District Civil Affairs Bureau: In order to further standardize the work of marriage registration, our bureau has formulated the Code of Marriage Registration in Beijing, which is hereby issued. Please follow it.
Chapter I General Provisions
Article 1 In order to strengthen the standardized management of marriage registration in this Municipality, safeguard the legitimate rights and interests of marriage parties, and promote the harmony of marriage and family, this Code is formulated in accordance with the Marriage Law of the People's Republic of China, the Regulations on Marriage Registration, the Measures for the Administration of Marriage Registration Files, Several Provisions on the Implementation of the Regulations on Marriage Registration in Beijing, the Regulations on Marriage Registration of the Ministry of Civil Affairs and relevant regulations, and in combination with the actual situation of this Municipality.
Article 2 The marriage registration authority of this Municipality shall conscientiously perform its duties and do a good job in marriage registration in accordance with laws, regulations, rules, documents of the Ministry of Civil Affairs and this Code.
Chapter II Marriage Registration Authority
Article 3 The marriage registration organ is an organ that performs the functions of marriage registration management according to law.
The marriage registration authority in this city is the District Civil Affairs Bureau.
Article 4 The marriage registration authority shall perform the following duties:
(a) for marriage registration;
(2) reissue the marriage registration certificate;
(3) The marriage is cancelled due to coercion;
(four) the establishment and management of marriage registration files;
(5) to publicize marriage laws and regulations and advocate civilized marriage customs.
Article 5 When performing their duties, the marriage registration authority shall be free of the cost of marriage registration certificate and shall not charge any other fees.
The marriage registration authority shall not engage in any business activities or seek other interests.
Article 6 The following marriage registration shall be handled by the Civil Affairs Bureau of each district of this Municipality:
(1) Marriage registration between mainland residents with permanent residence in this Municipality;
(two) the marriage registration of mainland residents with permanent residence in this Municipality with foreigners, Hong Kong residents, Macao residents, Taiwan Province residents and overseas Chinese;
(three) the marriage registration of active servicemen whose troops were stationed or whose permanent residence was in this city before joining the army;
(four) marriage registration between foreigners, Hong Kong residents, Macao residents, Taiwan Province residents and overseas Chinese who work or live in this city.
In violation of the above provisions, the marriage registration authority shall not handle the marriage registration.
Article 7 The District Civil Affairs Bureau shall set up a marriage registration office in accordance with the requirements of this Code.
The marriage registration office shall conform to the 4A-level marriage registration office standard in the Grade Standard of Marriage Registration Office.
The establishment, alteration or revocation of the marriage registration office of the District Civil Affairs Bureau shall form a document, which shall be announced to the public and reported to the Municipal Civil Affairs Bureau for the record.
The Civil Affairs Bureau adjusts the relevant authority of the marriage registration information system accordingly.
Article 8 The name of the marriage registration office established by the District Civil Affairs Bureau is: Marriage Registration Office of the Civil Affairs Bureau of XX District, Beijing.
If the District Civil Affairs Bureau establishes multiple marriage registration offices, it shall be numbered.
Ninth marriage registration office shall hang the marriage registration office sign in a prominent position outside the door.
The size of the signboard shall not be less than1500mm× 300mm or 550mm× 450mm.
Article 10 The marriage registration authority shall use the national marriage registration mark according to the requirements of the Ministry of Civil Affairs.
Eleventh District Civil Affairs Bureau shall engrave the special seal and steel seal for marriage registration.
The special seal and steel seal are circular with a diameter of 35mm.
Special seal and steel seal for marriage registration. The name of the District Civil Affairs Bureau to which the marriage registration office belongs ("Beijing XX District Civil Affairs Bureau") is published in the central journal "★" and the peripheral journal ".
"Special Seal for Marriage Registration" is published under "★".
If the District Civil Affairs Bureau establishes multiple marriage registration offices, it shall publish the numbers of the marriage registration offices under the special seal for marriage registration.
Twelfth marriage registration office should have an independent place.
The marriage registration place should be set in an area with convenient transportation and good surrounding environment, and equipped with a waiting hall, a marriage registration room, a file room, a permit hall and a marriage and family consultation room.
Public signs and bulletin boards shall be set up in the waiting hall;
Standard samples of all kinds of applications filled out by express delivery parties;
Set up publicity materials display tables and suggestion boxes, and provide service facilities such as drinking fountains, drinking cups and reading glasses.
The national emblem should be set up in the marriage registration room, and the marriage registrar and the parties face to face without any isolation barrier in the middle.
Archives should be equipped with filing cabinets that meet the needs of keeping marriage registration files, and equipped with moisture-proof, fire-proof, insect-proof, anti-theft and other equipment.
The accreditation hall shall be equipped with the national emblem and accreditation desk, reflecting the name of the marriage registration office and the date of accreditation, equipped with audio-visual and lighting equipment, and set up seats for relatives and friends to watch the ceremony;
You can choose double happiness, dragon and phoenix and other background decorations.
Marriage and family counseling room should be equipped with necessary service facilities and professional equipment.
Marriage registration places shall be equipped with dressing rooms, dressing rooms, toilets, barrier-free facilities and other necessary public service facilities.
Marriage registration places should create a harmonious marriage and family atmosphere, popularize legal knowledge, strengthen marriage and family responsibilities and publicize marriage culture.
Marriage registration places should be spacious, solemn, clean and tidy, maintain good order, and prohibit noise and smoking;
Without permission, photography, audio recording, video recording and other acts that infringe on the privacy of the parties are prohibited.
Marriage registration places shall not be located in wedding photography, wedding, medical and other institutions, and the above-mentioned service institutions shall not be located in marriage registration places.
Thirteenth marriage registration office shall be equipped with the following equipment:
(1) copier;
(2) fax machine;
(3) scanner;
(4) certificate and paper printer;
(5) computers;
(6) ID card reader.
Fourteenth marriage registration office should install equipment with audio and video recording function, and properly keep and use relevant materials.
Fifteenth marriage registration office shall be open to the public, and the following contents shall be publicly displayed in the marriage registration office:
(a) the jurisdiction and basis of the marriage registration office;
(two) the basic principles of the marriage law and the rights and obligations of husband and wife;
(3) Conditions and procedures for marriage registration and divorce registration;
(four) the conditions and procedures for changing the marriage registration certificate;
(5) Provisions on invalid marriage and revocable marriage;
(six) the provisions of the marriage registration certificate fee;
(seven) the duties of the marriage registrar and his photos and numbers;
(eight) the office hours and service telephone number of the marriage registration office;
The establishment of multiple marriage registration offices shall be announced at the same time;
Those who sign up for tourism shall announce the time and place of signing up for tourism;
(9) The telephone number of the supervisor.
Article 16 The marriage registration office shall have the Marriage Law of the People's Republic of China, the Regulations on Marriage Registration, the Measures for the Administration of Marriage Registration Files, Several Provisions on the Implementation of the Regulations on Marriage Registration in Beijing, the Regulations on Marriage Registration of the Ministry of Civil Affairs and other relevant documents for the parties to the marriage to consult for free.
Seventeenth marriage registration office shall be open from Monday to Friday, and provide appointment registration service on Saturday;
If the the State Council Municipal People's Government stipulates the date of holiday and rest, it shall be implemented in accordance with the provisions.
The office hours of the marriage registration office shall be announced outside the office.
The District Civil Affairs Bureau shall establish an overtime rest system to protect the legitimate rights and interests of marriage registrars.
Eighteenth marriage registration office shall conduct real-time online registration through the city's marriage registration information system.
The city has established a unified marriage registration information management system.
District Civil Affairs Bureau shall create conditions for the informatization construction of marriage registration management in this district and establish an informatization management system of marriage registration.
The marriage registration authority shall enter the preserved marriage registration files that have not been entered into the information system of this area into the supplementary record system of marriage registration historical data.
Nineteenth marriage registration authorities shall establish and manage marriage registration files in accordance with the provisions of the Measures for the Administration of Marriage Registration Files.
Twentieth marriage registration authority shall formulate the management system of marriage registration seals, certificates, paper files and electronic files, and improve the system of professional learning, post responsibility, assessment, rewards and punishments.
Twenty-first civil affairs bureau to provide unified marriage registration online booking function and Internet pages for the city's marriage registration authority.
Conditional marriage registration offices can open online booking functions and Internet pages for marriage registration.
Twenty-second marriage registration office should set up an appointment service window to provide priority services for the parties who make an appointment.
Twenty-third marriage registration office shall, at the same time of marriage registration, carry out extended services such as marriage registration and certification, marriage and family consultation through government purchase of services or public recruitment of volunteers.
Chapter III Marriage Registrar
Article 24 The marriage registration authority shall be equipped with full-time marriage registrars.
Twenty-fifth marriage registrar by the District Civil Affairs Bureau assessment, appointment.
The marriage registrar shall be trained by the Civil Affairs Bureau, and only after passing the examination can he engage in marriage registration.
Other personnel shall not engage in the work specified in Article 26 of this Code.
The marriage registrar training examination certificate shall be uniformly printed by the Civil Affairs Bureau.
The marriage registrar shall participate in the business training organized by the Civil Affairs Bureau at least once every 2 years, and obtain the certificate of training and examination for the marriage registrar.
The marriage registration office shall report to the Civil Affairs Bureau the information on the appointment or departure of the marriage registrar in a timely manner, and the Civil Affairs Bureau shall timely adjust the relevant authority for the use of the marriage registration information system according to the reported information.
Article 26 The main duties of a marriage registrar are:
(a) To be responsible for the statement of marital status of the sworn parties;
(two) to examine whether the parties have the conditions for marriage, divorce, replacement of marriage registration certificate and cancellation of forced marriage;
(3) Handling marriage registration procedures and issuing marriage registration certificates;
(four) the establishment of marriage registration files.
Article 27 The signature of the marriage registrar on the marriage registration certificate and marriage registration materials shall be written by himself with black ink pen or signature pen, and shall not be printed by computer or stamped with personal seal, and shall not be blank.
The signature of the marriage registrar should be legible.
Twenty-eighth marriage registrars should be proficient in relevant laws and regulations, skilled in using the marriage registration information system, administration according to law, and civilized service.
The marriage registrar shall have a college degree or above.
The marriage registrar shall wear standard clothes and signs in accordance with the unified requirements of the Civil Affairs Bureau.
Chapter IV Marriage Registration
Twenty-ninth marriage registration shall be handled in accordance with the procedures of preliminary examination, acceptance, examination and registration (certification).
Thirtieth conditions for accepting an application for marriage registration are:
The marriage registry has jurisdiction;
(2) If both men and women want to get married, they shall jointly apply to the marriage registration authority;
(3) The party concerned has reached the age of 22 for males and 20 for females;
(4) Both parties have no spouse (unmarried, divorced or widowed);
(five) the parties have no lineal blood relatives and collateral blood relatives within three generations;
(6) Both parties have no diseases that are medically considered unsuitable for marriage;
(7) Both parties get married voluntarily;
(eight) the parties to submit three 2 inch recent bust bareheaded photos;
(nine) the parties hold valid certificates and materials as stipulated in Article 32 to Article 39 of this specification.
Article 31 A deaf-mute party applying for marriage registration shall be translated by a professional sign language interpreter.
If a person with limited capacity for civil conduct who can clearly express his will to marry and fulfill the registration procedures applies for marriage registration, the guardian shall agree and witness.
Thirty-second mainland residents shall submit their valid household registration books and identity cards when registering their marriages.
The name, gender, date of birth and citizenship number on the household registration book and the resident identity card shall be consistent (if the citizenship number on the household registration book before promotion is 15, it shall be regarded as consistent);
Inconsistency (if the household registration book has no citizenship number, it will be regarded as inconsistency), the parties concerned shall first go to the household registration authority to correct the household registration book or reissue a new identity card.
If the household registration book of a family account is inserted, the parties concerned shall submit the home page of the household registration book and its permanent resident registration card.
If the party concerned is a collective household registration, it is not necessary to submit a copy of the first page of the collective household registration book if the permanent population registration card (form) is submitted.
If the permanent residence has not been settled again after moving out, the parties concerned shall go through the settlement formalities at the household registration authority first and get the household registration book.
The household registration book shall be stamped with the special seal for household registration, and the date of registration shall be indicated.
If the residence booklet is unrecognizable or torn due to alteration, defacement, incompleteness and other reasons, the parties concerned shall first apply to the household registration authority for a new residence booklet.
If the marital status of the parties is unmarried, the marital status in the household registration book should be blank or "unmarried";
Other contents, if inconsistent with the statement, should be corrected at the household registration authority first.
If the marital status of the party concerned is divorced, it shall submit to the marriage registration authority a divorce certificate that can prove the authenticity of its statement, a copy of the divorce registration file stamped with the special seal for file inquiry, an effective divorce judgment of the people's court (the judgment of first instance also provides valid proof) or a conciliation statement and other materials.
If the marital status of a party is widowed, it shall submit a marriage certificate (or a copy of the marriage registration file stamped with the special seal for file inquiry) and a spouse's death certificate to the marriage registration authority.
Death certificates include valid legal documents declaring death, medical certificates of residents' death (inference) issued by hospitals, public security and other relevant departments, and certificates of cancellation of household registration due to death.
If the marital status of the divorced or widowed party in the household registration is consistent with the statement, and the divorce and spouse death information that proves the authenticity of the statement can be found through the marriage registration information system, the party concerned may not submit the divorce and widowed materials.
If the marital status in the household register of the divorced or widowed party is inconsistent with the statement, and the date of change or registration is later than the date of divorce or widowhood, the parties concerned shall first go to the household registration authority to correct it.
If the resident ID card expires, is seriously damaged, is unrecognizable (excluding the chip information that the ID card reader can't read) or the photo and personal appearance characteristics have changed greatly, the parties concerned shall issue a new resident ID card or submit a valid temporary resident ID card.
Thirty-third active servicemen shall submit their valid identity cards (including those obtained before service and still valid), military officers' cards and military marriage registration certificates issued by the army in accordance with relevant regulations;
Before joining the army, if you register at the place where your permanent residence is located, you should also submit a certificate of cancellation of your residence booklet or household registration.
The name, gender, date of birth and citizenship number on the resident identity card, military officer's card and military marriage registration certificate shall be consistent;
If there is any inconsistency, the parties concerned should first go to the relevant departments to correct it.
Article 34 Hong Kong residents applying for marriage registration shall submit:
(a) Hong Kong and Macao residents to and from the mainland pass or Hong Kong and Macao compatriots home visit permit;
(2) Hong Kong identity card;
(3) A statement notarized by a notary agency entrusted by Hong Kong that I have no spouse and no direct blood relationship with the other party and collateral blood relationship within three generations.
Article 35 Macao residents shall submit:
(a) Hong Kong and Macao residents to and from the mainland pass or Hong Kong and Macao compatriots home visit permit;
(2) Macao resident identity card;
(3) A statement notarized by the Macao notary office that I have no spouse, no direct blood relationship with the other party and collateral blood relationship within three generations.
Thirty-sixth Taiwan Province residents to apply for marriage registration shall submit:
Mainland travel permit for taiwan residents or other valid travel documents;
(2) A valid identity document of my residence in Taiwan Province Province;
(3) A statement that I have no spouse, no direct blood relationship with the other party and collateral blood relationship within three generations notarized by a notary office in Taiwan Province Province.
Residents of Taiwan Province Province entrust a third person to handle notarization in the Notary Office of Taiwan Province Province.
The statement in item (3) is acceptable to the marriage registration authority.
Article 37 An overseas Chinese applying for marriage registration shall submit:
(1) My valid passport or valid travel document;
(2) A certificate issued by the notary office or competent authority of the host country and certified by the Chinese people's * * and China's embassy (consulate) in that country that I have no spouse and no lineal blood relatives and collateral blood relatives within three generations, or a certificate issued by the Chinese people's * * and China's embassy (consulate) in that country that I have no spouse and collateral blood relatives within three generations.
Relevant certificates issued by countries that have not established diplomatic relations with China shall be certified by the embassies (consulates) of third countries that have established diplomatic relations with that country and China and the embassies (consulates) of China in third countries, or by the embassies (consulates) of third countries in China.
Article 38 Foreigners shall submit:
(a) my valid passport or other valid international travel documents;
(2) I don't have a spouse certificate issued by a notary office or competent authority in my country and certified by the embassies (consulates) of People's Republic of China (PRC) and China or the embassy (consulate) of China in that country, or I don't have a spouse certificate issued by the embassy (consulate) of China in that country.
The certificate of no spouse issued by a foreigner entrusted by a third party, which is certified by the people of China and the embassy (consulate) of China or the embassy (consulate) of China in that country, shall be accepted by the marriage registration authority.
Relevant certificates issued by countries that have not established diplomatic relations with China shall be certified by the embassies (consulates) of third countries that have established diplomatic relations with that country and China and the embassies (consulates) of China in third countries, or by the embassies (consulates) of third countries in China.
Article 39 For marriage registration between foreigners, Hong Kong residents, Macao residents, Taiwan Province residents and overseas Chinese, in addition to the corresponding documents and materials in accordance with the provisions of Articles 34 to 38 of this Law, one party shall also submit the certificate of working or living in this Municipality;
If both parties are foreigners, they shall also submit a certificate that they acknowledge that their residents' marriage registration abroad is valid.
The proof of working or living in this city refers to the valid residence permit, foreigner's permanent residence permit, foreign expert certificate and other proof of employment, study or living in this city.
The proof that the state recognizes the validity of the marriage registration of its residents abroad refers to the proof that the state explicitly agrees to the marriage registration among its residents or with the residents of a third country in China;
If there is no spouse certificate indicating the identity information of both parties, it is deemed that the state recognizes the validity of the marriage registration of its residents in China.
Article 40 If the certificate submitted by foreigners and overseas Chinese does not specify that the parties have no spouse, it cannot be used as a separate certificate of no spouse.
The above certificate shall be accompanied by the following materials as proof of no spouse:
(a) if the parties hold the certificate of "Marriage Accessibility" and "Marriage Legal Capacity", submit the certificate issued by the above-mentioned state-owned authority, that is, the parties have no spouse;
(2) If the parties hold "No Marriage Search Record" and "Marriage Search Record" (the parties submit divorce documents such as divorce judgment at the same time), and the marital status column is blank or no marital status column, they shall submit the statement of no spouse certified by People's Republic of China (PRC) and Chinese embassies (consulates) in that country or issued or certified by Chinese embassies (consulates) in that country.
The relevant countries have made it clear that the certificates issued by the state, such as "marriage barrier-free", "legal capacity for marriage" and "no record of seeking marriage", mean that the parties have no spouse, and those confirmed by the documents of the Ministry of Civil Affairs can be used as proof of no spouse.
Article 41 When handling the marriage registration of Hong Kong residents or Taiwan Province residents, the marriage registrar shall check whether the statements submitted by the parties that they have no spouse, no lineal blood relationship with each other and collateral blood relationship within three generations are consistent with the copies received.
Article 42 The legal entry status of a party who holds identity documents of more than two countries (regions) shall be regarded as that of the party.
Article 43 When accepting an application for marriage registration, a marriage registrar shall follow the following procedures:
(1) Asking the parties about their marriage wishes;
If necessary, the inquiry can be conducted separately, and the inquiry can be recorded, and the recorded parties will read it and sign it according to their fingerprints and date of writing;
(2) Examining the corresponding certificates and materials specified in Articles 32 to 39 of this Law;
(3) Both parties who are willing to get married should fill in a Declaration of Application for Marriage Registration;
The signature of the column "Declarer" in the declaration of applying for marriage registration must be filled in by the declarer in front of the witness and pressed by the handprint;
(4) The parties repeat the contents of the Declaration on Application for Marriage Registration on the spot, with the marriage registrar as a witness and signing in the column of "Witness".
Forty-fourth "application for marriage registration statement" items to fill in, in accordance with the following provisions:
(1) "Name of the applicant": if the party concerned is a citizen of China, it shall be filled in Chinese;
If the person concerned is a foreigner, fill in the name on the passport or international travel document;
(2) "Gender": fill in according to the gender on the identity document;
(3) "Nationality": If the parties are mainland residents, Hong Kong residents, Macao residents, Taiwan Province residents and overseas Chinese, fill in "China";
If the party concerned is a foreigner, it shall be filled in according to the nationality on the passport or international travel document;
Stateless person, fill in "Stateless";
(4) "Date of birth": fill in according to the date of birth on the identity document;
(5) "Nationality": If the party concerned is a mainland resident, it shall be filled in according to the household registration book;
If the parties are Hong Kong residents, Macao residents, Taiwan Province residents and overseas Chinese, fill in according to the actual situation;
If the parties are foreigners, do not fill in;
(six) "occupation": fill in according to the actual situation;
(7) "Education level": fill in according to the actual situation;
(8) "ID number": If the party concerned is a mainland resident, fill in the citizenship number, in which the servicemen should fill in the citizenship number and the military ID number;
If the party concerned is a resident of Hong Kong, Macao or Taiwan Province Province, fill in the ID number of the resident of Hong Kong, Macao and Taiwan Province Province, and add "(Hong Kong)", "(Macao)" or "(Taiwan Province Province)" after the number.
If the party concerned is an overseas Chinese, fill in the passport or travel document number;
If the person concerned is a foreigner, fill in the passport or international travel document number;
If there are characters before the certificate number, they should be filled in together;
(9) "Location of permanent residence": If the party concerned is a mainland resident, it shall be filled in according to the household registration book; If there is no address on the permanent population registration card (form), fill in the name of the police station and its local administrative region, in which the active servicemen fill in the name of the political organ that issued the Military Marriage Registration Certificate and its local administrative region (if the active servicemen registered their permanent residence before enlisting, fill in the address of their permanent residence before enlisting);
If the parties are Hong Kong residents, Macao residents, Taiwan Province residents, overseas Chinese and foreigners, fill in according to the actual situation;
"Marital status": fill in "unmarried", "divorced" or "widowed" according to the actual situation;
(1 1) "Declarer": the relevant personnel personally sign and press their fingerprints;
(12) "declaration date": fill in according to the actual situation;
(13) "affidavit": the personal signature of the marriage registrar;
(14) "swearing date": fill in according to the actual situation.
Article 45 The marriage registrar shall examine and verify the documents, certificates, marriage registration application statements and other materials submitted by the parties concerned. If the marriage conditions are met, the marriage registration examination and handling form and marriage certificate shall be filled in.
Forty-sixth "marriage registration review processing form" to fill in:
(1) Fill in the Marriage Registration Examination and Processing Form by computer according to the following regulations: 1. "Applicant's name": if the party concerned is a citizen of China, fill it in Chinese;
If the person concerned is a foreigner, fill in the name on the passport or international travel document;
2. "Date of birth": fill in according to the date of birth on the identity document;
3. "ID number": If the party concerned is a mainland resident, fill in the citizenship number;
If the party concerned is a resident of Hong Kong, Macao or Taiwan Province Province, fill in the ID number of the resident of Hong Kong, Macao and Taiwan Province Province, and add "(Hong Kong)", "(Macao)" or "(Taiwan Province Province)" after the number.
If the party concerned is an overseas Chinese, fill in the passport or travel document number;
If the person concerned is a foreigner, fill in the passport or international travel document number;
If there are characters before the certificate number, they should be filled in together;
4. "Nationality": If the parties are mainland residents, Hong Kong residents, Macao residents, Taiwan Province residents and overseas Chinese, fill in "China";
If the party concerned is a foreigner, it shall be filled in according to the nationality on the passport or international travel document;
Stateless person, fill in "Stateless";
5. "Documents provided": The documents, certificates and statements provided by the parties shall be filled in item by item and shall not be omitted;
6. "Review opinion": fill in "meeting the conditions for marriage and allowing registration";
7. "Marriage registration date": the date filled in should be consistent with the registration date on the marriage certificate;
8 "Marriage Certificate Name": The filling style shall be implemented in accordance with the relevant provisions of the Ministry of Civil Affairs, and the filling rules are shown in the annex;
9. "Print number of marriage certificate": fill in the number printed on the marriage certificate issued to the parties;
10. "Name of the undertaking institution": fill in the name of the marriage registration office that undertakes the marriage registration.
(2) "Registrar's signature": signed by the marriage registrar who approved the marriage registration.
(3) "Remarks": If the serviceman goes through the marriage registration, fill in the serviceman's ID number.
(4) Paste the photos of both parties on the "photos" and affix the steel seal at the riding seam.
Article 47 Fill in the marriage certificate:
(1) The name, name, sex, date of birth, ID number, nationality and registration date of the marriage certificate shall be completely consistent with the corresponding items in the Marriage Registration Review Processing Form;
(2) "Marriage Registrar": signed by the marriage registrar who approved the marriage registration;
(three) in the "photo" column, paste the photos of both parties;
(4) Stamping a special seal for marriage registration on the photo and marriage certificate;
(5) "Registration Authority": affixed with the special seal for marriage registration (red seal).
Forty-eighth marriage registrars should carefully check and check after filling out the marriage certificate;
If the document is filled in incorrectly, contaminated or damaged, it should be scrapped and filled in again.
Article 49 Marriage certificates shall be issued in the presence of both parties according to the following steps:
(a) require both parties to check their names, dates of birth and marriage wishes;
(two) to inform the parties of the legal relationship and the rights and obligations of husband and wife after receiving the marriage certificate;
(3) Witness the personal signature of the parties in the column of "The parties get the certificate and sign by their fingerprints" on the Marriage Registration Review Processing Form, and write the date according to their fingerprints;
(4) issue marriage certificates to both parties respectively, announce to both parties that they have received marriage certificates, and establish the relationship between husband and wife;
(5) Congratulations to the newcomers.
Legal basis:
Article 1049 of the Civil Code of People's Republic of China (PRC) requires both men and women to apply for marriage registration in person at the marriage registration office. Those who meet the requirements of this law shall be registered and issued a marriage certificate. The marriage relationship is established when the marriage registration is completed. Those who have not registered for marriage shall re-register.
Article 28 The conditions for accepting an application for marriage registration are:
The marriage registry has jurisdiction;
(2) If both men and women want to get married, they shall jointly apply to the marriage registration authority;
(3) The party concerned has reached the age of 22 for males and 20 for females;
(4) Both parties have no spouse (unmarried, divorced or widowed);
(five) the parties have no lineal blood relatives and collateral blood relatives within three generations;
(6) Both parties get married voluntarily;
(7) The parties submit 3 recent 2-inch half-length bareheaded photos of both parties;
(eight) the parties hold valid certificates as stipulated in Articles 29 to 35 of these Standards.
