Article 1 These Regulations are formulated in accordance with the Regulations of the State Council Municipality on the Safety Management of Fireworks and Firecrackers and other relevant laws and regulations, combined with the actual situation of this Municipality, with a view to strengthening the safety management of the sale and discharge of fireworks and firecrackers, ensuring the safety of the public, people and property, reducing air pollution and improving environmental quality.

Article 2 These Regulations shall apply to the safety management of the sale and discharge of fireworks and firecrackers within the administrative area of this Municipality.

Article 3 The Municipal People's Government shall be responsible for organizing the implementation of these Regulations, establishing a coordination mechanism for the safety management of fireworks sales and discharge, and making overall arrangements for the safety management of fireworks sales and discharge.

The district and county people's governments and the Development Zone Management Committee are responsible for the safety management of the sales and discharge of fireworks and firecrackers within their respective management scope.

The Town People's Government and the subdistrict offices shall incorporate the safety management of fireworks and firecrackers into the social governance at the grassroots level, and strengthen the organization, coordination, guidance and supervision.

Fourth safety production supervision and management departments are responsible for the supervision and management of fireworks and firecrackers safety production; The public security organ is responsible for the safety management of fireworks and firecrackers.

Quality supervision, industry and commerce, transportation, environmental protection, commerce, urban management, education and other relevant administrative departments shall, in accordance with their respective responsibilities, do a good job in the safety management of sales and fireworks.

Supply and marketing cooperatives shall strengthen the management of fireworks and firecrackers business activities of enterprises in this system.

Fifth organs, organizations, enterprises and institutions, residents' committees, villagers' committees, owners' committees and property service organizations shall cooperate with the safety management of fireworks and firecrackers, publicize, educate and guide the public to discharge fireworks and firecrackers legally, civilly and safely.

Article 6 The municipal, district and county people's governments and their relevant departments shall regularly organize publicity on the safety management of fireworks and firecrackers, and increase the publicity on the safety management of fireworks and firecrackers during major festivals.

Radio, television, newspapers, internet and other media should carry out safety management of fireworks and firecrackers and public welfare propaganda to change customs.

Schools and guardians of minors shall educate minors on the safety of fireworks and firecrackers.

Seventh new city, beilin district, Lianhu District, Yanta District, Baqiao District, weiyang district administrative areas prohibit the sale and discharge of fireworks.

Other areas where sales and emissions are prohibited outside the areas specified in the preceding paragraph shall be determined by the local and county people's governments; Involving the Development Zone, the opinions of the Development Zone Management Committee shall be sought. After the area where sales and emissions are prohibited is determined, the district and county people's governments shall make an announcement to the public.

Article 8 It is forbidden to sell and set off fireworks and firecrackers in the following places outside the areas specified in Article 7 of these regulations:

(1) State organs;

(two) the scope of protection of cultural relics protection units, historical and cultural blocks and excellent modern buildings;

(3) Units that produce and store inflammable and explosive articles;

(four) parks, forests and other key fire prevention areas;

(5) Medical institutions, schools, kindergartens, sanatoriums and institutions for the aged;

(six) transportation hubs such as stations and airports, urban rail transit and railway line safety protection zones, and motor vehicle parking lots;

(seven) power transmission and transformation facilities safety protection zone;

(eight) theaters, museums, libraries, shopping malls, exhibition halls;

(nine) other key units of fire safety.

Ninth heavy pollution weather warning and emergency response period, it is forbidden to set off fireworks within the administrative area of this Municipality.

The Municipal People's Government shall timely release the early warning and emergency response information of heavy polluted weather through the news media to remind the public that fireworks and firecrackers are prohibited during this period.

Article 10 When holding large-scale fireworks display activities such as fireworks evening, the organizer shall apply to the public security organ for administrative license according to the fireworks display level and obtain the fireworks display license.

If it is really necessary to hold large-scale fireworks display activities, such as fireworks parties, in the area where sales and discharge are prohibited as stipulated in the first paragraph of Article 7 of these regulations, the public security organ shall obtain the consent of the Municipal People's Government before accepting the administrative license; If it is really necessary to hold large-scale fireworks display activities, such as fireworks parties, in the area where sales and discharge are prohibited as determined by the district or county people's government, the public security organ shall obtain the consent of the district or county people's government before accepting the administrative license.

Eleventh enterprises engaged in the wholesale of fireworks and firecrackers shall apply to the municipal safety production supervision and management department for administrative license and obtain the "fireworks and firecrackers business (wholesale) license".

Operators engaged in the retail of fireworks and firecrackers shall apply to the district and county safety production supervision and management departments for administrative license and obtain the "Fireworks and Firecrackers Business (Retail) License".

Article 12 Fireworks wholesale enterprises shall establish fireworks purchase and sales files, truthfully record the names, specifications, quantities, purchasing units and other purchase and sales information of fireworks products, and keep them for three years for future reference.

Thirteenth fireworks retail layout, determined by the county safety production supervision and management departments in accordance with the principle of ensuring safety, unified planning, rational layout, total control; Belong to the scope of development zone management, decided by the development zone management committee.

It is forbidden to set up fireworks retail outlets and residential places in the same building.

Article 14 The types and specifications of fireworks and firecrackers that are allowed to be sold and set off in this Municipality shall be determined by the safety production supervision and management department in conjunction with the administrative departments of public security, quality supervision, industry and commerce according to the national standards for the safety and quality of fireworks and firecrackers and the actual situation, and shall be announced after being reported to the Municipal People's Government for approval.

Fifteenth production safety supervision, public security and other relevant administrative departments shall establish and improve the supervision and inspection system, strengthen the inspection of the sale and discharge of fireworks and firecrackers, and promptly investigate and deal with illegal sales and discharge of fireworks and firecrackers.

Sixteenth fireworks business units in this city, fireworks parties and other large-scale fireworks business units shall, according to the safety needs, insure the corresponding insurance according to law; Encourage them to buy relevant liability insurance.

Article 17 In areas where sales and discharge are prohibited, residents' committees, villagers' committees and owners' committees may convene residents' meetings, villagers' meetings and owners' meetings, formulate conventions on matters related to the discharge of fireworks and firecrackers in their residential areas according to law, and organize and supervise their implementation.

Eighteenth in the area where sales and discharge are prohibited, the realty service organization shall remind the owners not to set off fireworks. Outside the area where sales and discharge are prohibited, the realty service organization shall do a good job in reminding the safety of discharge and related preventive work.

The realty service organization shall discourage the illegal discharge of fireworks and firecrackers in this service area on the spot; If dissuasion is ineffective, it shall report to the public security organ in time.

Nineteenth hotels, hotel operators and units and individuals engaged in wedding and funeral services that undertake banquet services in areas where sales and discharge are prohibited shall inform consumers in writing in advance of the prohibition of fireworks and firecrackers.

Hotels and hotel operators should discourage illegal fireworks and firecrackers on the spot in their city appearance and environmental sanitation responsibility areas; If dissuasion is ineffective, it shall report to the public security organ in time.

Twentieth fireworks, fireworks should be set off safely in accordance with the instructions. Do not throw it at pedestrians, vehicles, buildings, structures and crowded places, and do not affect road traffic safety or discharge it in other ways that endanger public safety and personal and property safety.

It is forbidden to set off fireworks and firecrackers in buildings, structures, roofs, balconies and windows.

Twenty-first any unit or individual who finds illegal sales and discharge of fireworks and firecrackers has the right to report to the relevant administrative departments such as safety production supervision and public security. The department that accepts the report shall timely check, handle and give feedback.

Twenty-second illegal sales, fireworks related information, into the city public credit information service platform.

Article 23 Whoever, in violation of the provisions of Article 7, Article 8 and Paragraph 2 of Article 20 of these Regulations, sets off fireworks and firecrackers in areas where the sale and discharge are prohibited, shall be ordered by the public security organ to stop the discharge, and shall be fined from 300 yuan to 500 yuan.

In violation of the provisions of the first paragraph of Article 9 of these regulations, if fireworks and firecrackers are set off during the early warning and emergency response period of heavy polluted weather above Grade 3, the public security organ shall order them to stop setting off and impose a fine of 500 yuan.

Twenty-fourth whoever, in violation of the provisions of the first paragraph of Article 10 of these regulations, holds a fireworks show and other large-scale fireworks display activities without permission shall be ordered by the public security organ to stop the discharge, and the responsible unit shall be fined between 30,000 yuan and 50,000 yuan.

Article 25 Whoever, in violation of the provisions of Article 11 of these regulations, operates fireworks and firecrackers without permission shall be ordered by the safety production supervision and management department to stop the illegal business activities, and shall be fined not less than 20,000 yuan but not more than 100,000 yuan, and the illegal business items and illegal income shall be confiscated.

Article 26 If, in violation of the provisions of Article 12 of these regulations, a fireworks wholesale enterprise fails to establish the procurement and sales files of fireworks or fails to keep them for future reference as required, the safety production supervision and management department shall order it to make corrections within a time limit and impose a fine of not less than 5,000 yuan but not more than 30,000 yuan.

Twenty-seventh in violation of the provisions of the second paragraph of Article eighteenth and the second paragraph of Article nineteenth of this Ordinance, the property service organizations and hotels and restaurant operators failed to perform the obligation of dissuasion and reporting, resulting in illegal discharge of facts, and shall be given a warning by the public security organ.

Article 28 Whoever, in violation of the provisions of the first paragraph of Article 20 of these regulations, discharges fireworks and firecrackers in a way that endangers public safety and personal and property safety, shall be ordered by the public security organ to stop the discharge, and shall be imposed with a fine of 100 yuan but not more than 500 yuan.

Twenty-ninth other acts in violation of the provisions of these regulations, laws and regulations have penalties, such provisions shall apply.

Thirtieth in accordance with the provisions of this Ordinance, make a fine of more than thirty thousand yuan, it shall inform the parties of the right to request a hearing.

Thirty-first safety production supervision, public security and other relevant administrative departments and their staff, in the safety management of fireworks and firecrackers, have one of the following acts, and their superior departments or supervisory organs shall order them to make corrections; If the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

Illegal implementation of administrative licensing;

(two) do not accept, not timely verification report;

(three) do not investigate and deal with illegal sales, fireworks behavior;

(four) other acts of abuse of power, dereliction of duty, favoritism.

Article 32 These Regulations shall come into force as of 20 17 12 1.
