Regulations of Yingtan Municipality on the sale and discharge of fireworks and firecrackers
Article 1 In order to strengthen the management of the sale and discharge of fireworks and firecrackers, protect and improve the environment, and ensure the safety of the public, people and property, these Regulations are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations on the Safety Management of Fireworks and Firecrackers and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the sales and discharge management of fireworks and firecrackers within the administrative area of this Municipality. Article 3 The municipal, district (city) people's governments shall strengthen their leadership in the management of fireworks sales and discharge, and coordinate major issues in the management of fireworks sales and discharge.

The public security organ is the competent department of fireworks management, responsible for the safety management of fireworks.

The emergency management department is the competent department of fireworks sales management, and is responsible for the supervision and management of fireworks sales.

Urban management, ecological environment, administrative examination and approval, meteorology, civil affairs, housing and urban and rural construction, market supervision and management, transportation, education, supply and marketing and other relevant departments and units shall, within the scope of their respective functions and duties, do a good job in the management of fireworks sales and discharge according to law.

Yingtan High-tech Industrial Development Zone Management Committee, Longhushan Scenic Area Management Committee and Xinjiang New District Management Committee (hereinafter referred to as the Administrative Committee) are responsible for the management of the sales and discharge of fireworks and firecrackers within their respective jurisdictions in accordance with the provisions of the Municipal People's Government. Article 4 Township (town) people's governments and sub-district offices shall, in accordance with the requirements of the municipal, district (city) people's governments, relevant departments and administrative committees, organize and implement the management of the sales and discharge of fireworks and firecrackers within their respective jurisdictions.

Village (neighborhood) committees shall assist in the management of fireworks sales and discharge. Article 5 The municipal and district (city) people's governments shall, according to the actual situation of their respective administrative areas, determine the area and time when fireworks and firecrackers are prohibited according to law, and announce them to the public. Article 6 It is forbidden to set off fireworks and firecrackers in the following places:

(a) cultural relics protection units and nature reserves, drinking water source protection areas;

(2) Transportation hubs such as stations and docks and railway line safety protection zones;

(3) Gas stations, liquefied petroleum gas stations, natural gas stations, places for producing, selling, storing and using inflammable and explosive articles such as grain, cotton, oil and hemp, and safety protection zones for power transmission and transformation facilities;

(4) State organs, medical institutions, kindergartens, schools, pension institutions and welfare homes;

(5) Places where fireworks and firecrackers are strictly prohibited in key fire prevention areas such as factories, mines and forests;

(six) parks, shopping malls, bazaars, public places of entertainment and other crowded places;

(7) Bridges and underground spaces;

(eight) other places stipulated by the municipal and district (city) people's government. Article 7 Where fireworks and firecrackers are sold in areas and places where the discharge of fireworks and firecrackers is prohibited, and property losses are caused to operators who have obtained business licenses for fireworks and firecrackers, compensation shall be made according to law, and the specific compensation measures shall be formulated by the Municipal People's Government. Eighth in the area where fireworks are prohibited, the sales of fireworks should be strictly controlled, the layout should be reasonable, and the supervision should be strengthened.

Fireworks and firecrackers sold shall conform to the relevant national standards. Article 9 The following provisions shall be observed in setting off fireworks and firecrackers outside areas and places where fireworks and firecrackers are prohibited:

(a) not to people, vehicles, buildings (structures), manhole projection, throwing lit fireworks;

(two) shall not hinder the safe passage of pedestrians and vehicles;

(three) fireworks shall not be set off in corridors, stairs and roofs of buildings;

(four) fireworks and firecrackers shall not be set off in other ways that endanger public safety and personal and property safety.

If a person without or with limited capacity for civil conduct sets off fireworks and firecrackers, he shall be accompanied by a guardian or other adults. Tenth in case of major celebrations and festivals, it is really necessary to hold a fireworks show and other large-scale fireworks display activities, the organizer shall, in accordance with the provisions of hierarchical management, apply to the public security organ according to law and obtain a fireworks display license.

If the public security organ makes a decision on permission, it shall announce the time, place, type, specification and quantity of the permission discharge to the public within three days after making the decision.

Fireworks evening and other large-scale fireworks display activities, the discharge operation units and workers shall carry out discharge operations in accordance with the fireworks safety regulations and the approved discharge operation plan. Eleventh heavy pollution weather warning period, the municipal, district (city) people's government shall, according to the warning level, timely start the emergency plan, according to the emergency needs, can take emergency measures to prohibit the discharge of fireworks and firecrackers in their respective administrative areas. Twelfth people's governments at all levels and their relevant departments, as well as radio, television, newspapers, internet and other media, should carry out publicity and education activities to comply with the provisions on the sale and discharge of fireworks and firecrackers. Thirteenth operators of hotels, hotels, property services, weddings, funeral services and other industries in areas and places where fireworks and firecrackers are prohibited shall inform customers that fireworks and firecrackers are prohibited and shall not provide fireworks and firecrackers services. Discourage the setting off of fireworks. If the dissuasion is ineffective, it shall immediately report to the public security organ.
