The court held through trial that during the insurance period, Wang died in a traffic accident while driving an electric tricycle. Although the public security organ recognized Wang as an electric tricycle in driving without a license, and the insurance contract also stipulated that "if the insured drives a motor vehicle without a valid driver's license, the insurance company will not be liable for paying the insurance money if the insured dies", the public security organ included the electric tricycle in the category of accident handling motor vehicles. Only in the field of administrative management, electric tricycles with traffic accidents are identified according to administrative rules. At present, there are no relevant explicit provisions in China's laws, regulations and departmental regulations on whether electric tricycles belong to motor vehicles, whether drivers should hold motor vehicle driving licenses when driving electric tricycles, and whether electric vehicles need to apply for vehicle driving licenses. In practice, it is impossible for an electric tricycle to register, obtain a driver's license and apply for compulsory insurance like a motor vehicle. Moreover, in the insurance contract concluded between Wang and the insurance company, it is not clearly stipulated that the electric tricycle belongs to a motor vehicle. If the insured has an accident driving an unlicensed electric tricycle, the insurer will be exempted from liability for compensation. To sum up, the insurance company's statement that "the insurance company should not be liable for the accident of Wang's electric tricycle in driving without a license" was rejected by our hospital, and an insurance company in Jurong should compensate 80,000 yuan for Wang's death according to the insurance contract.
