Article 1 In order to ensure the safety of the state, collective property and citizens' personal property, protect the environment and maintain social order, these Provisions are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this Municipality. Article 2 Fireworks and firecrackers (including simulated firecrackers) are prohibited in Heping District, Shenhe District, Tiexi District, Huanggu District, Dadong District, Dongling District, Yuhong District, Sujiatun District and Xinchengzi District of this Municipality. Article 3 The delineation of the areas where fireworks and firecrackers are prohibited outside the forbidden areas in this Municipality shall be decided by the local county (city) and district people's governments and promulgated by the Municipal People's government. Article 4 No unit or individual may set off, produce or sell fireworks and firecrackers in areas where fireworks and firecrackers are prohibited. The transport of fireworks and firecrackers through the area where fireworks and firecrackers are prohibited in this Municipality shall be verified by the public security organ and the dangerous goods sign shall be hung. Article 5 These Provisions shall be implemented by people's governments at all levels.

The public security organ is the competent authority that prohibits the discharge of fireworks and firecrackers. Industry and commerce administration, environmental protection, urban management and other departments shall, in accordance with their respective responsibilities, cooperate with the public security organs to implement these Provisions. Article 6 People's governments at all levels, neighborhood offices, residents' committees and villagers' committees, as well as organs, organizations, schools, enterprises and institutions shall educate citizens to strictly abide by these provisions. Violation of the provisions of article seventh shall be punished by the public security organs:

(a) the unit that sets off fireworks and firecrackers shall be fined more than 2000 yuan 10000 yuan, and the person directly responsible and the person in charge of the unit shall be fined more than 500 yuan 1000 yuan.

(two) individuals who set off fireworks and firecrackers shall be fined from 200 yuan to 0000 yuan.

(three) the production and sale of fireworks, fireworks and illegal income confiscated, and impose a fine of 5000 yuan to 20000 yuan. Article 8 In case of serious violation of these regulations, in addition to being fined in accordance with these regulations, he shall be detained in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security 15; If property losses or personal injuries are caused to the state, the collective or others, they shall bear civil liability according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 9 The guardians shall bear the fines or losses that should be compensated for minors and irresponsible persons who violate these provisions. Article 10 Anyone who violates these provisions has the right to dissuade and report. Give appropriate rewards to those who report meritorious service; Whoever retaliates against informants or witnesses shall be given a heavier punishment according to law. Eleventh if a party refuses to accept the punishment decision, he may, within 5 days from the date of receiving the punishment decision, apply for reconsideration to the public security organ at the next higher level of the public security organ that made the punishment decision. The public security organ at the next higher level shall make a reconsideration decision within 5 days from the date of receiving the application for reconsideration; If he refuses to accept the reconsideration decision, he may bring a lawsuit to the people's court within 5 days from the date of receiving the reconsideration decision. Twelfth national, provincial and municipal major celebration activities, the need to set off fireworks and firecrackers and salute in the area where fireworks are prohibited, decided by the Municipal People's government and announced. Thirteenth specific issues in the implementation of these Provisions shall be interpreted by the Municipal People's government. Article 14 These Provisions shall come into force as of 1994 1 February1day.
