What procedures and materials are needed for marriage registration?
Application, examination and registration are three links in the process of marriage registration.
(1) application
Those who meet the conditions for marriage registration, with relevant documents, certificates and 3 registration photos, apply for marriage registration at the marriage registration office where one party's household registration is located, and fill in the application registration statement according to the instructions of the staff.
The documents and materials for applying for marriage registration depend on individual circumstances. For example, when applying for marriage registration in China, China citizens need to hold their own identity certificate, household registration certificate, marriage examination certificate, proof of no spouse, and a signed statement that they have no direct blood relationship with each other and collateral blood relationship within three generations. If it is a divorce, you need to bring a divorce certificate to apply for remarriage.
Foreigners who apply for marriage in China (including China people, foreigners who come to China permanently or temporarily, and foreigners who have settled in China) need to hold their valid passports or nationality certificates, valid residence permits for foreigners, and proof of marital status issued by embassies and consulates in China.
(2) Review
The marriage registration authority shall verify and examine the parties who apply for marriage registration, and find out whether the documents and certificates meet the conditions for marriage. If there is any ambiguity, the marriage registration authority will ask the parties concerned, and if necessary, the parties will be required to provide materials related to the application for marriage registration.
(3) Registration and licensing
The marriage registration authority shall register those who meet the conditions for marriage and issue a marriage certificate; For those who have experienced divorce, the marriage registration office will cancel their divorce certificates; When necessary, the marriage registration office will also issue a notice of disapproval of marriage registration, explaining the reasons for disapproval of marriage registration.
What procedures and documents do you need for divorce?
The process of divorce registration is roughly as follows:
(1) application
If a husband and wife voluntarily divorce in the Mainland, they shall sign a written divorce agreement, apply to the marriage registration authority (which has jurisdiction), and provide the following documents and supporting materials:
1, marriage certificate issued by mainland marriage registration authority or Chinese embassy (consulate) abroad;
2. Valid and compliant identity documents, such as household registration book, ID card, Hong Kong, Macao and Taiwan pass, passport, etc. ;
3. An application for divorce registration filled in at the marriage registration office.
(2) Accept
The staff will conduct a preliminary examination of the materials submitted by the parties in accordance with the relevant provisions of the Marriage Registration Code. After the documents and certification materials submitted by the parties are correct after the first trial, they will send a receipt for accepting the divorce registration application to the parties. If the conditions for divorce registration are not met, the registrar may issue a notice that the application for divorce registration will not be accepted.
(3) cooling-off period
Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues the receipt of the application for divorce registration to the parties concerned, any party who requests a divorce can go to the marriage registration office that accepts the application for divorce registration with his valid identity certificate and the receipt of the application for divorce registration (the situation can be explained in writing if the receipt is lost), withdraw the application for divorce registration and fill out the Application for Withdrawal of Divorce Registration in person. After verification, the marriage registration authority shall issue the Confirmation of Withdrawal of Divorce Registration to the parties concerned, and the application for divorce registration, the application for withdrawal of divorce registration and the confirmation of withdrawal of divorce registration (stubs) shall be filed together. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to apply to the marriage registration authority for a divorce certificate, it shall be deemed that the application for divorce registration has been withdrawn.
(4) Review
Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday is the expiration date of the period), both parties shall bring their recent bareheaded photos, divorce agreement, marriage certificate, ID card, passport or pass and other relevant documents and materials to the marriage registration office to apply for the issuance of divorce certificates. The marriage registration authority shall conduct an examination in accordance with the relevant procedures and conditions, and refuse to handle those who do not meet the conditions for divorce registration. If a party requests to issue a notice not to register for divorce, the marriage registration authority shall issue it.
(5) Registration (certification)
The marriage registration authority shall register in accordance with the relevant provisions and issue a divorce certificate.
