1. Compensation for plastic surgery death includes compensation for medical expenses, lost time, hospital food subsidies and other expenses. Accidents that lead to the death of patients due to plastic surgery generally belong to medical accidents, and medical accidents need to pay the relevant expenses of patients according to law. Among them, the calculation basis of medical expenses is the medical expenses incurred in the treatment of personal injury caused by medical accidents.

2. Legal basis: Article 50 of the Regulations of People's Republic of China (PRC) Municipality on Handling Medical Accidents.

Medical malpractice compensation is calculated according to the following items and standards:

(1) Medical expenses: calculated according to the medical expenses incurred in treating personal injuries caused by medical accidents, and paid according to the evidence, but excluding the medical expenses of the primary disease. If it is really necessary to continue treatment after closing the case, it shall be paid according to the basic medical expenses.

(2) Hospitalization food allowance: calculated according to the standard of food allowance for ordinary staff of state organs where the medical accident occurred.

(3) Disability living allowance: according to the disability level and the average annual living expenses of residents in the place where the medical accident occurred, the maximum compensation is 30 years from the month of disability; However, those over 60 years old shall not exceed 15 years old; More than 70 years of age, not more than 5 years.

Second, what should I pay attention to before plastic surgery?

(1) Pay attention to the professional qualification certificate of doctors. Before receiving plastic surgery, we should not only pay attention to the signboard of the doctor's clinic, but also pay attention to whether the doctor has received complete plastic surgery training. Under normal circumstances, qualified doctors will take the initiative to produce relevant documents to prove their professional qualifications, but don't be fooled by some seemingly incredible leaders. If you don't see the relevant certificates in the clinic, you must ask the doctor's medical background carefully;

(2) Take photos before operation. Any cosmetic surgery should be partially photographed according to the requirements of medical photography. First, it should be kept as hospital data for postoperative comparison and scientific research. Second, it should be kept as legal materials and can be presented as evidence when medical disputes occur.

(3) Save every piece of medical information. Consumers must leave medical information, such as receipts, registration forms, written medical records, etc., when deciding on cosmetic surgery. This is also the basic proof that when a dispute occurs, the parties can appeal and safeguard their personal rights and interests. Medical records are also very important evidence. If consumers are worried that their medical records have been tampered with, they can file a lawsuit directly, and the court will retrieve the medical records.

(4) In the process of consumption, we should actively review the products and materials provided by beauty institutions and resolutely resist unqualified products;

(5) Sign the operation agreement. The contents include the operation mode, process, possible situations during operation, short-term postoperative reactions or possible complications, etc. And teenagers or major surgery still need the signature of their families. Surgical agreement is a written document formed by mutual understanding between the two sides, so that when medical disputes occur after operation, it can be used as the legal document basis for handling disputes. Signing the operation agreement not only shows the seriousness of the operation, but also provides legal protection for beauticians;

(6) Don't expect too much from the effect of "cosmetic surgery". Most cosmetic surgery can still improve people's image and enhance their self-confidence. However, the final result of surgery usually has an irregular gap with people's expected psychology, and it takes a process for surgery to be effective, not "immediate". In general, after a few weeks, patients will feel good about themselves = after a few months, their image will be significantly improved;

(7) Be psychologically prepared for possible sequelae and complications after operation. "Plastic surgery" may also cause excessive blood loss, infection, knife marks and scars after operation. For example, some smokers do not smoke, and it is easy to grow scabs in the process of wound healing after surgery.
