Measures for the implementation of the management of medical institutions in Hubei Province
Chapter I General Provisions Article 1 In order to strengthen the management of medical institutions, promote the development of medical and health undertakings, and safeguard people's health, these Measures are formulated in accordance with the Regulations of the State Council on the Management of Medical Institutions (hereinafter referred to as the Regulations) and in combination with the actual situation of our province. Article 2 These Measures shall apply to the management of various medical institutions engaged in disease diagnosis, treatment and physical examination within the administrative region of this province (including supernumerary medical institutions established in our province by China People's Liberation Army and China People's Armed Police). Article 3 The classification of medical institutions (including Chinese medicine institutions, the same below) shall be based on the Detailed Rules for the Implementation of the Regulations on the Administration of Medical Institutions of the Ministry of Health (hereinafter referred to as the Detailed Rules). The following institutions providing diagnosis, treatment and physical examination services shall be managed separately.

(a) health and epidemic prevention stations at or above the county level (including county-level cities and districts under provincial jurisdiction, the same below) carry out diagnosis and treatment services, and the medical institutions set up are classified according to specialist prevention clinics or specialist disease prevention hospitals (stations).

(two) the establishment of county-level schistosomiasis control institutions and medical institutions to carry out diagnosis and treatment business shall be classified according to specialized prevention clinics or specialized disease prevention hospitals (stations).

(three) maternal and child health care institutions at or above the county level are classified according to the first, second and third level maternal and child health care hospitals.

(four) medical education and scientific research institutions to set up outpatient departments for teaching and scientific research services, according to the classification of comprehensive outpatient departments; Set more than 20 beds, according to the comprehensive medical classification.

(5) Medical beauty institutions are classified into medical beauty clinics, medical beauty clinics, beauty hospitals and plastic surgery hospitals.

(six) medical massage institutions are classified according to medical massage clinics, medical massage clinics and medical massage hospitals.

(seven) the classification of other institutions involved in diagnosis, treatment and physical examination shall be stipulated by the provincial health administrative department. Article 4 Medical institutions shall be managed by the whole industry. Health administrative departments at or above the county level shall exercise unified supervision and management over medical institutions within their respective administrative areas.

Chinese medicine (medicine) management institutions of health administrative departments at or above the county level shall, in accordance with the Regulations, Detailed Rules and these Measures, examine and approve, register, supervise and manage all kinds of Chinese medicine, integrated traditional Chinese and western medicine and ethnic medical institutions. Article 5 Medical institutions and their medical personnel shall engage in medical activities according to law and be protected by law. No unit or individual may interfere with the normal working order of medical institutions. Chapter II Examination and Approval of Establishment Article 6 The people's governments at or above the county level shall rationally allocate and make full use of medical resources, and incorporate the planning of the establishment of medical institutions into the overall planning of local social development and urban and rural construction. Article 7 The plan for the establishment of medical institutions shall be formulated by the health administrative department at or above the county level according to the Plan for the Establishment of Medical Institutions in Hubei Province, and shall be submitted to the people's government at the same level for approval and implementation after soliciting the opinions of the health administrative department at the next higher level. The establishment planning of medical institutions is the main basis for the health administrative departments at or above the county level to approve medical institutions. Article 8 Legal persons, other organizations and citizens must meet the following conditions for establishing medical institutions:

(1) Conforming to the planning of local medical institutions;

(two) in accordance with the "Regulations" and "detailed rules for the establishment of medical institutions";

(3) Meet other conditions stipulated by the provincial health administrative department. Ninth legal persons, other organizations and citizens to apply for the establishment of medical institutions, according to the following provisions for approval or filing procedures.

(a) the following medical institutions shall be accepted by the local health administrative department at the county level, and the local, state and municipal health administrative departments shall conduct preliminary examination and report to the provincial health administrative department for examination and approval:

100 beds or more (inclusive) general hospital;

Chinese medicine hospitals at or above the county level, integrated traditional Chinese and western medicine hospitals, and ethnic medicine hospitals;

Specialized hospitals, sanatoriums, rehabilitation hospitals, maternal and child health hospitals, and specialized hospitals for disease prevention;

Medical institutions with the word "center" or trans-regional words in their names, such as drug rehabilitation institutions, emergency centers and clinical inspection centers.

(two) the following medical institutions, by the local health administrative department at the county level to accept the application, and conduct a preliminary examination, reported to the prefecture, city health administrative departments for approval:

General hospitals with fewer than 100 beds;

Chinese medicine hospitals, integrated traditional Chinese and western medicine hospitals and ethnic medicine hospitals below the county level;

First aid station, nursing home, medical massage hospital;

Specialized disease prevention and treatment stations (stations);

The establishment of outpatient departments, clinics, health clinics and infirmary in the urban area where the city with districts is located shall be subject to the examination and approval of the municipal public health administrative department with districts.

(3) The following medical institutions shall be examined and approved by the health administrative department at the county level:

Outpatient department, clinic, health center, infirmary and nursing station;

Village clinic.

(4) Outpatient departments, clinics, health clinics and medical offices set up by legal persons and other organizations to serve internal personnel must go through filing procedures. If the central government sets up a unit in Hubei, it shall file a record with the local, city and state health administrative department before practicing, and obtain a receipt for the record of setting up a medical institution; Before the establishment and practice of other units, they should report to the local health administrative department at the county level for the record, and obtain the Record Receipt for Setting up Medical Institutions.

(5) The establishment of supernumerary medical institutions by the China People's Liberation Army and the Chinese People's Armed Police Force shall be examined and approved by the provincial health administrative department in conjunction with the health administrative department of the provincial military region and the Hubei Armed Police Corps.
