The term "city appearance management" as mentioned in these Regulations includes the management of buildings, outdoor advertisements and shop signs, urban roads and vehicles, farmers' markets and temporary business premises, garbage and dust, and city appearance responsibility areas. Article 3 City appearance management adheres to the principles of unified leadership, graded responsibility, compartmentalization, territorial management, public participation and social supervision. Article 4 The people's governments of cities and counties (districts) shall establish and improve the coordination mechanism of city appearance management, strengthen the supervision and inspection of city appearance management and the assessment of rewards and punishments, and coordinate and solve major problems in city appearance management.
City, county (District) people's government urban management department is the administrative department in charge of urban management, responsible for the daily work of urban management. Other administrative departments shall, in accordance with their respective responsibilities, do a good job in the management of city appearance.
All kinds of development zones, parks and scenic spots management committees should do a good job in the city management in this area.
Town (township) people's government, street offices are responsible for organizing the implementation of the city management work within their respective jurisdictions, and village (neighborhood) committees assist in the city management work. Article 5 People's governments at all levels shall incorporate city appearance management into the national economic and social development plan, and the required funds into the fiscal budget, and establish and improve a diversified investment mechanism based on public finance. Article 6 The municipal and county urban management departments shall, jointly with the urban and rural planning, housing and urban-rural construction departments, formulate local urban appearance standards according to national and provincial urban appearance standards and relevant local urban and rural planning, solicit opinions from all sectors of society, and report them to the people's government at the same level for approval before promulgation and implementation. Article 7 The people's governments of cities and counties (districts) shall establish an incentive mechanism for city appearance management, encourage units and individuals to participate in public welfare activities of city appearance management, and reward units and individuals that have made outstanding contributions in city appearance management. Eighth city management departments and other relevant administrative departments should strengthen the publicity and education of city appearance management laws, regulations and scientific knowledge, and enhance citizens' sense of responsibility for maintaining the city appearance.
Schools, kindergartens and other educational institutions should carry out educational practice activities to maintain the city appearance, and cultivate good habits of young people and children to care for the public health environment.
The news media should strengthen the publicity of city appearance management and expose the problems existing in city appearance management. Article 9 All units and individuals shall maintain the city appearance, cherish public facilities, respect the city appearance operators and their labor achievements, and support the city appearance management personnel to perform their duties. Encourage units and individuals to report acts of sabotage. Chapter II Administration of Building Facades Article 10 Newly-built projects and facade renovation of buildings (structures) shall conform to urban and rural planning and urban appearance standards.
In any of the following circumstances, the construction unit shall provide the elevation design scheme to the competent department of urban and rural planning:
(a) the building (structure) building facade unified transformation into a community;
(two) the main street and key areas frontage building (structure) building facade transformation, it is really necessary to change the original main color, shape and facade design style;
(three) the facade renovation of large and medium-sized or protected buildings (structures).
The elevation design scheme of the construction project shall be examined and agreed by the competent department of urban and rural planning. The approved design scheme shall not be changed without authorization.
In violation of the provisions of the third paragraph, the design scheme of the facade of the construction project has not been examined and approved by the urban and rural planning department or the construction has not been carried out in accordance with the examined and approved scheme, and the competent urban and rural planning department or the urban management administrative law enforcement department shall order it to stop construction according to its duties. If corrective measures can be taken to eliminate the impact on the implementation of the plan, it shall be corrected within a time limit and a fine of more than 5% 10% of the cost of the facade construction project shall be imposed; If it is impossible to take corrective measures to eliminate the impact, it shall be demolished within a time limit, and a fine of less than 10% of the project cost of the facade may be imposed. Article 11 The installation of protective facilities, outdoor air conditioners, sunshade (rain) awnings, smoke exhaust facilities, solar energy facilities and pipeline facilities on the facades of buildings (structures) facing the street in major streets and key areas, as well as the closure of balconies and greening shall conform to the standards of urban appearance and shall not affect the overall effect of the facades.
The owner, user or responsible person of the building (structure) city appearance responsibility area shall maintain and manage the building (structure) facade and keep it clean and intact. If the structure is damaged, the wall falls off or the facade is defaced, it shall be repaired, maintained and cleaned in time. Twelfth the use of buildings (structures) to set up night lighting facilities shall comply with the provisions of urban lighting management and technical specifications, and be in harmony with the main color, shape and design style of the building (structure) facade. Thirteenth no unit or individual may carry out the following acts:
(a) in the main streets and key areas of the building (structure) balcony, window, roof hanging or piling up unsightly items;
(two) damage, unauthorized removal of major streets and key areas frontage building (structure) building facade unified facilities or change its location, specifications, style and color;
(three) unauthorized building (structure) building facade;
(four) scribbling and posting on the facade of the building (structure);
(five) other acts in violation of city appearance standards.
In violation of the first and fourth provisions of the preceding paragraph, the urban management administrative law enforcement department shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than one hundred yuan but not more than five hundred yuan shall be imposed. In violation of the provisions of the second paragraph of the preceding paragraph, the urban management administrative law enforcement department shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than 3,000 yuan shall be imposed on 500 yuan, and if the facilities are damaged or lose their functions, they shall be liable for compensation according to law. In violation of the provisions of the third paragraph of the preceding paragraph, the urban management administrative law enforcement department shall order it to stop construction, dismantle it within a time limit, and impose a fine of more than 5% 10% of the cost of the existing building (structure); If the construction or demolition is not stopped within the time limit, it shall be demolished according to law, and a fine of less than 10% of the project cost of the existing building (structure) may be imposed.
