Chapter I General Provisions

Article 1 In order to standardize the management of dog-raising, safeguard the health and personal safety of citizens, and maintain environmental sanitation and social order, these Regulations are formulated in accordance with the provisions of the Implementation Measures of the Law of People's Republic of China (PRC) Municipality on the Prevention and Control of Infectious Diseases and other relevant laws and regulations, and combined with the actual situation of this Municipality.

Article 2 These Regulations shall apply to dog management activities within the administrative area of this Municipality.

These Regulations do not apply to the management of military dogs and police dogs, and the management of dogs kept by zoos, professional performance groups, scientific research institutions and other units due to special needs.

Article 3 Dog management shall follow the principles of combining management with service, combining law enforcement by administrative organs with participation of grass-roots organizations, and combining self-discipline of dog owners with public supervision.

Article 4 The legitimate rights and interests of raising dogs are protected according to law; Raising a dog shall not harm the public interest or the legitimate rights and interests of others.

Fifth people's governments at all levels are responsible for the organization and implementation of these regulations, and establish a dog management coordination mechanism composed of public security, urban management, aquatic animal husbandry and veterinary, industry and commerce, health and other departments.

The administrative departments shall, in accordance with the division of responsibilities, perform their respective duties:

(a) the public security organ is responsible for dog registration, killing rabies, sheltering abandoned dogs, and investigating illegal dog raising;

(two) the urban management department is responsible for investigating the behavior of selling dogs on the street and affecting the city appearance and environmental sanitation because of raising dogs, and is responsible for capturing the ownerless dogs and abandoned dogs in key management areas and sending them to dog shelter and rescue places for treatment; Responsible for setting up no-dog signs in public places outside the venues; Cooperate with the investigation and punishment of unlicensed dog raising and illegal dog carrying;

(3) The aquatic animal husbandry and veterinary administrative department shall be responsible for dog immunization, quarantine and other epidemic prevention work, and license and supervise dog diagnosis and treatment activities;

(four) the administrative department for Industry and commerce is responsible for the registration and supervision of activities related to dog management;

(five) the health administrative department is responsible for the health education of rabies prevention and the supply of rabies vaccine for human use; Do a good job in the use and management of rabies vaccine for human use, the diagnosis and treatment of rabies patients and the prevention and monitoring of rabies epidemic for human use.

Article 6 Villagers' committees, community residents' committees, owners' committees of residential quarters, organs, enterprises and institutions shall carry out dog-raising publicity and education activities according to law, formulate management conventions on dog-raising related matters according to law, mediate neighborhood disputes caused by dog-raising according to law, correct illegal and uncivilized dog-raising behaviors, and cooperate with relevant administrative departments to do a good job in the daily management of dog-raising.

Villagers' committees, community residents' committees and owners' committees of residential quarters shall cooperate with relevant administrative departments to carry out dog management activities, and the expenses shall be charged from the dog management fees. The specific measures shall be formulated by the Municipal People's government and the county (District) people's government.

Seventh kennel associations and other non-governmental organizations should actively advocate civilized dog raising, strengthen self-discipline, and assist in the publicity and education of dog management.

Article 8 Within the administrative area of this Municipality, the office area, hospital service area, school (including kindergarten) teaching area, student dormitory area and drinking water source protection area are no dog-raising areas.

The built-up area of this Municipality and the town built-up area where the county people's government is located, as well as other areas designated and announced by the Municipal People's government and the county (District) people's government to implement urbanization management are key management areas; Other areas are general management areas.

Chapter II Immunization and Registration

Ninth dogs in key management areas shall be subject to compulsory immunization and registration system. Dog owners must bring their dogs for immunization within 15 days from the date of raising dogs and register with the local police station. Without immunization and registration, no feeding is allowed.

Dogs in the general management area shall be subject to compulsory immunization system, and shall not be kept without immunization.

Tenth individual dogs in key management areas, each household is only allowed to raise 1.

It is forbidden to raise, manage and breed dangerous dogs in key management areas.

Dangerous dog breeds are recognized by the Municipal People's Government and announced to the public.

Eleventh key management areas of individual dog shall meet the following conditions:

(1) Having a legal identity certificate;

(2) Having full capacity for civil conduct;

(3) Having a fixed residence, and the residence is not within the range of no dog-raising areas;

(4) Having a legal and valid dog immunization certificate;

(5) There is no record of dog abandonment or abuse in the last 3 years.

Twelfth key management area units to apply for a dog shall meet the following conditions:

(1) Preservation, safety or other reasonable purposes of cultural relics under state protection, warehouses and raw materials on construction sites;

(two) the legal proof of the unit and its legal representative, and can independently bear civil liability;

(3) A sound dog management system;

(four) equipped with management personnel, dogs should undergo professional training;

(five) there are dog cages, kennels, fences and other closed captive facilities;

(six) to obtain a legal and effective dog immunization certificate.

Thirteenth units and individuals in the key management areas shall inform the villagers' committees, community residents' committees or owners' committees in the residential areas where they live, and sign a dog-raising obligation.

Fourteenth individuals in key management areas to apply for dog registration, dog owners should submit the following materials to the local police station:

(1) An application form for dog registration;

(two) the identity certificate of the dog owner;

(3) dog immunization certificate;

(four) photos of dogs that meet the requirements;

(five) the obligation of dog owners.

Units in key management areas applying for dog registration shall provide the following materials to the local police station:

(1) An application form for dog registration;

(two) the unit certificate and other relevant certification materials;

(3) dog immunization certificate;

(4) photos of dogs that meet the requirements.

Units and individuals that raise dogs imported from abroad shall also have entry quarantine certificates issued by entry-exit inspection and quarantine institutions.

Article 15 The public security police station shall, within 20 working days from the date of accepting the application for raising dogs, register and issue the dog registration certificate and dog identification card to those who meet the requirements, and set up the dog electronic identification mark; If the registration is not granted, the reasons shall be explained. The unit that accepts the application shall conduct on-the-spot verification.

Sixteenth dog registration certificate is valid for 1 year. If it is necessary to continue to raise dogs at the expiration date, the dog breeder shall apply to the original registration authority for renewal with a valid dog immunization certificate and dog registration certificate before the expiration date of 10.

Seventeenth key management areas of dog owners in any of the following circumstances, should hold the dog registration certificate to the local public security organs for change, cancellation or replacement procedures:

(1) Where the domicile is changed, it shall, within 30 days from the date of change, handle the change registration with the dog registration certificate;

(2) If the dog owner changes, it shall register the change with the dog registration certificate within 15 days from the date of change;

(three) to give up the dog, the dog should be sent to the dog shelter and rescue place, and the dog registration certificate should be cancelled at the registration authority;

(4) If the dog is dead or missing, it shall cancel the registration with relevant certification materials within 15 days from the date of death or missing; If it is not handled within the time limit, it will be regarded as abandoning the dog;

(5) If the dog registration certificate is lost, it shall, within 15 days from the date of loss, apply to the original registration authority for a replacement with the dog owner's identity certificate.

Article 18 Where a dog is allowed to breed puppies, the dog owner shall, within 90 days from the date of birth of the puppies, hand over the over-limit dogs to others or send them to the dog shelter and rescue place.

Nineteenth public security organs should establish electronic files of dog management in key management areas.

The main information of dog electronic files can be inquired by relevant departments.

Twentieth units and individuals in key management areas shall pay the dog management fee. Dog owners shall pay dog management fees when handling dog registration or dog renewal procedures at the public security organ in their place of residence.

The dog management fee is paid every year 1 time. The specific standards shall be determined by the Municipal People's Government according to law.

The management fee for raising guide dogs for the blind and supporting dogs for the disabled is exempted.

Feeding sterilized dogs, with the certificate of dog sterilization issued by the agency entrusted by the aquatic animal husbandry and veterinary department, will be charged a management fee of half.

Article 21 The dog management fee shall be turned over to the government in a centralized way, and shall be included in the financial budget management, and shall be earmarked for the expenses of dog registration digital management, dog immunization, stray dog shelter, dog rescue site construction, harmless treatment of sick and dead dogs, and participation of grass-roots organizations such as villagers' committees, community residents' committees and owners' committees in residential quarters in dog management.

Article 22 The township (town) people's government shall strengthen the management of dogs within the general administrative area, and organize the supervising agencies for animal epidemic prevention to inject rabies vaccine for dogs free of charge every year.

Dog owners in the general management area shall, in accordance with the relevant provisions of the state, regularly inject rabies vaccine for dogs. Dogs that have not been immunized shall be dealt with by the township (town) people's government according to law.

Article 23 It is forbidden to forge, alter, alter, falsely use, transfer, buy or sell certificates and certificates related to raising dogs and engaging in dog business activities.

Chapter III Daily Management

Twenty-fourth key management areas, dogs of individuals and units must comply with the following provisions:

(a) dogs raised by individuals are raised in the dog owners' residence, and dogs raised by units shall be kept in captivity or tied up, and dogs shall not be allowed to leave their homes by themselves;

(two) raising a dog shall not affect the normal work and rest of others, and barking shall be stopped promptly and effectively;

(3) Do not abandon dogs;

(four) shall not organize dog fighting activities, and shall not abuse dogs;

(5) Do not allow or drive away dogs to intimidate or hurt others;

(six) shall not implement other dog-raising behavior in violation of laws, regulations and rules.

Twenty-fifth no one is allowed to bring dogs into the following areas:

Party and government organs, hospitals, schools, kindergartens and other places for children's activities;

(2) Exhibition centers, exhibition halls, libraries, museums and art galleries;

(three) public sports venues such as stadiums (gymnasiums), swimming pools (gymnasiums) and theaters;

(4) Shopping malls, hotels and restaurants;

(five) public transport except waiting rooms (airplanes, boats) and small taxis;

(6) Parks, city squares, public green spaces and scenic spots;

(seven) other public places where dogs are prohibited.

Blind people carrying guide dogs or severely disabled people carrying assistance dogs are not subject to the restrictions stipulated in the preceding paragraph.

Twenty-sixth dogs are prohibited from entering units and business premises outside the area, and their managers or operators have the right to decide whether to prohibit or restrict dogs from entering their management or business premises.

Article 27 Villagers' committees, community residents' committees and owners' committees of residential quarters may adopt conventions to stipulate the area and time for dogs to walk in villages, communities or residential quarters.

Twenty-eighth key management areas, individual dogs shall comply with the following provisions:

(a) carrying a dog registration certificate and a dog immunization certificate, wearing a dog identification card for the dog, and being led by a person with full capacity for civil conduct, paying attention to avoiding the elderly, the disabled, pregnant women and children;

(two) small dogs are only allowed to use dog ropes and chains with a length of not more than 2 meters; Large dogs are only pulled by dog ropes and chains with a length not exceeding 1.5m;

(three) to take a small taxi with a dog, the driver must agree, and put a muzzle on the dog or put the dog in a dog bag (cage);

(four) to bring a dog into the elevator, it is necessary to put a muzzle on the dog or put the dog into a dog bag (cage); ,

(5) Do not feed dogs in public places;

(six) timely removal of dog excrement.

Twenty-ninth dogs entering key management areas shall meet the requirements of key management areas.

Thirtieth units or individuals that transport dogs through key management areas shall put dogs into dog cages, and dogs shall not stay in key management areas for more than 24 hours.

Thirty-first dogs cause personal or property damage to others, dog owners should bear corresponding legal responsibilities according to law.

If a dog endangers traffic safety and causes its own casualties, the driver of the vehicle shall not be liable for compensation.

Thirty-second dogs that hurt people or are suspected of suffering from rabies shall be sent to the dog rescue site for quarantine by the supervising agency for animal epidemic prevention in time; For dogs diagnosed with rabies, the aquatic animal husbandry and veterinary administrative department shall take extermination measures according to law and conduct harmless treatment.

Article 33 When rabies epidemic occurs, the people's governments of cities and counties (districts) shall designate epidemic spots and epidemic areas according to the epidemic situation, and take emergency measures such as killing dogs according to law, and dog owners shall cooperate.

Chapter IV Management, Diagnosis, Treatment, Rescue and Disposal of Dogs

Thirty-fourth key management areas are prohibited from engaging in dog breeding activities.

Engaged in dog business activities, should have legal procedures.

Thirty-fifth engaged in dog breeding, trading and other production and business activities, shall comply with the following provisions:

(a) to engage in dog trading shall be carried out in dog trading places recognized by the administrative department for Industry and commerce;

(two) dog trading places shall meet the epidemic prevention conditions stipulated by the state, and be equipped with facilities such as washing, disinfection and harmless treatment of sewage and dirt;

(three) dogs should be vaccinated with rabies vaccine for animals;

(four) when trading dogs, it shall provide the buyer with animal quarantine certificate or immunization certificate and other materials;

(5) If a dog is found to be infected or suspected to be infected, it shall immediately report to the local competent department of aquatic animal husbandry and veterinary medicine or the public security organ, and protect the site, and shall not be transferred, sold or slaughtered.

Thirty-sixth dog clinics should have corresponding professional and technical personnel and corresponding equipment, facilities and places, and obtain the animal clinic license issued by the aquatic animal husbandry and veterinary administrative department according to law.

Thirty-seventh dog clinics should carry out harmless treatment of dead dogs or tissues, organs, medical and beauty wastes removed by dogs according to law, and shall not discard them at will.

Thirty-eighth city and county people's governments shall, according to the needs of dog management in this area, set up dog shelters. The dog shelter and rescue place is managed by the public security organ, which is responsible for receiving and handling the dogs delivered and confiscated according to the regulations.

The government supports and encourages qualified folk animal protection organizations and individuals to set up dog shelter and rescue places according to law to take in stray dogs and abandoned babies. The specific management measures shall be formulated separately by the municipal public security organ in conjunction with the municipal aquatic animal husbandry and veterinary, civil affairs and other departments.

Thirty-ninth dog shelter and rescue places shall notify the dog owners to claim the housed stray dogs. If no one claims it within 10 days from the date of notification, it shall be treated as a stray dog without a owner.

Dog shelter and rescue places shall take necessary immunization and medical measures for the housed dogs, establish an adoption system for abandoned dogs and stray dogs, and allow units and individuals to adopt.

Dog shelter and rescue places shall provide free information inquiry service for lost dogs to the society.

Fortieth units and individuals that raise dogs are not allowed to abandon dog carcasses at will.

Dogs that die of non-communicable diseases should be buried deep; In case of death due to infectious diseases, it shall notify the aquatic animal husbandry and veterinary administrative department to handle it according to the regulations.

Chapter V Legal Liability

Forty-first in violation of these regulations, one of the following acts shall be punished by the public security organs:

(a) in violation of the provisions of article ninth, dogs that have not been registered or immunized in key management areas shall be confiscated. At the same time, the unit shall be fined between 1000 yuan and 3,000 yuan, and the individual shall be fined between 500 yuan and 2,000 yuan.

(two) in violation of the provisions of the first paragraph of article tenth, in the key management areas, the number of individual dogs exceeds the limit, and shall be ordered to make corrections within a time limit; Overdue correction, the confiscation of overrun dogs, and impose a fine of more than 2000 yuan on individuals in 500 yuan.

In violation of the provisions of the second paragraph of article tenth of these measures, the breeding, management and breeding of dangerous dogs shall be confiscated. And impose a fine of 5000 yuan each.

(three) in violation of the provisions of the first and second paragraphs of article seventeenth, the dog shall be confiscated without going through the formalities for change according to law. Is a unit, punishable by a fine of more than 500 yuan 1000 yuan; Impose a fine of more than 200 yuan and less than 500 yuan on individuals. In violation of the provisions of the third paragraph of Article 17, the abandoned dog is not sent to the dog shelter and rescue place for treatment, or although the abandoned dog is sent to the dog shelter and rescue place for treatment, but the dog registration certificate is not held to cancel at the registration authority, the unit is fined 2000 yuan; Impose a fine of not more than 500 yuan on individuals.

(four) in violation of the provisions of the first paragraph of article twenty-fourth, it shall be ordered to make corrections, and if it refuses to make corrections, it shall be fined 1000 yuan for the unit and 200 yuan for the individual;

(5) Whoever, in violation of the provisions of Item 4 of Article 17 and Item 3 and Item 4 of Article 24, abandons or maltreats dogs shall be fined not less than 2,000 yuan in 500 yuan for the unit and not more than/kloc-0,000 yuan for the individual;

(six) in violation of the provisions of article twenty-fifth, article twenty-eighth of the first to fifth, shall be ordered to make corrections; Refuses to correct, and impose a fine of more than 200 yuan and less than 500 yuan.

Forty-second in violation of the provisions of the sixth paragraph of Article 28 of these regulations, the urban management department shall order it to remove the dog excrement in time, and if it refuses to do so, it shall be fined in 50 yuan.

Article 43 If, in violation of the provisions of Article 30 of these regulations, a unit or individual carries a dog through a key management area, fails to load the dog into a kennel or stays in the key management area for more than 24 hours, the public security organ shall impose a fine of more than 500 yuan 1000 yuan; If the circumstances are serious, the dogs shall be confiscated.

Forty-fourth other acts in violation of these regulations, laws and regulations have been punished, in accordance with its provisions. If a crime is constituted, criminal responsibility shall be investigated according to law.

Forty-fifth any unit or individual has the right to criticize, discourage, report and complain about violations of these regulations. The relevant departments that receive reports and complaints shall handle them in a timely manner.

To take revenge on informants and complainants, the public security organs shall be punished in accordance with the provisions of the Law of People's Republic of China (PRC) Municipality on Public Security Administration Punishment; If a crime is constituted, criminal responsibility shall be investigated according to law.

Forty-sixth dog owners who violate these regulations shall confiscate their dogs, and the public security organs shall cancel the dog registration certificate, and shall not apply for dog registration within 3 years.

Forty-seventh departments responsible for dog management and their staff have one of the following acts, and shall be given administrative sanctions by the supervisory organ or the administrative department at a higher level according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

(a) failing to apply for dog registration for eligible dog registration applicants or deliberately delaying the application;

(two) found problems in law enforcement inspection or received complaints and reports, not according to law or buck passing;

(three) other acts of abuse of power, dereliction of duty, favoritism.

Article 48 If a party refuses to accept a specific administrative act related to dog management made by the public security organ and other relevant administrative departments, it may apply for administrative reconsideration or bring a lawsuit to the people's court according to law.

Chapter VI Supplementary Provisions

Forty-ninth street offices under the jurisdiction of the general management area, the township (town) people's government dog management responsibilities applicable to the provisions of this Ordinance.

Article 50 These Regulations shall come into force as of August 1 2009. 1 March, 9971The Regulations of Nanning Municipality on Strictly Restricting Dog Breeding promulgated and implemented shall be abolished at the same time.
