Article 1 In order to further improve the social assistance system in our city and effectively guarantee the basic livelihood of poor rural residents, according to the spirit of the Notice of Hunan Provincial People's Government on Establishing Urban and Rural Social Assistance System (Xiang [2005]14) and the Notice of Hunan Provincial People's Government on Establishing Rural Minimum Living Security System (Xiang [2006] No.28), combined with the actual situation of our city,
Article 2 All rural residents and families in this Municipality who have permanent residence in rural areas and whose annual per capita disposable income is lower than the minimum living guarantee standard for local rural residents in the counties (cities, districts) where the household registration is located may apply for the minimum living guarantee for local rural residents. Counties (cities, districts) determine the coverage according to the local financial situation and the poverty level of rural residents. ?
Article 3 The minimum living guarantee object for rural residents refers to rural residents who have local permanent residence and the annual per capita income of family members living together is lower than the minimum living guarantee standard for their place of residence. We will focus on ensuring families with perennial difficulties who lack the ability to work and are difficult to help out of poverty through production.
Article 4 The minimum living security system for rural residents adheres to the principles of combining national security with social assistance, encouraging self-help through labor, openness, fairness, justice and territorial management, and implements graded responsibility, dynamic management, classified insurance and remedial assistance. At the initial stage of the implementation of the minimum living guarantee for rural residents, we should adhere to the principle of starting with low standards, providing assistance in a narrow range and gradually expanding. In the future, with the development of economy and society, we should raise the security standard in a timely manner, moderately expand the scope of security, and gradually realize all the insurance should be guaranteed. ?
Article 5 The minimum living security system for rural residents shall be governed by the management system of "government leadership, civil administration, departmental cooperation and social participation". The civil affairs department is the competent department of rural minimum living security, responsible for making work plans, examining and approving security objects, issuing security funds and regulating daily work. The financial department is responsible for raising, timely and full disbursement, supervision and inspection of rural minimum living security funds. Audit and supervision departments are responsible for the audit and supervision of security funds. Other relevant departments are responsible for formulating and implementing preferential support policies for relevant security objects. All departments should strengthen coordination and cooperation, carry out their duties and do their part. It is necessary to widely mobilize social forces to carry out donation activities for poverty alleviation in send warm. ?
Article 6 The minimum living standard for rural residents is based on ensuring the basic livelihood of the local poor, and in principle it is not lower than the absolute poverty line announced by the state (693 yuan per capita in 2007). Specific standards shall be formulated by the local civil affairs department in conjunction with the departments of finance, statistics and prices, and promulgated and implemented after being approved by the people's government at the same level. The rural poor who have already enjoyed the rural five guarantees will no longer enjoy the rural minimum living allowance. ? The minimum living standard for rural residents should be adjusted according to the local economic and social development, residents' living standards and price index changes. ?
Seventh family income refers to the sum of all disposable income of family members living together, including wage income, net income from family business, transfer income and property income. Mainly includes:?
Income from agriculture, aquaculture, handicrafts and other productive activities; ?
(2) Income from wholesale and retail trade and catering industry; ?
(three) social service business and labor income of migrant workers; ?
(four) the village (group) collective economic distribution income; ?
(five) income from one-time compensation for land acquisition, demolition or other reasons, after deducting related expenses such as housing reconstruction and simple decoration; ?
(six) the legal maintenance (support, support) expenses that should be paid by the legal maintenance (support, support) people who do not live with * *, except that the per capita income of the legal maintenance (support, support) people is lower than the minimum living guarantee standard for local rural residents; ?
(7) Income from inheritance or property; ?
(8) Self-sufficient income in kind (converted at market price); ?
(nine) the purchase of lottery tickets, lottery sales and other sales revenue; ?
(10) Rental income; ?
(eleven) other income should be calculated. ?
If it is difficult to determine the wage income of rural residents who work outside the home, it shall be calculated according to the minimum wage standard provided by the labor and social security department of the household registration. The calculation of family income should deduct the non-essential expenses of the family in that year, including the hospitalization expenses of family members in that year due to illness and the large tuition and miscellaneous fees of family members in that year. ?
Eighth the following funds are not included in the family income:
(a) entitled groups in accordance with the provisions to enjoy the disability pension and family members of conscripts preferential payments; ?
(two) grants, scholarships, bonuses and subsidies given by the government, society and schools to the children of poor families at school; ?
(3) Temporary life assistance and consolation money given by the government, social organizations and individuals. ?
Ninth in any of the following circumstances, rural residents shall not enjoy the minimum living allowance:
(a) the purchase, construction or decoration of housing within three years (except for necessary maintenance) has caused difficulties in family life (except for the purchase, construction and simple decoration of housing due to demolition and resettlement); ?
(two) there are contracted fields (land) and have the ability to work but do not cultivate; ?
(three) I and my family members have gambling, drug abuse or high-consumption entertainment activities; ?
(four) the family has mobile phones, motorcycles, air conditioners, expensive jewelry and other high-end consumer goods that are not necessary for life; ?
(five) the family living standard is significantly higher than the minimum living standard; ?
(six) resort to deceit, defrauding the minimum living allowance for rural residents; ?
(seven) other laws and regulations can not enjoy the minimum living allowance. ?
Tenth rural residents' minimum living security assistance adhere to the principle of declaration at the place where the household registration is located. If there are children in the family who apply for the minimum living guarantee for rural residents and have been admitted to colleges and universities and moved to schools, they will still be counted as family members who live with them and enjoy the minimum living guarantee at the place where their accounts are located. ?
Eleventh families applying for the minimum living guarantee for rural residents shall, with the head of the household as the applicant, submit a written application to the village committee where the household registration is located, and provide the following relevant documents and supporting materials:
(a) the original and photocopy of the household registration book and resident identity card of the family members; ?
(two) proof of the income status of family members (issued by the local villagers' group); ?
(three) legal support (support, support) family members' income certificate (certified by the local villagers' group) or support (support, support) agreement and other relevant legal documents; ?
(four) if there are family members of the disabled, the original and photocopy of the disability certificate should be provided; ?
(five) family members suffering from serious diseases, should provide hospital outpatient (emergency) medical records and hospitalization medical records, disease diagnosis certificate and medical expenses receipt; ?
(six) the original and photocopy of the contract or lease of land, mountains, ponds, factories and mines, and the certificate of agricultural income issued by the villagers' committee; ?
(7) Other necessary relevant certificates. ?
Article 12 The villagers' committee shall investigate and verify the documents and certification materials provided by the applicant, conduct democratic appraisal according to the investigation and verification, determine the standards for replacement, and guide the applicants who meet the requirements after preliminary examination to fill out the Application and Approval Form for Minimum Living Security for Rural Residents, post it for publicity, and report it to the township (town) people's government or sub-district offices. The township (town) people's government or the subdistrict office shall verify the objects reported by the villagers' committee, and if they meet the requirements, the villagers' committee shall make a second announcement and report it to the civil affairs department of the county (city, district) at the same time. County (city, district) civil affairs departments shall review the objects reported by the township (town) people's government or street offices. The villagers committee to the county (city, district) civil affairs departments to verify the examination and approval results for the third time posting. The minimum living allowance for rural residents shall be paid quarterly from the month following the date of approval. Banks or rural credit cooperatives designated by the township (town) people's government issue personal account passbooks on a household basis, and rural residents with minimum living allowances can receive the minimum living allowance for rural residents directly from the local banks or rural credit cooperatives and postal savings offices. ?
Thirteenth rural residents' minimum living guarantee shall be subject to the system of individual declaration at any time, and the villagers' committee and the administrative examination and approval authority shall complete the examination and approval procedures within one month from the date of receiving the written application from the applicant. To implement the minimum living security system for rural residents, we should implement the system of democratic appraisal and three lists publicity. The villagers' committee shall set up a democratic appraisal group for the minimum living guarantee for rural residents and set up a fixed publicity column. The minimum living guarantee for rural residents shall be subject to an annual review system. For families who stop enjoying the minimum living guarantee for rural residents, the civil affairs departments of counties (cities, districts) shall promptly recover the "Minimum Living Guarantee Certificate for Rural Residents". When the family income of rural residents who enjoy the minimum living guarantee for rural residents changes, they should promptly inform the management authorities to handle the relevant procedures. ? Civil affairs, finance, supervision and auditing departments at all levels shall supervise and inspect the minimum living guarantee for rural residents, and investigate and punish violations of laws and regulations such as fraud according to law and discipline. ?
Article 14 The minimum living guarantee for rural residents shall be incorporated into the financial budget of the city and county (city, district) according to the principle of graded responsibility and multi-party financing, and special account management and earmarking shall be implemented. Donations and subsidies provided by enterprises, social organizations and individuals for rural residents' minimum living security shall be included in the special account management of rural residents' minimum living security funds. ? Counties (cities, districts) should incorporate the minimum living guarantee for rural residents into the fiscal budget in a timely manner, and raise the standards year by year according to economic development. The municipal finance is included in the fiscal budget according to the standard of 1 yuan per person per year of the city's agricultural population, and the funds raised are mainly used for subsidies to counties (cities, districts). The allocation scheme of subsidy funds is studied and formulated by the Municipal Civil Affairs Bureau and the Municipal Finance Bureau in combination with the actual situation in various places, and reaches counties (cities, districts) year by year. The distribution and management of the minimum living guarantee for rural residents shall be implemented with reference to the relevant provisions of the minimum living guarantee for urban residents. ?
Article 15 Those who engage in the examination and approval of the minimum living guarantee for rural residents neglect their duties, engage in malpractices for selfish ends, practise fraud, or embezzle, misappropriate or withhold the minimum living guarantee funds for rural residents shall be given administrative sanctions by the relevant departments according to law; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated by judicial organs according to law. ?
Sixteenth county (city, district) people's government can formulate specific implementation rules according to these measures. ?
Seventeenth of these measures from July 2007 1. Where laws, regulations and rules provide otherwise, such provisions shall prevail.
