The origin of the event

We were moved by the novice decorators, and we didn't think much at that time, so we signed with them.

The whole set of materials is too expensive and we are beginning to waver.

Years later, before I was ready to decorate, I began to seriously understand the contents of this all-inclusive package and look at the materials. As a result, I found that I couldn't choose wall tiles, floor tiles and kitchen and bathroom, and I didn't know the brand and didn't like the style. We took photos and searched one by one on the Internet. They are all small brands, and many Baidu can't find them. So we don't want to use this set meal any more, because it's too uneconomical and the quality is hard to guarantee.

When we saw Chen Jie again, we asked him if he could refund the deposit. First, he said that he had never encountered such a situation and had to ask the leader. Later, he said that he could not return it. If he does this, he will pay the penalty of 15% stipulated in the "Grand Agreement". We still thought it was expensive, so we considered another company.

About the Decoration Agreement

There are two references to expenses in the Decoration Agreement. They are:

● When Party A needs to terminate the agreement due to special circumstances, it shall notify Party B in time, and Party A shall pay Party B the completed design fee after receiving the notice.

● After signing the renovation agreement, neither party may terminate the agreement without reason. If the agreement is terminated unilaterally, it shall pay 15% of the total budget to the other party as liquidated damages.

There are two problems here: contradiction and ambiguity. Paradoxically, we need to terminate the agreement, but which one should we follow? Is it "to pay 15% of the total project cost as liquidated damages" or "to pay the design fee for the completed part of Party B upon receipt of the notice"? Or both at the same time, obviously not clear in the agreement. Vagueness: What is "special circumstances" and what is "termination without cause"? Not defined in the agreement.

Our indignation

1. Since it is all-inclusive, there is no mention of materials in the Decoration Agreement, and the designer did not mention it to us before signing the agreement, which is also unreasonable. Obviously, they are digging a hole and receiving the owners politely and kindly, but they are waiting for us to jump with ulterior motives! What I want to ask is that the owner is a rookie and doesn't know this piece. As professional players, can you pretend that you don't know anything?

2. If there is a problem to be solved, you can find a designer, but the designer's leadership is not there. The designer won't give you a phone number, and the general manager's phone number and office location don't know! Is this a problem-solving attitude?

The last key: the difference with designers.

The last key is that the deposit can be refunded, but a part of the design fee needs to be paid. This is what Chen Jie meant. This seems reasonable, but it is still a kind of fraud in disguise. Chen Jie said that he had passed the exam, and his CAD design fee was 80 yuan per square meter. Now that the CAD drawings have been produced, they have reached the final stage and can be used for construction. We must pay him the design fee according to the apartment area of 88 square meters.

But in our opinion, his drawings are only a preliminary plan, and we just apply for decoration. We can't use his drawings for construction, because he just communicated with us the plan of the TV wall, nothing else. Only this one has been rejected by us, and we are not going to use it. So he asked us for a design fee of 3 thousand yuan, which is naked fraud!
