transactions, the supervision and implementation agencies of the convention shall urge them to make rectification within a time limit. If they fail to make rectification within the time limit, they will be informed of the exposure or handed over to the relevant competent departments for investigation.
Article 14 China Jewelry Industry Association has the final right to interpret this Convention.
Article 15 This Convention shall come into force as of February 6, 2009.
