What procedures and materials are needed for marriage registration?
Application, examination and registration are three links in the process of marriage registration.
(1) application
Those who meet the requirements for marriage registration shall apply for marriage registration at the marriage registration office where one party is located with relevant documents, certificates and three registration photos, and fill in the declaration required for applying for marriage registration on the spot.
The proof materials needed to apply for marriage registration depend on individual circumstances. For example, China citizens applying for marriage registration in China (except Hong Kong, Macao and Taiwan) must hold their own identity certificate, household registration certificate, marriage examination certificate, single spouse certificate and signed statement that they are not related to each other. Those who apply for divorce and remarriage must also bring a divorce certificate.
Foreigners living in China, foreign Chinese and other foreigners applying for marriage registration in China must hold their valid passports, Alien Residence Permit issued by public security organs or valid temporary residence permit in China, official proof of marital status and other materials.
(2) Review
The marriage registration office will examine the application of the parties to determine whether the submitted marriage application meets the requirements. If the application materials submitted are unclear, the marriage registration authority will generally ask the parties and ask them to provide relevant supporting materials when necessary.
(3) Registration and licensing
The marriage registration office will register eligible couples and then issue marriage certificates; For those who have experienced divorce, the marriage registration office will cancel their divorce certificates; When necessary, the marriage registration office will also issue a notice of disapproval of marriage registration, explaining the reasons for disapproval.
What procedures and documents do you need for divorce?
The divorce registration process is as follows:
(1) application
The husband and wife who request divorce shall sign a written divorce agreement, jointly apply to the marriage registration authority with jurisdiction, and provide the following documents and supporting materials as required:
1. Marriage certificate issued by the Mainland Marriage Registry or Chinese embassies and consulates abroad;
2. Relevant valid identity documents that meet the requirements, such as identity cards, household registration books, Hong Kong, Macao and Taiwan passes, passports, etc. ;
3. An application for divorce registration filled in at the marriage registration office.
(2) Accept
The staff will conduct a preliminary examination of the materials submitted by the parties in accordance with the relevant provisions of the Marriage Registration Code. After checking the documents and supporting materials submitted by the parties for the first time, the marriage registrar will issue a receipt for accepting the divorce registration application. Those who do not meet the requirements for divorce registration will not be accepted, and if necessary, a Notice of Rejection of Divorce Registration Application will be issued at the request of the parties concerned.
(3) cooling-off period
Within 30 days from the date when the marriage registration office receives the application for divorce registration and delivers the receipt of the application for divorce registration to the parties concerned, any party who does not want to divorce can withdraw the application for divorce registration at the marriage registration office that accepts the application for divorce registration with his valid identity certificate and the receipt of the application for divorce registration (the situation can be explained in writing if the receipt is lost), and fill out the Application for Withdrawal of Divorce Registration in accordance with the regulations. After verification by the marriage registration authority, a Confirmation Letter for Withdrawing the Application for Divorce Registration will be issued. Within 30 days after the end of the cooling-off period of divorce, if both parties fail to jointly apply to the marriage registration authority for a divorce certificate, it shall be deemed that the application for divorce registration has been withdrawn.
(4) Review
Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the cooling-off period is a holiday, the first day after the holiday is the expiration date), divorced couples should carry valid certificates and materials according to relevant regulations, such as recent bareheaded photos of both parties, divorce agreement, marriage certificate, ID card, passport or pass. , and apply for a divorce certificate at the marriage registry. The marriage registration authority shall conduct an examination according to the provisions of the Marriage Registration Code. Those who do not meet the conditions for divorce registration shall not go through the divorce registration formalities. If a party requests to issue a notice not to register for divorce, the marriage registration authority shall issue it.
(5) Registration and issuance of divorce certificates
The marriage registration authority shall register in accordance with the relevant provisions and issue a divorce certificate.
