(a) housing construction, municipal engineering, water conservancy projects, transportation infrastructure construction, maintenance, demolition and other construction projects;
(2) Road transportation;
(3) Cleaning of municipal public facilities, urban roads and expressway;
(four) greening projects and greening operations;
(5) production of ready-mixed concrete and ready-mixed mortar;
(6) Mining and processing activities of mineral resources;
(seven) industrial production activities such as building materials and handicraft processing;
(eight) rural agricultural land leveling, non-road mobile agricultural machinery operations and other agricultural production activities;
(nine) the storage materials of port and wharf projects and the material storage yard of industrial enterprises;
(ten) gravel field within the scope of river management;
(eleven) the bare ground in the urban built-up area;
(twelve) other activities and places that are easy to produce dust particles. Article 4 The prevention and control of dust pollution shall follow the principles of giving priority to prevention, comprehensive management and bearing the responsibility for damage, and build an environmental governance system with government as the leading factor, enterprises as the main body, social organizations and public participation. Article 5 The people's governments at the municipal and county levels shall be responsible for the prevention and control of dust pollution in their respective administrative areas, formulate work plans for the prevention and control of dust pollution in their respective administrative areas according to the objectives and control tasks of atmospheric environmental protection, and establish a mechanism for overall coordination, long-term management and information sharing of dust pollution prevention and control. The town people's government and sub-district offices shall carry out dust pollution prevention and control work in accordance with their duties.
Villagers' committees and residents' committees shall assist in the prevention and control of dust pollution. Sixth people's governments at all levels and relevant competent departments should strengthen the publicity and education of laws and regulations on the prevention and control of dust pollution.
The news media shall carry out public welfare publicity on laws and regulations on the prevention and control of dust pollution and scientific prevention and control knowledge, and supervise the illegal activities of dust pollution prevention and control by public opinion. Chapter II Responsibility for Prevention and Control Article 7 The competent department of ecological environment shall exercise unified supervision and management over the prevention and control of dust pollution within their respective administrative areas, be responsible for coordinating and urging relevant departments to perform their management duties, and be responsible for the supervision and management of dust pollution prevention and control in industrial enterprise yards. Article 8 The competent department of housing and urban and rural construction shall be responsible for the supervision and management of the prevention and control of dust pollution in urban and rural housing and municipal engineering construction, the production of ready-mixed concrete and ready-mixed mortar, and the construction waste disposal sites and the comprehensive utilization treatment sites of construction waste resources. Article 9 The comprehensive law enforcement department in charge of urban management shall be responsible for the supervision and management of the prevention and control of dust pollution such as the construction of municipal public facilities, public parking lots and squares, road greening, city appearance and environmental sanitation, collection and transportation of urban and rural domestic garbage and urban construction garbage. Tenth departments in charge of natural resources are responsible for the supervision and management of the prevention and control of dust pollution such as construction land, mining, mine geological environment control projects and the demolition of buildings (structures) that violate land management. Article 11 The competent transportation department is responsible for the construction, maintenance, demolition and other construction activities of transportation infrastructure such as roads, ports and docks, and the prevention and control of dust pollution caused by the use of bare parking lots, as well as the supervision and management of dust pollution prevention and control caused by road cleaning and greening projects, greening operations and materials stored in ports and docks. Article 12 The traffic administrative department of the public security organ is responsible for stipulating the driving routes and transit times of transport vehicles that are prone to dust pollution, such as construction waste, construction earthwork and ready-mixed concrete, and investigating and dealing with illegal acts such as the above-mentioned vehicles not driving according to the prescribed driving routes and transit times according to law. Thirteenth water administrative departments shall be responsible for the supervision and management of the construction, maintenance and demolition of water conservancy projects and the prevention and control of dust pollution such as sand yard operations within the scope of river management. Fourteenth agricultural and rural authorities are responsible for the supervision and management of dust pollution prevention and control in rural agricultural land leveling, non-road mobile agricultural machinery operation, rural homestead building and comprehensive utilization of agricultural wastes such as straw. Fifteenth industrial and information technology departments are responsible for organizing and coordinating the development of energy-saving and environmental protection industries, promoting the technological transformation and upgrading of industrial green development, eliminating backward production capacity, guiding and urging industrial enterprises to implement the main responsibility of dust pollution prevention and control. Sixteenth development and reform, finance, market supervision and management, civil affairs, forestry, science and technology, civil air defense and other departments are responsible for the prevention and control of dust pollution within their respective responsibilities. Chapter III Prevention and Control Measures Section 1 Prevention and Control of Dust Pollution in Construction Projects Article 17 The relevant units of a construction project shall perform the following obligations for prevention and control of dust pollution:
(a) the construction unit is responsible for the prevention and control of construction dust pollution, dust pollution prevention and control costs included in the project cost, the implementation of separate payment. In the tender documents, bidders are required to formulate measures to prevent and control dust pollution on the construction site. Incorporate the prevention and control of dust pollution into the project supervision contract, and the supervision unit shall implement the supervision responsibility of dust pollution prevention and control in accordance with the contract; Define the responsibility of the construction unit for dust pollution prevention and control in the construction contract, supervise its preparation of special plans for dust pollution prevention and control, and implement dust pollution prevention and control measures.
(two) the supervision unit shall incorporate the prevention and control of construction dust pollution into the scope of supervision, put forward targeted supervision measures in combination with the characteristics of the project, and strengthen the inspection of construction dust pollution prevention and control; If the construction is not carried out in accordance with the dust pollution prevention measures, the construction unit shall be required to correct it immediately and report to the construction unit in time.
(3) The construction unit shall specifically undertake the prevention and control of dust pollution in construction projects, formulate specific implementation plans for the prevention and control of dust pollution in construction, establish a dust pollution prevention account, equip relevant management personnel, and implement dust pollution prevention and control measures in the construction site. The expenses for the prevention and control of dust pollution shall be earmarked and shall not be misappropriated.
