Regulations of Xuancheng Municipality on Property Management of Residential Quarters
Chapter I General Provisions Article 1 In order to standardize the property management activities in residential quarters, safeguard the legitimate rights and interests of owners, property users and property service enterprises, and create a good living environment, these Regulations are formulated in accordance with the Property Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council and other relevant laws and administrative regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the property management activities of residential quarters within the administrative area of this Municipality and their supervision and management. Article 3 Property management shall follow the principle of combining owner autonomy, professional services and legal supervision. Article 4 The people's governments of cities and counties (cities, districts) shall strengthen their leadership in property management within their respective administrative areas, establish and improve the coordination mechanism of property management, and coordinate and handle major issues in property management.

Encourage the property management work into the government target management performance appraisal. Article 5 The administrative department of property management of the Municipal People's Government shall be responsible for the supervision and management of property management activities in the whole city and perform the following duties:

(a) to formulate policies and measures related to property management;

(two) the establishment of property management credit information platform;

(three) the supervision and management of property special maintenance funds;

(four) to guide and supervise the administrative supervision of property management in counties (cities, districts);

(five) to guide and supervise the bidding activities of property management, guide and standardize the market behavior of property management, and handle major property management disputes and complaints;

(six) other duties as prescribed by laws and regulations. Sixth county (city, district) people's government property management administrative departments specifically responsible for the supervision and management of property management activities within their respective administrative areas, and perform the following duties:

(a) to guide the Township People's governments and sub-district offices to perform their duties of property management and supervision;

(two) to guide and supervise the bidding activities of property management;

(three) to be responsible for the signing of the preliminary realty service contract, temporary management agreement and realty service contract, to undertake the inspection, and to record the relevant materials of the owners' committee;

(four) to be responsible for the collection, accounting and disbursement of special property maintenance funds, and to guide and supervise the use of special property maintenance funds;

(five) to collect and verify the credit information of property service enterprises and project leaders, establish relevant property management files and accept inquiries;

(six) to organize the training of property management personnel and members of the owners' committee of the township people's government, street offices and neighborhood (village) committees;

(seven) other duties as prescribed by laws and regulations. Seventh city and county (city, district) people's government construction, public security, justice, civil affairs, emergency management, environmental protection, planning, urban management, civil air defense, price, market supervision, economic information and other administrative departments in accordance with their respective responsibilities, do a good job in the relevant administrative law enforcement and supervision and management.

(a) the construction administrative department is responsible for coordinating the project quality deposit; Supervise the construction unit to fulfill the quality warranty responsibility of the construction project; Responsible for accepting and handling complaints about housing quality problems;

(two) the public security organs shall be responsible for investigating and dealing with illegal acts affecting public safety and public order in residential areas according to law, supervising and inspecting the discharge of fireworks and firecrackers, public security monitoring and parking vehicles, and doing a good job in the supervision and management of house leasing;

(three) the judicial administrative department is responsible for guiding the people to mediate property management disputes;

(four) the administrative department of civil affairs is responsible for urging the neighborhood (village) committees to guide and supervise the owners' congress and the owners' committee to carry out autonomous management activities;

(five) the administrative department in charge of emergency management is responsible for the supervision and management of fire safety in residential areas;

(six) the competent administrative department of environmental protection shall be responsible for the supervision and management of the property management area and the surrounding pollution sources according to law; Investigate and deal with violations of environmental laws and regulations according to law;

(seven) the planning administrative department is responsible for the verification of the property service housing planning and the identification of illegal construction;

(8) The administrative department in charge of urban management is responsible for investigating and dealing with illegal acts such as changing the load-bearing structure of houses without authorization, illegally erecting buildings and structures, setting up stalls in disorder, occupying and damaging green spaces, cutting down, moving and pruning trees without authorization, burning leaves and garbage, etc.

(nine) the competent administrative department for civil air defense is responsible for the supervision and inspection of illegal acts of civil air defense engineering facilities;

(ten) the price administrative department is responsible for the supervision and management of property service charges;

(eleven) the market supervision and management department is responsible for the safety supervision and inspection of elevators and other special equipment;

(twelve) the administrative department of economic information is responsible for coordinating the communication operation and the protection of power facilities. Eighth Township People's governments and sub-district offices shall be responsible for the guidance, coordination and supervision of property management activities within their respective jurisdictions in accordance with the prescribed duties, and perform the following duties:

(a) responsible for property management within the jurisdiction, improve the working mechanism of property management;

(two) to guide the establishment of the owners' congress and the election of the owners' committee, and to guide and supervise the owners' congress and the owners' committee to perform their duties;

(three) mediation of property management disputes;

(four) to guide and supervise the transfer of property services within the jurisdiction;

(five) other duties as prescribed by laws and regulations.

Neighborhood (village) committees shall assist township people's governments and sub-district offices in carrying out relevant work.
