The term "fireworks" as mentioned in these Provisions refers to the inflammable and explosive articles which use pyrotechnics as the main raw materials and produce light, sound, color, shape, smoke and other effects through burning or explosion after being ignited for viewing. Article 3 The people's governments of cities and counties (cities, districts) shall strengthen their leadership over the management of fireworks and firecrackers, and establish and improve the working mechanism of coordinated management.
The emergency management department is responsible for the supervision and management of the safety production of fireworks and firecrackers, and investigate and deal with the illegal activities of safety production in the business activities of fireworks and firecrackers according to law.
The public security organs are responsible for the safety management of fireworks and firecrackers, provide warning signs prohibiting the discharge of fireworks and firecrackers, investigate and deal with illegal acts in fireworks and firecrackers and other activities, and organize the destruction and disposal of confiscated fireworks and firecrackers and fireworks and firecrackers abandoned by business units.
Natural resources and planning, market supervision and management, ecological environment, comprehensive administrative law enforcement, transportation, culture, radio, film and television tourism, education and other departments shall, according to their respective responsibilities, do a good job in the management of fireworks and firecrackers.
The township (town) people's government and sub-district offices shall be responsible for the safety management of fireworks and firecrackers within their respective jurisdictions. Fourth within the administrative area of this Municipality, it is forbidden to operate and set off fireworks and firecrackers in urban built-up areas. The specific scope of urban built-up areas shall be determined by the people's governments of cities and counties (cities) and announced to the public.
County (city, district) people's governments may, according to the actual situation of their respective administrative areas, determine other areas outside the urban built-up areas where it is forbidden to operate and release fireworks and firecrackers to the society. Article 5 It is forbidden to set off fireworks and firecrackers in the following places outside the area specified in Article 4 of these Provisions and within 50 meters around it:
Office of state organs;
(two) the scope of protection of cultural relics protection units and historical buildings;
(3) Transportation hubs such as stations, docks and airports and railway line safety protection zones;
(4) Medical institutions, kindergartens, primary and secondary schools, nursing homes and places for religious activities;
(five) tourist attractions, commodity trading markets, parks, cemeteries and other public places;
(six) the production and storage units of flammable and explosive materials and dangerous chemicals, as well as key industrial and mining enterprises for fire safety;
(seven) in the safety protection zone of power transmission and transformation facilities;
(8) Protected areas for military installations.
(nine) key fire prevention areas such as mountains and grasslands;
(10) High-rise residential quarters;
(eleven) other places prohibited by laws, regulations and rules. Sixth county (city, district) public security organs shall organize relevant units to set up obvious warning signs in places where fireworks and firecrackers are prohibited, and relevant units and individuals shall cooperate.
No unit or individual may damage the warning signs. Article 7 If it is really necessary to hold a fireworks show or other large-scale fireworks display in the area specified in Article 4 of these Provisions for major public activities determined by the people's government of the city or county (city), the organizer shall apply to the public security organ in accordance with the relevant provisions.
If the public security organ makes a decision to grant permission, it shall issue a permit for the discharge of fireworks and firecrackers, and announce the time, place, type, specification and quantity of the permit to the public. Eighth people's governments at all levels and relevant departments shall do a good job in the publicity and education of operating and setting off fireworks and firecrackers according to law.
Television, radio, newspapers, internet and other news media should carry out publicity and education activities to operate and set off fireworks and firecrackers according to law.
Encourage village rules and regulations, residents' conventions and owners' management regulations to make an agreement on the content of fireworks and firecrackers according to law. Article 9 Fireworks and firecrackers wholesale enterprises shall establish business files, truthfully record the names, specifications, quantity, shelf life, sales time, purchasing units and other contents of fireworks and firecrackers, and keep relevant vouchers for two years for future reference.
Encourage retail operators to establish business files. Article 10 The layout of retail outlets of fireworks and firecrackers outside the prohibited areas as mentioned in Article 4 of these Provisions shall be determined by the emergency management department of the county (city, district) after consulting the opinions of the township (town) people's government and sub-district offices in accordance with the principle of total control, ensuring safety and reasonable layout. Eleventh in the area stipulated in article fourth, no unit or individual may store fireworks products.
Outside the areas specified in Article 4 of these Provisions, the total amount of fireworks and firecrackers stored by non-fireworks and firecrackers operators shall not exceed 30 kg. Twelfth hotels and restaurants with comprehensive functions of catering and accommodation in the areas specified in Article 4 of these Provisions shall explicitly prohibit the discharge of fireworks and firecrackers in a conspicuous position.
Units and individuals engaged in catering, accommodation, wedding etiquette and funeral services in the areas and places specified in Articles 4 and 5 of these Provisions shall inform the clients of the provisions prohibiting the discharge of fireworks and firecrackers, and shall not provide related services for the discharge of fireworks and firecrackers.
