Measures of Shandong Province on Implementing the Interim Provisions on Education Supervision
Article 1 These Measures are formulated in accordance with the Interim Provisions on Educational Supervision for the purpose of establishing an educational supervision system and strengthening administrative supervision of educational work. Article 2 The task of educational supervision is to supervise, inspect, evaluate and guide the educational work of people's governments at lower levels, educational administrative departments at lower levels and schools, so as to ensure the implementation of educational principles, policies and regulations and the realization of educational objectives. Article 3 The scope of educational supervision mainly covers primary and secondary education, preschool education and special education.

Educational supervision institutions may, according to the requirements of the people's government at the corresponding level or the administrative department of education, supervise the educational work other than those specified in the preceding paragraph. Article 4 The whole province shall establish an educational supervision system. The education administrative departments of provinces, cities (prefectures) and counties (cities, districts) shall exercise the functions and powers of education supervision on behalf of the people's governments at the corresponding levels. The Provincial Education Commission (hereinafter referred to as the Provincial Education Commission) is responsible for the management of the province's education supervision.

Major provincial enterprises carry out educational supervision within the scope of their own enterprises. Fifth Provincial Education Commission set up education supervision office, its main responsibilities are:

(a) to implement the national guidelines, policies, laws and regulations on educational supervision, and complete the educational supervision tasks assigned by the state and the province.

(two) to formulate rules and regulations and implementation plans for educational supervision and evaluation, and organize their implementation.

(three) to organize and coordinate the inspection, evaluation and guidance of education at all levels except higher education.

(four) to guide the work of education supervision in the province, summarize and popularize the experience of education supervision, and organize scientific research on education supervision.

Article 7 People's governments at all levels shall determine the establishment of educational supervision offices according to the scale of educational undertakings within their respective administrative areas and local actual conditions. Ninth education supervision offices at all levels should be equipped with a small number of staff in addition to inspectors. Staff must have a college degree or above or equivalent, be enterprising, have good political quality and have some practical experience in education. Tenth education supervision offices at all levels set up full-time inspectors and part-time inspectors. The measures for the appointment of part-time inspectors shall be formulated separately by the Provincial Education Commission in conjunction with relevant departments. Full-time and part-time inspectors have the same authority. Eleventh inspectors issued by the people's government at the same level inspector certificate. Twelfth special inspector must meet the following basic conditions:

(a) adhere to the party's basic line and be loyal to the cause of socialist education;

(two) familiar with the national education guidelines, policies and regulations, with a high level of policy;

(three) with a bachelor's degree or equivalent, and more than ten years of education experience, familiar with education and teaching, and have a certain leadership and management ability and writing level;

(four) serious and responsible, adhere to principles, law-abiding, fair and honest, contact with the masses, handle affairs fairly, seek truth from facts, and have certain public prestige;

(five) good health, can insist on supervision. Article 13 Inspectors must receive training. Provincial and municipal inspectors must participate in the training organized by the State Education Commission; County (city, district) inspectors must participate in the training organized by the Provincial Education Commission. Fourteenth inspectors with professional and technical positions or transferred from educational institutions shall be treated according to the existing relevant regulations. Fifteenth education supervision office or inspector has the following powers:

(a) to conduct a comprehensive or individual inspection and evaluation of the educational work within the scope of supervision;

(two) to criticize and stop acts that violate the educational principles, policies, regulations and education laws, and to order them to make corrections within a time limit;

(three) to attend the relevant meetings of the supervised units, participate in relevant teaching activities, and assess the work and learning conditions of educators and students;

(four) to require the supervised units to provide documents and materials related to the supervision matters and report their work;

(five) on-site investigation of the supervised units. Article 16 An inspector shall hold an inspector's certificate for supervision. Seventeenth education supervision office or inspector in performing their duties, should follow the principle of objectivity and fairness, seeking truth from facts, support the work of the supervised units, pay attention to discover and summarize advanced experience. For the problems found, we should give priority to helping and guiding, with the aim of promoting work. Article 18 After completing the supervision task, the education supervision office or inspector shall report the supervision results to the people's government at the corresponding level, the administrative department of education and the superior supervision institution, and put forward opinions or suggestions, which can be announced to the public. Nineteenth after the supervision work, the education supervision office or the inspector shall inform the supervised unit of the situation and put forward opinions and suggestions; For units with serious problems, it is necessary to issue an inspector's notice, point out the problems, require rectification within a time limit, and conduct a review if necessary. Article 20 The supervised unit shall make a reply to the requirements put forward in the inspector's notice within a time limit, and make corrections, and report the improvement situation and the measures taken in writing to the education supervision office or the inspector. Twenty-first supervised units and individuals in any of the following circumstances, by the local people's government or the administrative department of education to informed criticism, the person in charge of the unit and the person directly responsible to give corresponding administrative sanctions; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law:

(a) refusing to implement the supervision measures of the education supervision office or the inspector;

(2) Obstructing or resisting inspectors from exercising their functions and powers according to law;

(3) Attacking, framing or retaliating against inspectors.
