Article 23 Contract disputes shall generally be under the jurisdiction of the people's courts of the defendant's domicile and the place where the contract is performed. Therefore, when the parties encounter medical disputes, they should bring a lawsuit to the people's court in the place where the hospital is domiciled or where the medical service contract is performed.
Article 164 If a party refuses to accept the judgment of first instance, he may appeal to the court at the next higher level within 15 days from the date of receiving the judgment. If the time limit for appeal is exceeded, the judgment of first instance will take effect and the court of second instance will not accept it.
