Generally, the crimes that can be sentenced to death include intentional homicide, rape, robbery, kidnapping, arson, explosion, and throwing dangerous substances. For criminals who should be sentenced to death, if they do not have to be executed immediately, they can be sentenced to death with a two-year suspension.
What are the ways to execute the death penalty?
1, intravenous injection: lethal drugs are continuously injected into the veins of death row inmates. The prisoner was lying on the execution chair with his ankles, legs, wrists, chest and head tied. The prisoner has a heart monitor attached to him. The executioner usually injects an anesthetic into the prisoner-making him unconscious, a muscle relaxant-to relax the prisoner's heart and lungs, and the highly toxic potassium chloride will stop his heart.
2. Electric chair: When electrocution is used, the prisoner is tied to a special chair, usually executed by three or more people. There is an electric button in front of them, but actually only one button is connected to the electrode. This arrangement is to reduce the psychological burden of the executioner, because no one knows who pressed the real button.
Gas chamber: The prisoner is locked in a secret room made of stainless steel. At the beginning of the execution, the executioner opened a valve and liquid hydrogen chloride flowed into a plate under the chair where the prisoner was sitting. Then, potassium cyanide or sodium cyanide is dropped into the plate, thereby generating cyanohydrogen gas.
4. Hanging: This is one of the oldest execution methods. Before the execution, the prisoner must be weighed, and then a heavy object is tied to the prisoner's leg according to his weight to ensure that the prisoner can be hanged immediately. The rope is put around the prisoner's neck, and then the support under the prisoner's feet is removed.
5. Shooting: There is no fixed mode of execution in western countries. In most cases, five executioners stood in a row in front of prisoners and fired at them. In order to ensure that the executioners were not retaliated, one of the executioners had no bullets in his gun. In this way, even if the Avengers know the names of the five executioners, it is difficult to tell who has no bullets in his gun.
When will the execution of the death penalty change?
The change of execution of death penalty includes two situations: suspension of execution of death penalty and suspension of execution of death penalty.
1, stop execution.
Article 2 1 1 of the Criminal Procedure Law and Articles 34 1 and 342 of the the Supreme People's Court Interpretation stipulate that the people's court at a lower level shall deliver the execution within 7 days after receiving the order to execute the death penalty. However, if any of the following circumstances is found, the execution shall be stopped and immediately reported to the people's court that approved the death penalty, and the people's court that approved the death penalty shall make a ruling:
(1) It is found that the referee may be wrong before execution;
(2) The criminal may need to change his sentence by exposing major criminal facts or making other major meritorious deeds before execution;
(3) The criminal is pregnant.
After the reasons for stopping the execution of the above two cases disappear, it must be reported to the president of the people's court that approved the death penalty for a ruling to execute the death penalty; If the execution is suspended due to the above-mentioned third reason, it shall be reported to the people's court that approved the death penalty to change the sentence according to law.
2. Moratorium on executions
The judge directing the execution should identify the criminal, ask him if he has any last words or suicide notes, and then hand them over to the executor for execution. Before execution, if it is found that there may be errors, the execution shall be suspended and reported to the people's court that approved the death penalty for a ruling.
Generally speaking, only people's courts above the intermediate level can sentence criminals to death. But after being sentenced to death, it needs to be reported to the Supreme People's Court for approval. Therefore, after being sentenced to death by the intermediate and higher people's courts, it is not necessarily that the death penalty will be executed in the end. As for the execution mode of death penalty in China, there are actually two cases: shooting and injection.
