What procedures and materials are needed for marriage registration?
The marriage registration process is roughly as follows:
(1) application
Those who meet the conditions for marriage registration shall apply for marriage registration at the marriage registration office where one party is located with relevant documents, certificates and 3 registration photos, and fill in the Declaration on Application for Marriage Registration and other documents.
The certification materials needed to apply for marriage registration depend on individual circumstances. For example, a citizen of China who applies for marriage in China must hold his/her valid pre-marital examination certificate, ID card, household register, single certificate without spouse and a signed statement that he/she is not related to the other party. Divorce application for remarriage, should also carry a divorce certificate.
Foreigners (including foreigners residing or temporarily residing in China, China people and foreigners residing in China) applying for marriage in the mainland of China need to hold their valid passports or nationality certificates, foreigners' residence permits issued by public security organs, official proof of marital status and other materials.
(2) Review
The marriage registration authority shall verify and examine the parties applying for marriage registration to find out whether the application for marriage is correct. If the application materials submitted are not clear, the marriage registration authority will ask the parties concerned and ask them to provide materials related to the application for marriage registration when necessary.
(3) Registration and licensing
Those who meet the conditions for marriage shall be registered by the marriage registration authority and then issued a marriage certificate; For those who have experienced divorce, the marriage registration office will cancel their divorce certificates; If necessary, a written statement shall be issued to those who do not meet the conditions for marriage registration, explaining the reasons for not being registered.
What procedures and documents do you need for divorce?
The divorce registration process is as follows:
(1) application
The husband and wife who request divorce shall sign a divorce agreement in accordance with the provisions, jointly apply to the marriage registration authority with jurisdiction, and provide the following application materials in accordance with the provisions:
1, marriage certificate issued by mainland marriage registration authority or Chinese embassy (consulate) abroad;
2. Compliance and valid identity documents, such as my ID card, residence booklet, pass, passport or other valid international travel documents;
3. An application for divorce registration filled in on the spot.
(2) Accept
The staff will conduct a preliminary examination of the materials submitted by the parties in accordance with the relevant provisions of the Marriage Registration Code. After verifying the application materials submitted by the parties, the staff will send a receipt to the parties about accepting the divorce registration application. Those who do not meet the application conditions will not be accepted, and the registrar may issue a notice that the divorce registration application will not be accepted.
(3) cooling-off period
Within 30 days from the date when the marriage registration office receives the application and issues the Receipt for Accepting the Application for Divorce Registration to the parties concerned, if either party disagrees with the divorce, it can go to the marriage registration office for accepting the application for divorce registration with its identity certificate and the Receipt for Accepting the Application for Divorce Registration (if it is lost, a written explanation is required), withdraw the application for divorce registration, and fill out the Application for Withdrawal of Divorce Registration in person. After verification, the marriage registration authority shall issue the Confirmation of Withdrawal of Divorce Registration to the parties concerned, and the application for divorce registration, the application for withdrawal of divorce registration and the confirmation of withdrawal of divorce registration (stubs) shall be filed together. Within 30 days after the end of the cooling-off period of divorce, if both parties fail to jointly apply to the marriage registration authority for a divorce certificate, it shall be deemed that the application for divorce registration has been withdrawn.
(4) Review
Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday is the expiration date of the cooling-off period), divorced couples should bring valid certificates and materials, such as photos, marriage certificates, ID cards or passports, divorce agreements, etc. And apply to the marriage registration authority for a divorce certificate. The marriage registration authority shall conduct the examination in accordance with the procedures and conditions stipulated in the Code for Marriage Registration. The parties who do not meet the conditions for divorce registration will not be handled, and if necessary, a notice of divorce registration will be issued at the request of the parties.
(5) Registration and issuance of divorce certificates
The marriage registration authority shall register in accordance with the provisions and issue a divorce certificate.
