Fuzhou is located in the east of Fujian Province, in the transitional zone between the middle subtropical zone and the south subtropical zone. Measures of Fuzhou Municipality on the Protection and Management of Shoushan Stone Resources

Article 1 In order to rationally develop, utilize and protect Shoushan stone resources, these Measures are formulated in accordance with the Mineral Resources Law of People's Republic of China (PRC), the Regulations of Fujian Province on Mineral Resources and other relevant laws and regulations, combined with the actual situation of our city.

Second units or individuals engaged in the exploitation, processing and sales of Shoushan stone resources within the territory of this Municipality shall abide by these measures.

Article 3 Shoushan Stone as mentioned in these Measures refers to pyrophyllite stored on the surface or underground in Shoushan Township, Huanxi Town and Rixi Township of our city, which can be used as carving crafts.

Article 4 Shoushan stone resources are owned by the state and will not be changed due to the different ownership or use right of the land to which they are attached. No unit or individual may occupy or destroy Shoushan stone resources.

Article 5 The development and utilization of Shoushan Stone Mine shall follow the principle of "unified planning, rational layout and scientific mining" and implement protective mining. Indiscriminate mining, indiscriminate digging and other destructive mining are prohibited.

Article 6 The people's government of Jin 'an District and its competent department of geology and mineral resources are responsible for the daily management and supervision of the development, utilization and protection of Shoushan stone mineral resources.

The municipal competent department of geology and mineral resources is responsible for exploring Shoushan stone resources, making development, utilization and protection plans, and supervising the development, utilization and protection.

Public security, industry and commerce, forestry and environmental protection departments in Fuzhou and Jin 'an District, and people's governments of Shoushan Township, Huanxi Town and Rixi Township in Jin 'an District should actively cooperate to do a good job in the development, utilization and protection of Shoushan stone resources.

Article 7 Shoushan Stone shall not be mined in the following areas:

1, tourist attractions, forest-intensive areas;

2, power, telecommunications lines and other distances within 60 meters;

3, drinking water sources, residential areas and other distances within 300 meters;

4. Shoushan Stone and Tianhuangshi Nature Reserve.

Shoushan Village's "Wild Nature Reserve" starts from the upper reaches of three old trees and ends at the arch bridge. There are four brands of "Wild Stone" Nature Reserve 50 meters on each side of the stream.

Eighth mining units must be state-owned mining enterprises and collective mining enterprises above the township (town), and it is strictly forbidden for village-run collective enterprises, private enterprises or individuals to mine Shoushan stone. It is forbidden to transfer mining rights without authorization or subcontract mining rights to individuals.

Ninth mining Shoushan stone units to apply for a "mining license", shall submit the following materials to the competent department of Geology and mineral resources in Jin 'an District:

(a) the application for registration and the map of the mining area;

(two) the qualification certificate of the mining right applicant;

(3) plans for the development and utilization of mineral resources;

(four) the approval documents for the establishment of mining enterprises according to law;

(5) Geological exploration data of the application area;

(six) the environmental impact assessment report of mineral resources development;

(seven) other materials required by laws and regulations.

Upon examination, if it meets the mining conditions, the competent department of Geology and Mineral Resources of Jin 'an District shall report it to the competent department of Geology and Mineral Resources of the city for examination and approval, and issue a mining license.

It is forbidden to exploit Shoushan Stone without a license.

Tenth the use of land, forest land, trees and water resources, in accordance with the relevant laws and regulations of the state to the relevant departments for examination and approval procedures.

Eleventh "mining license" is valid for one year. "Mining license" expires and needs to continue mining, the mining right holder shall apply to the examination and approval authority for renewal of registration 30 days before the expiration of the validity period; Failing to go through the formalities for renewal of registration within the time limit, the mining license shall be invalidated automatically.

Twelfth units that have obtained mining licenses to mine Shoushan Stone shall perform the following obligations:

(1) carrying out mine construction or mining within the approved time limit;

(2) Mining within the approved mining area;

(three) to pay the resource tax, mineral resources compensation fee and mining right use fee to the competent department of Geology and mineral resources in Jin 'an District according to law;

(four) to abide by the laws and regulations of the state on labor safety, soil and water conservation, land reclamation and environmental protection, protect the ecological environment and ensure safe production;

(five) should have the qualifications stipulated by the state, the use of advanced mining technology, the implementation of large-scale mining, mining recovery rate, mining dilution rate and mineral processing recovery rate to meet the design requirements.

Thirteenth units that use blasting to mine Shoushan stone shall, in addition to obtaining a legal mining license, apply to the public security department for approval to use blasting materials. The public security department shall not approve the use of explosives by units that have not obtained mining licenses according to law.

Article 14 Units and individuals selling Shoushan stone raw ore shall apply to the industrial and commercial department for a business license with the approval of the competent department of geology and mineral resources and the Shoushan stone business license issued by the competent department of geology and mineral resources.

Article 15 Shoushan stone raw ore mined by units that have legally obtained mining rights, and Shoushan stone raw ore mined by other units and individuals before the implementation of these Measures shall be sold to units and individuals that have obtained Shoushan stone business licenses, or publicly traded in Shoushan stone trading market established by the government.

It is strictly forbidden to trade Shoushan Stone privately.

Sixteenth jin an district Municipal Government shall organize a joint law enforcement inspection team composed of personnel from the competent department of Geology and mineral resources and relevant examination and approval departments. According to the responsibilities of the relevant departments, acts in violation of laws, regulations and the provisions of these measures in Shoushan stone mining shall be punished according to law.

The township (town) and village where Shoushan Stone is located should actively cooperate with law enforcement and strengthen daily management.

Seventeenth approach by the Jin 'an District People's government, the municipal department of Geology and mineral resources is responsible for organizing the implementation.

Article 18 These Measures shall come into force as of the date of promulgation.

On August 1 2005, the Asian Development Bank approved a loan of US$ 55.8 million to help Fuzhou, the capital of Fujian Province, China, improve the urban environment by reducing water pollution and protecting water resources.

The project will help Fuzhou improve the urban environment of 6,543,850 people by building and repairing drainage pipe network, maintaining underground ditch system and strengthening water resources management. In particular, the project will expand the Liyang drainage pipeline system serving the east of Fuzhou, build a continuous drainage system on Nantai Island in the south of Fuzhou, and repair the 13 underground ditch on Nantai Island to control pollution and prevent floods. Total will build 264 kilometers of drainage pipes and repair 35 kilometers of existing drainage pipes.

Similarly, the project will improve the water quality of underground ditches and Minjiang River by supporting the overall water resources management to meet the predetermined standards. "The project will improve water quality and environmental conditions, increase the sources of safe drinking water in Fuzhou, reduce diseases caused by water sources, and directly improve living conditions and public health in Fuzhou," said Edgar A. Kua, a major project economist of ADB. "In addition, the improvement of the environment will improve the comfort of the city, stimulate economic activities, and further strengthen the image of Fuzhou as one of the most active cities in improving the urban environment in China."

Fuzhou is the main cultural, commercial and industrial center in the Minjiang River Delta. Minjiang River flows through the center of Fuzhou, which is the water source for drinking, irrigation and industrial processing. However, rapid economic growth and urbanization have led to serious pollution. Due to the discharge of a large amount of treated wastewater, the water quality of urban ditches and rivers has seriously deteriorated. Most ditches are polluted by organic matter, nitrogen and phosphorus wastes.

"Inadequate waste water management and water resources protection lead to the deterioration of public health, unclean urban living environment and drinking water pollution, all of which affect social and economic development." Mr. Kwa added.

This project will complete the first phase of Fuzhou Liyang Sewage Treatment Plant with ADB loan ahead of schedule. The project also includes institution building and training, aiming at strengthening the management capacity of Fuzhou municipal government in wastewater treatment and promoting the participation of private institutions in the development of urban infrastructure. A $500,000 aid and a loan were used to support a demonstration action to promote a clean river plan for the poor in Nantai Island.

The ADB loan will bear 30% of the total project cost18.55 million USD. The loan comes from ADB's regular funding sources, with a term of 25 years and a grace period of 5 years. The interest rate will be determined according to the terms set by ADB according to the London Interbank Offered Rate.

China Industrial and Commercial Bank will raise 27,654.38+0.90 million USD for this project, and Fuzhou Municipal Government will contribute 654.38+0.2565,438+0.00 million USD.

Fuzhou Municipal Government is the executing agency of this project, which will be completed in February 2009.

Article 1 In order to strengthen the protection and management of ancient and famous trees and maintain the features of historical and cultural cities, these Measures are formulated in accordance with the Forest Law of People's Republic of China (PRC), the Regulations on Urban Greening and other relevant laws and regulations, combined with the actual situation of this Municipality.

Article 2 The term "ancient trees" as mentioned in these Measures refers to trees whose age is more than 100 years; Famous trees are trees with rare tree species, peculiar tree shapes, rare at home and abroad, historic significance, important scientific research value or important embellishment in scenic spots and urban landscapes.

Article 3 These Measures shall apply to the protection and management of ancient and famous trees in the urban planning area of Fuzhou.

Fourth Fuzhou City Landscaping Department is responsible for the protection and management of ancient and famous trees in this city.

The competent department of district landscaping shall be responsible for the protection and management of ancient and famous trees within its jurisdiction according to the division of responsibilities.

Urban planning, construction, environmental protection, forestry, cultural relics management, tourism, public security, urban construction supervision and other relevant departments shall cooperate with the competent department of landscaping to implement these measures.

Article 5 All units and individuals have the obligation to protect ancient and famous trees, and have the right to discourage and report acts that damage ancient and famous trees.

Units or individuals that have made remarkable achievements in the protection of ancient and famous trees shall be commended or rewarded by the Municipal People's Government.

Sixth old and famous trees protection and management funds mainly by financial allocation, supplemented by other channels to raise, and encourage units and individuals to give support.

The funds for the protection and management of ancient and famous trees shall be earmarked for the rescue, rejuvenation and maintenance of ancient and famous trees, and shall not be used for other purposes.

Article 7 Old and famous trees that are more than 300 years old or are particularly precious and rare, with particularly important historical value and commemorative significance, are classified as Grade I; The rest are secondary.

The municipal competent department of landscaping shall organize relevant experts to identify and evaluate ancient and famous trees, and report to the Municipal People's Government for publication.

Article 8 The municipal landscaping administrative department shall organize relevant departments to investigate and register ancient and famous trees, establish archives, set up signs, strengthen technical guidance and supervision of management and protection, and check the growth and management of ancient and famous trees at least once every six months.

Ninth landscaping departments should strengthen publicity and scientific research on the protection of ancient and famous trees, popularize and apply scientific research results, improve the level of protection and management, and promote the development and utilization of ancient and famous trees resources.

Article 10 The municipal landscaping department shall, jointly with the municipal planning department, formulate the protection plan for ancient and famous trees, determine the corresponding protection measures, and ensure the synchronous protection of trees, growing environment and landscape.

Eleventh first-class ancient and famous trees are managed by the professional team designated by the municipal landscaping department.

The management responsibility of two ancient and famous trees is divided according to the following principles:

(a) organs, schools, organizations, enterprises and institutions and parks, scenic spots, temples and other land within the scope of the old and famous trees, by the unit responsible for;

(two) the ancient and famous trees within the scope of railway, highway, reservoir and river management are respectively responsible for the railway, highway, reservoir and river management units;

(three) the ancient and famous trees in the residents' courtyards and residential quarters shall be responsible for the neighborhood offices and township (town) people's governments;

(four) the ancient and famous trees in the urban public * * * lots shall be in charge of the local landscaping department;

(five) the old and famous trees in the courtyard of a single-family house shall be responsible for the owner or user of the house.

The unit responsible for the management and protection of ancient and famous trees shall determine the special person for management and protection.

Old and famous trees management responsibility unit changes, the original management responsibility unit shall report to the competent department of landscaping within ten days.

Article 12 When the responsible management and protection unit discovers that ancient and famous trees are damaged or withered, it shall promptly report to the competent department of landscaping, and cooperate with the competent department of landscaping for rejuvenation and maintenance. The death of ancient and famous trees shall be reported to the competent department of landscaping, and the municipal competent department of landscaping shall find out the reasons and responsibilities and deal with them; The green space within its protection scope shall not be occupied without authorization.

Thirteenth of the seriously damaged or endangered ancient and famous trees, by the municipal landscaping department to develop rescue, rejuvenation and maintenance plans and programs, submitted to the Municipal People's government for approval before implementation.

The Municipal People's Government shall organize urban planning, construction, landscaping, environmental protection and other departments to clean up the existing buildings, structures and pollution sources that besiege ancient and famous trees or destroy the landscape of ancient and famous trees, and dismantle or relocate them within a time limit.

Fourteenth ancient and famous trees within five meters of the vertical projection of the outer edge of the crown is an ancient and famous tree protection area. If the crown is skewed, the corresponding protection range should be set according to the actual root growth.

It is forbidden to build, rebuild or expand buildings, structures and other facilities that hinder the normal growth of trees within the scope of protection of ancient and famous trees.

Fifteenth prohibit the following acts of damage to ancient and famous trees:

(1) Erecting overhead lines, stacking articles, dumping sewage and waste residue, discharging waste gas and using open flames within the protection scope;

Article 23 Whoever, in violation of the provisions of these measures, cuts down, destroys or transplants ancient and famous trees without authorization, or causes the death of ancient and famous trees due to damage, shall compensate the losses according to their value, and the competent department of landscaping may impose an equal fine; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 24 If the staff of the competent department of landscaping fail to check and guide on time due to ineffective protection and restoration measures, or neglect their duties, resulting in serious damage or death of ancient and famous trees, the people's government at the same level or the competent department at a higher level may, in addition to giving economic penalties to the competent leaders of the management department and the persons directly responsible, give administrative sanctions at the same time; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law.

Twenty-fifth if a party refuses to accept the decision on administrative punishment, it may apply for reconsideration or bring an administrative lawsuit according to law. If a party fails to perform the decision on administrative punishment within the time limit and does not apply for reconsideration or prosecution, the organ that made the decision on punishment shall apply to the people's court for compulsory execution.
