Can I get a refund if I pay a deposit for the wedding?
You paid a deposit and formed a service contract with the wedding company. Even though there may be no written contract, such a relationship has actually been formed. If the contract is terminated for personal reasons, the deposit is definitely non-refundable. According to the provisions of the Guarantee Law, when the deposit is used as the form of guarantee, if the party paying the deposit fails to perform the contract, the party receiving the deposit may confiscate the deposit, and if the party receiving the deposit violates the contract, it shall return the deposit twice. According to Article 1 16 of China's Contract Law: "If the parties agree on both liquidated damages and deposit, when one party breaches the contract, the other party may choose to apply the liquidated damages or deposit clause." Thus, when one party breaches the contract, the deposit penalty and liquidated damages cannot be applied at the same time.
