Jizhou District People's Government, Qingyuan District People's Government, Jinggangshan Economic and Technological Development Zone Administrative Committee and Luling New District Administrative Committee shall, according to the actual situation in their respective jurisdictions, draw up areas, time periods and types for prohibiting or restricting the discharge of fireworks and firecrackers, and report them to the Municipal People's Government for approval and promulgation. Fourth the following places are not allowed to set off fireworks at any time:
Office space;
(two) medical institutions, pension institutions, children's welfare homes, kindergartens, schools;
(three) shopping malls, bazaars, parks, indoor public places of entertainment and other crowded areas;
(4) Traffic hubs such as stations, docks and airports, traffic facilities such as expressways, tunnels, elevated roads and overpasses, and railway line safety protection zones;
(5) places for the production, operation and storage of inflammable and explosive articles and safety protection zones for oil (gas) pipelines, power transmission and transformation facilities and communication facilities;
(six) key fire prevention areas such as forests;
(seven) cultural relics protection units;
(eight) other places where fireworks and firecrackers are prohibited as prescribed by the people's government of the city or county (city or district).
Where fireworks and firecrackers are prohibited in the preceding paragraph, the people's governments of cities and counties (cities, districts) shall set up warning signs. Fifth in the cemetery area where fireworks are not prohibited, centralized discharge facilities should be set up. Article 6 Fireworks and firecrackers shall not be set off in the following ways in areas, places and time periods where fireworks and firecrackers are not prohibited:
(1) Discharging or throwing in the corridors, aisles, balconies, windowsills and roofs of buildings;
(two) for pedestrians, vehicles, buildings, public green space, underground pipe network, etc. ;
(3) Obstructing pedestrians and affecting road traffic safety;
(four) other ways to endanger public security and personal and property safety. Seventh in the early warning period of heavy pollution weather, fireworks are prohibited throughout the administrative area of this Municipality.
The early warning information of heavy pollution weather is released to the public by the Municipal People's Government in accordance with the prescribed procedures. Article 8 The people's governments of cities and counties (cities, districts) shall strengthen their leadership, co-ordinate the management of fireworks and firecrackers, and incorporate the management of fireworks and firecrackers into the target management of ecological protection, civilization creation and comprehensive management of social security.
Township people's governments and sub-district offices shall, in accordance with the requirements of the people's governments of cities and counties (cities, districts), organize the management of fireworks and firecrackers in their respective areas.
Village (neighborhood) committees shall assist in the publicity, inspection, dissuasion and reporting of fireworks and firecrackers management. Ninth public security organs are the competent authorities in charge of fireworks management, responsible for the safety management of fireworks and firecrackers, and investigate and deal with illegal discharge of fireworks and firecrackers.
The emergency management department is the competent department in charge of the production and sales management of fireworks and firecrackers, and is responsible for the supervision and management of the safety production and operation of fireworks and firecrackers.
Ecological environment, natural resources, housing and urban and rural construction, civil affairs, urban management, publicity, culture, radio and television, press and publication, tourism, education, sports and other departments and supply and marketing cooperatives shall, in accordance with the division of responsibilities, do a good job in the supervision and management of fireworks and firecrackers. Tenth in areas and places where fireworks are prohibited, the sale of fireworks is prohibited.
Before the implementation of this Ordinance, the fireworks and firecrackers business (retail) license that has been issued within the scope of prohibiting the discharge of fireworks and firecrackers and is still within the validity period shall be recovered by the original issuing department within one month after the implementation of this Ordinance, and if property losses are caused to the operators who have obtained the license to sell fireworks and firecrackers, compensation shall be made according to law. Article 11 If it is necessary to hold a fireworks party or other large-scale fireworks display activities due to major public celebrations, the organizer shall apply to the public security organs of the city and county (city, district) for a discharge permit, and carry out the discharge in accordance with the discharge safety regulations and operation plan. Article 12 Radio, television, newspapers, Internet and other media shall carry out the management of fireworks and firecrackers and conduct public welfare propaganda to change customs, guide citizens to consciously abide by the relevant provisions on the management of fireworks and firecrackers, and supervise the illegal discharge of fireworks and firecrackers by public opinion. Thirteenth primary and secondary schools and guardians of minors should educate minors to set off fireworks and firecrackers in accordance with the law, civilization and safety. Fourteenth industry departments should supervise the celebrations, funerals, sacrifices and other activities carried out by their clients, and inform them of the regulations that fireworks and firecrackers are not allowed to be set off in violation of regulations; Discourage the illegal discharge of fireworks and firecrackers during the activity, and report to the public security organ in time if you don't listen to dissuasion. Fifteenth operators who provide wedding, banquet and other services in areas where fireworks and firecrackers are prohibited or restricted and places where fireworks and firecrackers are prohibited shall inform the clients of the provisions that fireworks and firecrackers shall not be illegally set off before providing services; Discourage the illegal discharge of fireworks and firecrackers in its health responsibility area or business premises, and report to the public security organ in time if it does not listen to dissuasion.
