: the determination of the overlord clause?
Overlord clauses are generally standard clauses. This clause requires the other party to pay special attention. ?
In any of the following circumstances, this clause is invalid.
(1) One party enters into a contract by means of fraud or coercion, which harms the interests of the state; ?
(2) Malicious collusion that harms the interests of the state, the collective or a third party; ?
(3) Covering up illegal purposes in a legal form; ?
(4) damaging the public interest; ?
(5) Violating the mandatory provisions of laws and administrative regulations. ?
The following exemption clauses in this contract are invalid:
(1) Causing personal injury to the other party;
(2) Causing property losses to the other party due to intentional or gross negligence.
Laws and regulations deal with the overlord clause: the maximum fine is 30 thousand yuan. The industrial and commercial department will give a warning to the operators who use the overlord clause according to the Measures for Supervision and Handling of Contract Violations issued by the State Administration for Industry and Commerce, and impose a fine of less than 3 times the illegal income but not more than 30,000 yuan. No illegal income, a fine of ten thousand yuan.
