Homestead is a collective construction land used by rural villagers to build houses and their ancillary facilities, including houses, ancillary buildings and courtyards, and belongs to (collective) construction land in land management.
The subject of the right to use the homestead is specific, and it is limited to rural residents in principle. Article 362 of the Civil Code defines the subject of the right to use the homestead as "the owner of the right to use the homestead". Under the current rules, the right to use the homestead is a member of the rural collective economic organization that meets the application conditions of the homestead. Judging from the social security function carried by the homestead and the unpaid nature of the initial acquisition of the homestead, this provision is appropriate.
