At present, natural persons in China cannot apply for trademark registration, nor can they be allowed to use other people's registered trademarks.

A registered trademark needs to provide a business license, not necessarily the company's. You can go to the local industrial and commercial department to obtain the business license of a sole proprietorship enterprise or limited company, and then apply for trademark registration.

According to the current Trademark Law of People's Republic of China (PRC), there are five subjects of trademark rights:

(1) Enterprises and institutions: Enterprises must be legally registered industrial and commercial enterprises that can independently bear civil liabilities; Institutions must have legal personality;

(2) Social organizations: social organizations that provide services or are approved to produce, manufacture, process, select and distribute commodities and need to use trademarks;
