Article 1 (Purpose and Basis)

In order to regulate the management of outdoor advertising facilities in this city, in accordance with the "Advertising Law of the People's Republic of China" and "Shanghai City Appearance and Environment" These measures are formulated in accordance with the relevant provisions of the Sanitation Management Regulations and the Shanghai Urban Planning Regulations. Article 2 (Scope of Application)

These Measures apply to the establishment of outdoor advertising facilities and related management activities within the administrative region of this city. Article 3 (Explanation of Words)

The outdoor advertising facilities referred to in these Measures refer to the use of buildings, structures, venues, spaces, etc. that are public, owned or owned by others (hereinafter collectively referred to as positions ) outdoor commercial advertisements such as street signs, light boxes, neon lights, electronic display boards (screens), signboards, signs, and physical shapes. Article 4 (Management Department)

The Shanghai City Appearance and Environmental Sanitation Administration (hereinafter referred to as the Municipal City Appearance and Environmental Sanitation Bureau) is responsible for the supervision, management and comprehensive coordination of the installation of outdoor advertising facilities in this city; district and county city appearance and environmental sanitation management The department (hereinafter referred to as the district or county city appearance and sanitation department) is responsible for the supervision and management of the installation of outdoor advertising facilities within its jurisdiction.

The city, district, and county urban planning management departments (hereinafter referred to as the city, district, and county planning departments) are responsible for the planning and construction review, supervision and management of outdoor advertising facilities.

The municipal, district, and county industrial and commercial administration departments (hereinafter referred to as the municipal, district, and county industrial and commercial departments) are responsible for the business qualification review, content registration, and supervision and management of outdoor advertising releases.

This Municipality’s municipal administration, greening, transportation, public security, real estate resources, quality and technical supervision, finance, price, culture and radio and other departments shall coordinate the implementation of these Measures in accordance with their respective responsibilities. Article 5 (Principles of installation)

The installation of outdoor advertising facilities shall comply with urban planning requirements, be compatible with urban regional planning functions, be reasonably laid out, and be standardized.

Outdoor advertising facilities should be solid, safe, coordinated with the surrounding environment, and meet the requirements of city appearance. Article 6 (Situations where installation is prohibited)

Outdoor advertising facilities shall not be installed under any of the following circumstances:

(1) Using traffic safety facilities and traffic signs;

(2) Affecting the use of municipal public facilities, traffic safety facilities, and traffic signs;

(3) Impeding the normal life of residents and damaging the appearance of the city or the image of buildings;< /p>

(4) Using street trees or damaging green spaces;

(5) Within the scope of land used by state agencies and scenic spots;

(6) In the context of cultural relics protection Within the construction control zone of units and outstanding historical buildings;

(7) In areas or on carriers where the municipal government prohibits the installation of outdoor advertising facilities. Article 7 (Position Planning and Technical Specifications)

The municipal planning department shall, together with relevant departments, prepare positions for setting up outdoor advertising facilities in accordance with the regulatory unit planning, regulatory detailed planning and the provisions of Article 6 of these Measures. plan and publish it.

The Municipal City Appearance and Environmental Sanitation Bureau shall prepare technical specifications for the installation of outdoor advertising facilities based on the location planning for outdoor advertising facilities and the city’s urban appearance standards, and publish them.

The municipal planning department and the Municipal City Appearance and Environmental Sanitation Bureau shall, when formulating the position planning for outdoor advertising facilities and the technical specifications for the installation of outdoor advertising facilities, shall adopt the form of hearings, demonstration meetings or symposiums to listen to the city’s outdoor advertising regulations. Establish relevant industry associations and opinions from relevant experts.

The installation of outdoor advertising facilities shall comply with the position planning for the installation of outdoor advertising facilities and the technical specifications for the installation of outdoor advertising facilities. Article 8 (Acquisition of the right to use positions)

If public positions are used to set up outdoor advertising facilities, the right to use the positions shall be obtained through auction or bidding.

The scope of public *** positions shall be proposed by the Municipal City Appearance and Environmental Sanitation Bureau in conjunction with the Municipal Planning Department, and will be implemented after approval by the Municipal Government. The specific measures for the auction and bidding of the right to use public security positions will be formulated separately by the Municipal City Appearance and Environmental Sanitation Bureau in conjunction with the municipal municipal administration, transportation and other relevant departments. Article 9 (Management Authority)

If outdoor advertising facilities are set up in the following areas, the Municipal City Appearance and Environmental Sanitation Bureau will accept the application or organize the auction and bidding of the right to use public positions:

(1) Within 100 meters of the Inner Ring Elevated Road, Yan'an Elevated Road, North-South Elevated Road and both sides;

(2) Within the central section of the core area on both sides of the Huangpu River;

(3) Within the People’s Square area;

(4) Setting up similar outdoor advertising facilities across districts and counties;

(5) Other important areas determined by the municipal government.

If outdoor advertising facilities are set up in areas other than those specified in the preceding paragraph, the district, county, city and environmental sanitation departments shall accept the application or organize the auction and bidding of the right to use the public position. Article 10 (Procedures for setting up outdoor advertising facilities in public positions)

When the municipal or district or county city appearance and environmental sanitation department organizes the auction or bidding of the right to use public positions, the auction and bidding shall be The plan seeks opinions from the planning department and other relevant departments.

If the right to use a public position is obtained through auction or bidding, the municipal or district or county city appearance and environmental sanitation department shall sign a contract for the use of the public position with the person who installs the outdoor advertising facilities.

The person who installs outdoor advertising facilities shall go through the relevant procedures in accordance with the following provisions before setting up outdoor advertising facilities:

(1) Apply to the district or county planning department for the "Construction Project Planning Permit" Certificate (sporadic)";

(2) File the design drawings and installation renderings of outdoor advertising facilities with the municipal or district or county city appearance and sanitation department, and pay the public site use fee in accordance with regulations;

(3) In accordance with the relevant regulations on outdoor advertising registration, apply for an "Outdoor Advertising Registration Certificate" from the municipal or district or county industrial and commercial department.
