Article 2 Fireworks and firecrackers mentioned in these Provisions refer to all kinds of fireworks, firecrackers, fireworks and other products that use gunpowder as raw materials and can produce smoke and sound. Article 3 These Provisions shall apply to the prohibition of setting off fireworks and firecrackers and their supervision and management within the administrative area of this Municipality. Central urban area: East Outer Ring Road-108 National Road, South Outer Ring Road-108 National Road, West Ring Road (Linxia Line) and North Ring Road-108 National Road, including the above four roads.

In administrative areas other than those specified in the preceding paragraph, the scope of prohibiting the discharge of fireworks and firecrackers shall be determined by the local people's government at the county level. Fifth in addition to the provisions of the provisions of the fourth places, the following places are prohibited from setting off fireworks:

The relevant units shall set up obvious signs prohibiting the discharge of fireworks and firecrackers in the places prohibited by the preceding paragraph. Sixth during the early warning period of heavy pollution weather, it is forbidden to set off fireworks and firecrackers within the administrative area of this Municipality. Article 7 No unit or individual may produce, manage, store or transport fireworks and firecrackers in areas and places where fireworks and firecrackers are prohibited. Eighth city and county (city, district) people's government should strengthen the organization and leadership of the work of prohibiting the discharge of fireworks and firecrackers, and coordinate the major issues in the work of prohibiting the discharge of fireworks and firecrackers.

The public security department of the people's government of the city or county (city, district) is the department in charge of prohibiting the discharge of fireworks and firecrackers, and the relevant departments of production safety supervision and management, environmental protection, quality and technical supervision, industrial and commercial administration, housing security, urban and rural construction, etc. shall do relevant work according to their respective duties.

Residents' committees, villagers' committees and property service agencies shall cooperate with relevant departments to ban the discharge of fireworks and firecrackers. Ninth people's governments at all levels in this Municipality and their relevant departments shall carry out publicity and education activities to prohibit the discharge of fireworks and firecrackers.

Radio, television, newspapers, internet and other media units should carry out public welfare publicity to prohibit the discharge of fireworks and firecrackers.

Schools and guardians of minors shall educate minors about the prohibition of setting off fireworks and firecrackers. Tenth major public events and major festivals, it is necessary to hold a fireworks party or other large-scale fireworks display activities, decided by the Municipal People's government and issued an announcement. Eleventh any unit or individual found in violation of the provisions of the act, have the right to discourage, or report to the public security organs, production safety supervision and management departments. Twelfth in violation of these provisions, laws and regulations have legal liability provisions, from its provisions. Thirteenth in violation of the provisions, in areas and places where fireworks are prohibited, the public security organ shall order it to stop the discharge and impose a fine of one hundred yuan or more and two hundred yuan or less; If the circumstances are serious, a fine of more than 200 yuan and less than 500 yuan shall be imposed.

In violation of these regulations, fireworks and firecrackers are set off during the early warning period of heavy pollution weather, and the public security organ shall order them to stop setting off, and impose a fine of more than 200 yuan and less than 500 yuan. Fourteenth in violation of the provisions, causing property losses or personal injury to the state, the collective and others, shall bear civil liability according to law; If it constitutes a violation of public security administration, it shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 15 Public security organs, production safety supervision and management departments and their staff, in violation of these Provisions, abuse their powers, neglect their duties or engage in malpractices for selfish ends in the work of prohibiting the discharge of fireworks and firecrackers, which constitutes a crime, shall be investigated for criminal responsibility according to law; If it does not constitute a crime, it shall be punished according to law.
