Article 2 Whoever engages in the transportation of construction waste (engineering dregs) and related activities in the urban areas of this Municipality shall abide by these Measures.
The term "transportation of construction waste (engineering dregs)" as mentioned in these Measures refers to the transportation of waste soil, materials and other wastes produced in the process of new construction, renovation and expansion of construction projects and the repair and demolition of buildings and structures.
Article 3 Departments of transportation, city appearance and sanitation, housing and construction, public security, finance, price, environmental protection, landscaping, water conservancy (water affairs) and so on shall, according to their respective functions and duties, do a good job in the transportation management of construction waste (engineering dregs) according to law.
Article 4 Construction waste (engineering dregs) transport vehicles shall be equipped with closed transport machinery or closed covering devices, and equipped with traveling and loading and unloading recorders or positioning systems and corresponding construction waste sorting and transportation equipment.
Construction waste (engineering dregs) transport vehicles shall be sealed, and mechanical devices such as side-opening flat cover closed carriage cover, side protection device, rear lower protection device, blind-mending exterior rearview mirror shall be installed in accordance with the provisions of the municipal public security organ, and shall be verified and filed by the vehicle management agency of the municipal public security organ.
Article 5 Units engaged in the transportation of construction waste (engineering dregs) shall have the qualification of road transport operation, obtain the road transport operation license issued by the road transport management institution affiliated to the transportation department, transport vehicles shall obtain the road transport license, and vehicle drivers shall have the corresponding road transport qualification certificate.
Article 6 Units engaged in the transportation of construction waste (engineering waste residue) shall apply to the municipal administrative department of city appearance and environmental sanitation for a construction waste (engineering waste residue) disposal certificate, and submit the following materials:
Business license issued by the administrative department for industry and commerce;
(two) the road transport business license issued by the road transport management institution;
(3) The record certificate of transport vehicle inspection issued by the vehicle management institution of the public security organ;
(4) Having office space, full-time management and safety management personnel and a sound safety production management system that are suitable for the business scale.
Seventh units engaged in the transportation of construction waste (construction waste) shall obtain the construction waste (construction waste) disposal certificate before going to the traffic management department of the municipal public security organ to handle the "Construction Waste (Construction Waste) Transport Vehicle Pass".
Provisions on road traffic management of construction waste (engineering dregs) transport vehicles shall be formulated separately by the traffic management department of the municipal public security organ.
Article 8 If the construction waste (construction waste) transport vehicle does not meet the technical requirements of closed transportation and safe passage, the municipal city appearance and environmental sanitation management department shall not issue the construction waste (construction waste) disposal certificate, and the traffic management department of the municipal public security organ shall not issue the construction waste (construction waste) transport vehicle pass.
Article 9 The municipal transportation department shall publish the list of vehicles receiving road transport permits.
The traffic administrative department of the municipal public security organ shall publish the list of vehicles that have obtained the transportation permit for construction waste (engineering dregs).
The administrative department of city appearance and environmental sanitation shall publish the list of units that have obtained the disposal certificate of construction waste (engineering dregs).
Article 10 Construction waste (engineering dregs) transport vehicles shall carry relevant documents with them, travel according to the loading limit and transport route and time approved by the traffic management department of the municipal public security organ, and transport them to the approved storage, transportation and consumption places, and shall not leak, scatter or fly in the process of transportation.
Article 11 Units engaged in the transportation of construction waste (engineering dregs) shall strengthen professional ethics education and business training for employees, establish and improve various management systems and management ledgers, and regularly submit data and information to relevant departments.
Article 12 The administrative department of city appearance and environmental sanitation shall regularly organize relevant departments to jointly enforce the law on the management of construction waste (engineering dregs) transport vehicles. All relevant departments shall, in accordance with their respective management authority, implement unified supervision and inspection of the construction waste (engineering residue) transportation market.
Article 13 The traffic administrative department of the municipal public security organ shall establish an information platform for construction waste (engineering dregs) transport vehicles, and share the operation information of construction waste (engineering dregs) transport vehicles with the departments of city appearance and environmental sanitation, transportation and housing construction.
Fourteenth staff of relevant departments to carry out supervision and inspection according to law, the units and personnel under inspection shall cooperate.
Fifteenth without obtaining the road transport business license to engage in construction waste (dregs) transport business, by the road transport management institution of the transportation department shall be ordered to stop business; Illegal income, confiscate the illegal income, and impose a fine of more than 2 times the illegal income 10 times; If there is no illegal income or the illegal income is less than 20,000 yuan, a fine ranging from 30,000 yuan to 6,543,800 yuan shall be imposed.
Article 16 whoever transports construction waste (engineering dregs) without obtaining the construction waste (engineering dregs) disposal certificate shall be given a warning by the city appearance and environmental sanitation management department to the transport unit and be fined between 5,000 yuan and 30,000 yuan.
Article 17 If construction waste (engineering dregs) transport vehicles leak along the way, and the wheels are muddy and drive to pollute the road, the city appearance and environmental sanitation management department shall impose a fine of more than 5,000 yuan in 500 yuan according to the seriousness of the case.
Eighteenth in violation of other provisions of these measures, by the transportation, city appearance and environmental sanitation management, traffic management of public security organs and other departments and units in accordance with the provisions of relevant laws, regulations and rules, the implementation of administrative punishment.
Nineteenth county-level municipal people's government may refer to these measures, or formulate construction waste (engineering residue) transportation management regulations according to local conditions.
Article 20 These Measures shall come into force as of1October 2002+1day.
