Hospitals are supervised and managed by health administrative departments, and local hospitals are managed by local health bureaus at all levels.

1, the health administrative department refers to the departments in charge of medical and health administration in governments at all levels, such as the Ministry of Health, the health departments of provinces and autonomous regions, and the health bureaus of cities and counties.

2. The administrative department of health is responsible for the policy and environmental work of medical and health care, and the specific law enforcement and business work are carried out by subordinate institutions, including the Health Supervision Bureau (Institute) responsible for administrative law enforcement, the Center for Disease Prevention and Control (formerly known as the Health and Epidemic Prevention Station) responsible for the prevention and treatment of infectious diseases and chronic diseases, the Maternal and Child Health Hospital responsible for maternal and child health care, and hospitals at all levels and township hospitals.

3, the health administrative department in violation of the provisions of this Ordinance, one of the following circumstances, given a warning by the health administrative department at a higher level and ordered to make corrections within a time limit; If the circumstances are serious, the responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law:

(1) Failing to organize an investigation in time after receiving a report of major medical negligence from a medical institution;

(two) after receiving the application for handling medical malpractice disputes, it has not been reviewed or transferred to the health administrative department of the people's government at the next higher level within the specified time;

(3) Failing to transfer the major medical negligence or medical malpractice dispute that should be technically appraised by the medical association for appraisal;

(four) failing to report the local medical accidents and the administrative handling of medical institutions and medical personnel step by step according to law;

(5) Failing to conduct technical appraisal of medical accidents in accordance with the provisions of these Regulations.
