According to the Supreme People's Court's Interpretation on Relevant Issues Concerning the Specific Application of Law in the Trial of Unit Crime Cases, "companies, enterprises and institutions" include both state-owned and collectively-owned companies, enterprises and institutions, as well as legally established joint ventures and cooperative enterprises and wholly-owned and private companies, enterprises and institutions with legal personality. Second, according to the relevant provisions of different criminal laws, the illegal gains of unit bribery must be owned by the unit. If it is owned by an individual, it should be punished as a natural person taking bribes. Articles 2 and 3 of the Supreme People's Court's Interpretation on Relevant Issues Concerning the Specific Application of Law in the Trial of Unit Crimes respectively stipulate that companies, enterprises and institutions established by individuals commit crimes, or companies, enterprises and institutions are established with crimes as their main activities, and are not punished as unit crimes; Whoever embezzles the name of a unit to commit a crime and distributes the illegal income to the criminal individual shall be convicted and punished in accordance with the provisions of the Criminal Law on crimes committed by natural persons. Third, the plot standards are different. "Serious circumstances" is one of the necessary conditions to constitute the crime of accepting bribes by units, and it is also an important symbol that distinguishes it from the crime of accepting bribes by individuals. As for how to determine the severity of a crime, it should be determined from two aspects: subjective guilt and objective social harm. In any of the following circumstances, it shall be deemed as "serious". The amount of bribes is relatively large. According to the relevant provisions in the Supreme People's Procuratorate's "Provisions on the Standards for Filing Investigation Cases Directly Accepted by People's Procuratorates (Trial)", if the amount of bribes paid by a unit is more than 200,000 yuan, it shall be filed. The starting point of personal bribery amount is 10000 yuan. There may still be some bad habits in today's society.
