In order to thoroughly implement the Notice of the People's Government of Henan Province on Printing and Distributing the Three-year Action Plan for Pollution Prevention and Control in Henan Province (20 18-2020) (JUNG WOO [2018] No.30), curb the impact of fireworks and firecrackers on ambient air quality, and protect people's health, according to the Law of People's Republic of China (PRC) on Public Security Administration Punishment and the Safety Management of Fireworks and Firecrackers, The notice is as follows:
First, the scope of prohibition of sale and incineration.
The areas under the jurisdiction of Hongqi District, muye district, Weibin District, Fengquan District, High-tech Zone, Economic Development Zone, Xinxiang County and Sun Xing Village within the urban planning area of Weihui City.
Weihui City, huixian city City, Huojia County, Yuanyang County, Yanjin County, fengqiu county City, Changyuan City and Pingyuan Demonstration Zone determine the specific scope of prohibition of sales and burning within their respective jurisdictions.
Two, prohibit the sale and burning content
The sale and discharge of fireworks and firecrackers are completely prohibited in the no-sale zone and the no-burning zone.
Third, the requirement of prohibiting sales and burning.
(a) prohibit the sale and discharge of fireworks and firecrackers to take the form of "government organization, departmental linkage, grassroots implementation, social participation" in accordance with the law.
(two) county (city, district) government (CMC), township government (street office), village (neighborhood) committee, residential property management company, etc. Publicity, education, guidance and management of fireworks and firecrackers should be comprehensively strengthened. Ecological environment, emergency management, market supervision, public security, transportation, supply and marketing departments should strictly follow the division of responsibilities and fully implement the responsibility of prohibiting the sale and discharge of fireworks and firecrackers. Radio, television, newspapers, internet and other media, as well as various enterprises and schools should widely publicize and educate, guide the masses to change their customs, and consciously safeguard the urban environment.
(three) illegal production and operation of fireworks, shall be punished by the emergency management department according to law; Those who illegally transport fireworks and firecrackers by road shall be punished by the public security department according to law. Illegal production, operation and transportation of fireworks and firecrackers, which constitutes a violation of public security management, shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
In case of setting off fireworks and firecrackers in violation of regulations, the public security department shall, according to the relevant provisions of the Regulations on the Prevention and Control of Air Pollution in Henan Province, order it to stop setting off fireworks and impose a fine of 1 000 yuan on individuals and 1 000 yuan on units; If it constitutes a violation of public security administration, it shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
