Article 1 In order to ensure public safety, personal and property safety and prevent noise and air pollution, these Provisions are formulated in accordance with the Regulations of the State Council Municipality on the Safety Management of Fireworks and Firecrackers and other relevant laws and regulations, combined with the actual situation of this Municipality.

Article 2 It is forbidden to set off fireworks and firecrackers in urban areas.

Article 3 The municipal public security organ shall be responsible for investigating and handling illegal fireworks and firecrackers and illegal road transport; City emergency management department is responsible for investigating illegal production and operation of fireworks and firecrackers.

The offices in cities and towns shall incorporate the work of prohibiting the discharge of fireworks and firecrackers into grid management, carry out publicity activities to prohibit the discharge of fireworks and firecrackers, and educate, guide and urge units and individuals to abide by these provisions.

Fourth road transport of fireworks and firecrackers, should obtain the permission of the public security organs in accordance with the law, and abide by the provisions of relevant laws and regulations.

Article 5 Where fireworks and firecrackers need to be set off for major festivals held according to law or approved, the organizer shall apply to the public security organ with the right of approval, obtain a fireworks and firecrackers discharge permit, make an announcement to the public, and implement fireworks and firecrackers discharge operation in accordance with the fireworks and firecrackers discharge safety regulations and the approved fireworks and firecrackers discharge operation plan.

Article 6 It is forbidden to carry fireworks and firecrackers on public transport.

It is forbidden to mail fireworks and firecrackers, and it is forbidden to carry fireworks and firecrackers in checked baggage, parcels and mails.

Article 7 The municipal public security, emergency and other relevant departments shall, in accordance with these Provisions, formulate relevant systems and implementation plans for prohibiting the discharge of fireworks and firecrackers, establish and improve the responsibility system for investigating and handling illegal production, transportation, management, storage and discharge of fireworks and firecrackers, improve the handling system for accepting and investigating reports, and strictly implement assessment and accountability.

Eighth financial media center platforms, new media, all kinds of schools should do a good job in the publicity and education of fireworks.

Ninth hotels, restaurants and wedding service operators shall inform consumers that it is forbidden to set off fireworks and firecrackers when undertaking festive activities.

Tenth organs, organizations, enterprises and institutions, village (neighborhood) committees, property service enterprises and grid workers should do a good job in prohibiting the discharge of fireworks and firecrackers in their own units and regions.

The town offices, industrial clusters and relevant departments of this Municipality shall establish and implement the responsibility system and assessment accountability mechanism for the units and grid members listed in the preceding paragraph to perform the duties of prohibiting the discharge of fireworks and firecrackers.

Eleventh guardians of minors should educate minors about the prohibition of fireworks and firecrackers, and stop minors from setting off fireworks and firecrackers in areas where fireworks and firecrackers are prohibited.

Minors who set off fireworks and firecrackers shall be ordered by the public security organs to strictly discipline their guardians; If personal or property damage is caused to the state, the collective or others, the guardian shall be liable for compensation according to law.

Twelfth acts in violation of these provisions, any unit or individual has the right to discourage and report.

Those who take revenge on informants shall be investigated and dealt with by public security organs according to law.

Thirteenth in violation of the provisions of article sixth, according to the provisions of article forty-first of the State Council "fireworks safety management regulations", the public security organs shall be punished accordingly.

Fourteenth fireworks in violation of the provisions, or in a way that endangers public safety and personal and property safety, shall be punished in accordance with the provisions of Article 42 of the Regulations on the Safety Management of Fireworks and Firecrackers in the State Council.

Fifteenth in violation of the provisions of these measures, one of the following acts, according to the State Council "fireworks safety management regulations" provisions of article thirty-sixth:

Sixteenth large-scale fireworks display activities such as fireworks evening without approval shall be punished according to the provisions of Article 42 of the Regulations on the Safety Management of Fireworks and Firecrackers in the State Council.

Seventeenth administrative organs and institutions at all levels in violation of the provisions of fireworks, shall be investigated for responsibility according to relevant laws and regulations.

Article 18 If the staff of public security, emergency management, market supervision, ecological environment and other departments fail to perform their duties, abuse their powers, neglect their duties or engage in malpractices for selfish ends in the safety supervision of fireworks and firecrackers, they shall be given administrative sanctions by their units or supervisory organs according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law; Those who infringe upon the lawful rights and interests of citizens, legal persons and other organizations shall be liable for compensation according to law.

Article 19 These Provisions shall come into force on August 1 day, 2020.
