Legal Basis: Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Laws in the Trial of Consumer Civil Public Interest Litigation Cases Article 2 The provisions of Article 47 of the Consumer Protection Law shall apply to the goods or services provided by business operators under any of the following circumstances:
(a) the goods or services provided are defective and infringe upon the legitimate rights and interests of many unspecified consumers;
(two) the goods or services provided may endanger the personal and property safety of consumers, without making a true explanation and clear warning, and without indicating the correct use of goods or services and the methods to prevent the occurrence of harm; Making false or misleading propaganda about the quality, performance, use and expiration date of the goods or services provided;
(three) hotels, shopping malls, restaurants, banks, airports, stations, ports, theaters, scenic spots, entertainment places and other business places that endanger the personal and property safety of consumers;
(4) Making unfair and unreasonable provisions to consumers, such as excluding or restricting consumers' rights, reducing or exempting operators' responsibilities, and aggravating consumers' responsibilities, by means of standard clauses, notices, statements, shop notices, etc. ; (five) other acts that infringe upon the legitimate rights and interests of many unspecified consumers or endanger the personal and property safety of consumers and harm the public interests.
