What procedures and materials are needed for marriage registration?
The marriage registration procedure is mainly composed of application, examination and registration.
(1) application
Those who meet the requirements for applying for marriage registration, with their own registration photos, relevant certificates and supporting materials, apply for marriage registration at the marriage registration office where one party's permanent residence is located, and fill in the application registration statement according to the guidance of the staff.
The preparation materials for marriage registration application depend on the specific circumstances. For example, China citizens who apply for marriage registration in China (except Hong Kong, Macao and Taiwan) must hold their valid ID card, household registration book, marriage inspection certificate, unmarried single certificate and signed statement that they are not related to each other. If you apply for divorce and remarriage, you must also hold a divorce certificate or divorce proof materials.
Foreigners applying for marriage in China (including China people, foreigners who come to China permanently or temporarily, and foreigners who have settled in China) must hold their valid passports, foreigners' residence permits issued by public security organs, and documents that can effectively prove their marital status.
(2) Review
The marriage registration office will examine the application of the parties to determine whether the marriage application submitted by them meets the requirements. If the application materials submitted by the parties are unknown, the marriage registration authority shall ask the parties and may require them to provide relevant materials when necessary.
(3) Registration and licensing
Those who meet the conditions for marriage shall be registered by the marriage registration authority and then issued a marriage certificate; For divorced people who want to remarry, the marriage registration office will generally cancel the divorce certificate; If necessary, a written statement shall be issued to those who do not meet the conditions for marriage registration, explaining the reasons for not being registered.
What procedures and documents do you need for divorce?
The process of divorce registration is roughly as follows:
(1) application
If the husband and wife voluntarily divorce in the Mainland, they shall conclude a written divorce agreement and jointly apply to the marriage registration authority with jurisdiction, and provide the following documents and supporting materials:
1. Marriage certificate issued by the Mainland Marriage Registry or Chinese embassies and consulates abroad;
2. Relevant valid identity documents that meet the requirements, such as household registration book, identity card, pass or passport;
3. An application for divorce registration filled in at the marriage registration office.
(2) Accept
The staff will conduct a preliminary examination of the materials submitted by the parties in accordance with the relevant provisions of the Marriage Registration Code. After the application materials submitted by the parties are verified by the staff in the first instance, the parties will receive a "Receipt of Acceptance of Divorce Registration Application". If there are differences with the application conditions for divorce registration, it will not be accepted, and the registrar may issue a notice of not accepting the application for divorce registration.
(3) cooling-off period
Within 30 days from the date when the marriage registration office receives the application for divorce registration and delivers the receipt of the application for divorce registration to the parties concerned, any party who does not want to divorce can bring his valid identity certificate and the receipt of the application for divorce registration (if the receipt cannot be found, he can explain the situation in writing), withdraw the application for divorce registration at the marriage registration office that accepted the application for divorce registration, and fill out the Application for Withdrawal of Divorce Registration in person. After verifying the information, the marriage registration authority shall issue the Confirmation of Divorce Registration to the parties concerned, and the application for divorce registration, the application for divorce registration and the Confirmation of Divorce Registration (stub) shall be filed together. Within 30 days after the expiration of the cooling-off period for divorce, if both husband and wife requesting divorce fail to apply to the marriage registration authority for a divorce certificate, it shall be deemed that both parties are unwilling to divorce and withdraw their application for divorce registration.
(4) Review
Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the cooling-off period is a holiday, the first day after the holiday will be the expiration date), both parties shall apply to the marriage registration authority for divorce certificate with divorce agreement, marriage certificate, two recent two-inch bareheaded photos of both parties, passport, pass, ID card and other relevant documents and materials stipulated in the Marriage Registration Standard. The marriage registration authority shall conduct an examination according to the provisions of the Marriage Registration Code. If one party does not meet the requirements for divorce registration, the divorce registration shall not be granted. If a party requests to issue a notice of disapproval of divorce registration, it shall issue it.
(5) Registration and certification
The marriage registration authority shall, in accordance with the provisions of the marriage registration work norms, carry out relevant registration and issue divorce certificates to the parties.
