The term "urban inland river" as mentioned in these Provisions refers to inland rivers (including lakes, Shipu Port, Jiujiu Bay Branch Canal, Wudian Branch Canal, Xikeng Branch Canal, gutang Creek, Tiantang Port, etc. ) within the built-up areas of xiangcheng district and longwen district. Article 3 The directory system shall be implemented in the management of urban inland rivers, which shall be compiled and adjusted by the administrative department of urban inland rivers, and announced after being approved by the Municipal People's Government.
The list of urban inland rivers shall include the names, starting and ending points and management matters of urban inland rivers. Article 4 Urban inland river management shall maintain the natural form and historical features of urban inland rivers, follow the principles of overall planning, overall consideration, comprehensive management and rational utilization, and obey the overall requirements of urban drainage and flood control. Article 5 The Municipal People's Government shall strengthen its leadership over the management of urban inland rivers, and incorporate the funds needed for the construction, maintenance, management and operation of urban inland rivers into the annual financial budget. Article 6 The municipal competent department of housing and urban and rural construction is the competent department of urban inland river administration. The main responsibilities are:
(a) to organize the preparation of urban inland river special planning;
(two) the division of urban inland river management responsibility section, clear management requirements;
(3) Organizing the implementation of comprehensive improvement of urban inland rivers;
(four) the establishment of urban inland river management information system;
(five) other duties as prescribed by laws and regulations. Seventh municipal water conservancy department is responsible for the construction, maintenance and management of urban inland river flood control and drainage and water conservancy facilities.
The municipal competent department of ecological environment is responsible for the supervision and management of urban river ecological environment.
Municipal natural resources, urban management, transportation and other competent departments shall, according to their respective responsibilities, do a good job in the management and protection of urban inland rivers. Article 8 The people's governments of xiangcheng district and longwen district, and the sub-district offices and township people's governments under their jurisdiction are responsible units for the management of urban inland rivers, and shall, in accordance with their prescribed duties, strengthen daily inspections, stop illegal acts, and do a good job in the management and protection, dredging and cleaning of urban inland rivers.
Villagers' committees and residents' committees may formulate village rules and regulations or residents' conventions according to law, guide villagers and residents to consciously maintain the cleanliness of urban inland rivers, and assist in the management and protection, dredging and cleaning of urban inland rivers. Ninth urban inland river management to implement the river (lake) long system, the implementation of urban inland river management and protection of the local main responsibility, establish and improve the long-term mechanism of comprehensive management of departmental linkage. Tenth urban river administrative departments should strengthen the publicity and education of urban river protection and enhance the public's awareness of maintaining the ecological environment of urban rivers.
Any unit or individual has the right to dissuade and report acts of destroying urban inland rivers. Eleventh urban inland river administrative departments shall, in conjunction with the municipal natural resources, water conservancy, ecological environment and other competent departments and urban inland river management responsibility units, prepare special urban inland river planning according to law, and report it to the Municipal People's government for approval before implementation.
The special planning of urban inland rivers shall conform to the overall urban planning and land use planning, and meet the basic functional requirements of drainage and flood control, water storage and water transfer, ecological protection and historical inheritance. Twelfth municipal and district people's governments should strengthen the protection of urban inland rivers with important historical and cultural value, clarify the scope and requirements of protection, and establish relevant files. Thirteenth state-owned construction land transfer plots involving the scope of urban inland river management, the municipal natural resources department shall incorporate the relevant requirements of urban inland river special planning into the regulatory detailed planning. Article 14 Tourism landscapes, water activities and leisure and entertainment projects developed and utilized within the scope of urban inland river management shall conform to the special planning of urban inland rivers, and shall not affect the safety of drainage and waterlogging prevention and pollute water bodies, and be in harmony with natural and human landscapes. Article 15 Comprehensive improvement projects such as dredging and widening, pollution source control, bridge and road construction within the scope of urban inland river management shall conform to the relevant provisions, technical specifications and standards of urban inland river special planning, drainage and waterlogging prevention, and ecological environment. The construction unit shall go through the examination and approval procedures in accordance with the basic construction procedures, and file with the administrative department of urban inland river and the responsible unit of urban inland river management. Article 16 Within the scope of urban inland river management, it is forbidden to build, rebuild or expand buildings, structures and other facilities that hinder flood discharge, and it is forbidden to pile up materials that hinder flood discharge.
Due to special needs such as construction, temporary construction and stacking within the scope of urban inland river management may hinder flood discharge. The construction unit shall apply to the municipal water conservancy department for examination and approval according to law, and report to the administrative department of urban inland river and the responsible unit of urban inland river management for the record after approval. Temporary construction and stacking period shall not exceed two years; Upon the expiration of the approved temporary construction and stacking period, the construction unit shall restore the original state.
